Description
Combined Synopsis/Solicitation for Leasing and Installation of Washer and Dryers, Fort Campbell, Kentucky Classification Code: W- Lease or Rental of Equipment Solicitation Number: W91248-15-T-0010 Closing Date: 20 February 2015; 4:00 PM CST Amendment 05: This is an amendment to subject solicitation posted in FEDBizOpps on 29 October 2014. Closing date and time is 20 February 2015; 4:00 PM CST. This modification is issued after the academic dismissal of GAO Protest for the solicitation. The following clauses are hereby added and apply to this solicitation: 52.216-19 Order Limitations (OCT 1995) (a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,500.00 the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor -- (1) Any order for a single item in excess of $650,000.00; (2) Any order for a combination of items in excess $650,000.00; or (3) A series of orders from the same ordering office within 3 days that together call for quantities exceeding the limitation in subparagraph (b)(1) or (2) of this section. (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section. (d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 3 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source. (End of Clause) 252.209.7992 (DEC 2014) REPRESENTATION BY CORPORATIONS REGARDING AN UNPAID DELINQUENT TAX LIABILITY OR A FELONY CONVICTION UNDER ANY FEDERAL LAW-FISCAL YEAR 2015 APPROPRIATIONS (DEVIATION 2015-000005) Bid schedule, wage determination and Performance Work Statement have been updated. All changes are in bold and italicized on respective documents. The following information is provided in order to give all interested vendors the most current information to submit or correct their pricing. Allegation 1: The first basis for protest is that CLIN 0001 is ambiguous because it refers to a non-existent section of the PWS. Response 1: The correct paragraph number that refers to CLIN 0001 was corrected to read 1.6.15 and was administratively corrected in the PWS. Allegation 2: There is no way to price option new installations or de-installations during the option period. Response 2: The PWS was modified to include additional language of how the daily rates are intended to be used in paragraph 5.1.2.1. All option periods currently include the same language on the bid schedule and are described in the paragraphs 5.6.9. and 5.6.10. Allegation 3: There is an ambiguity in the base year on annual pricing versus daily rate pricing. Response 3: Bid schedule has been revised to clarify periods of performance and pricing for machines used less than one month. Allegation 4: There is both unfairness and ambiguity if the optional prices are used when additional machines are ordered, particularly in the last option year. Response 4: Option CLINs have been revised to allow offerors to indicate pricing for additional machines ordered during option periods. See revised bid schedule. quote mark Allegation 5: Section 5.1.1. of the PWS is ambiguous indicating two different times for installation after issuance of a delivery order.. Response 5: Paragraph 5.1.1. of the PWS was modified to indicate that contractors are allowed thirty (30) calendar days following award of the contract to install all equipment during the Phase-in period. Any additional units ordered after the Phase-In Period shall be installed within 15 days after notice to install is given. Allegation 6: What do the estimates mean for the number of machines per month that are included in the bid schedule? Response 6: This question was answered on Amendment 03 posted to GPE on 03 December 2014 that corrected the bid schedule. See revised bid schedule. Allegation 7: The solicitation fails to identify the dollar figures, quantities or days in the quote mark Order Limitations quote mark clause Response 7: Clause 52.216-19 Order Limitations (OCT 1995) has been added to the solicitation. NAICS is 532210; business size is $35.5M; acquisition is 100% setaside for Small Business Concerns.
