Table of Contents Introduction Scope of Work Specific Requirements Deliverables Performance Requirement Summary and Quality Assurance TECHNICAL EXHIBIT 1: FENCE SPECIFICATIONS TECHNICAL EXHIBIT 2: PERFORMANCE REQUIREMENTS ASSESSMENT SUMMARY TECHNICAL EXHIBIT 3: GENERAL REQUIREMENTS (SERVICES) 1.INTRODUCTION: US Army Africa (USARAF) requires the following service(s): 1.1.GENERAL: The contractor is required to prepare the site by removing the existing fence and construct a perimeter fence and gates to support the installation in Libreville Gabon. The fence is required to secure equipment. The contractor will be responsible for providing all material, manpower, and equipment. 1.2.LOCATION: Libreville, Gabon. 1.3.PERIOD OF PERFORMANCE (POP) 15-30 January 2015 1.4. NORMAL WORK HOURS: 9 a.m. to 5:30 p.m. local Accra Time. 2.SCOPE OF WORK. 2.1. Construct and install approximately 500 meters of FE6 Chain-Link Security Fence around 2.95 acres of land. Chain Link Fabric fencing shall be 2.44 meters (8 feet) high. The fence will follow the existing fence line. All pre-existing fence and concrete base must be removed. The fence line shall contain two locking personnel gates, as well as, two locking vehicle gates. The gates will be on the western perimeter near the main public road and the eastern perimeter near the airfield runway. The Eastern Perimeter (Main Entry Control Point) and Western Perimeter (Airfield Runway). The personnel and vehicle locking gates will be adjacent to each other. Be prepared to remove all dirt and vegetation within 32.81 feet (10 m) of the fence and external perimeter and add gravel to the cleared 10m of land. Remove all dirt and vegetation within 50 feet (15.24 m) of the internal portion of the fence. Remove all dirt and vegetation as required to clear space for fence installation. Properly dispose of all waste materials in accordance with all applicable local laws and regulations. Waste materials shall be removed from the site. Level and or build-up ground as appropriate for construction 2.2.The contractor shall include all site prep. The Contractor shall use new materials specifically purchased for this project. The Contractor shall perform all work in accordance with this PWS. The Contractor shall coordinate all work with the Contracting Officer (KO) and Contracting Officer Representative (COR) and is subject to the work schedule as stated in this document. 3.SPECIFICATIONS: 3.1.Fencing. The contractor shall remove the existing fence structure then install all fencing, pedestrian gates, and vehicle gates in accordance with the attached standards. See Technical Exhibit 1 for additional fencing details. 4.DELIVERABLES 4.1.Daily Reports. The contractor shall produce a daily status report to the COR. The format will include the following: a daily list of personnel performing on the work site by name, employer and task. 4.2.GOVERNMENT FURNISHED ITEMS AND SERVICES: N/A 5. PERFORMANCE REQUIREMENTS SUMMARY (PRS) AND QUALITY ASSURANCE (QA): 5.1.The contractor shall establish a quality control program. 5.2.The contractor shall utilize qualified personnel to perform the requirements of the contract. The contractor shall provide personnel appropriate to the requirements of this contract. The contractor shall maximize opportunities to use host country national personnel, materials, products and equipment. The contractor shall, to the maximum extent practicable, hire host country national (HCN) personnel in cooperation with the diplomatic agreements between the U.S. Government and the host nation. The contractor shall have exclusive supervisory authority and responsibility over employees. 5.3.The contractor shall be assessed for performance of services by the Contracting Officer or COR according to the measures identified in Technical Exhibit 2. 5.4. DEFINITIONS: 5.5.CONTRACTING OFFICER (KO). The Service member or Department of Defense civilian with the legal authority to enter into, administer, modify, and/or terminate contracts. 5.6.CONTRACTING OFFICER'S REPRESENTATIVE (COR). A COR is responsible for monitoring contract performance and performing duties specified by their appointment letter. The contractor will only take direction from the Contracting Officer (KO) or Contracting Officer Representative (COR). The limit of the CORs authority will be in writing and given to the contractor. Figure 2 - Site Access Figure 3 - Existing Site Plan Figure 4 - Site Image from NW Figure 5 - Vegetation and Brush in work area TECHNICAL EXHIBIT 1: FENCE SPECIFICATIONS (SEE ATTACHMENT) 5.7.Perimeter Fencing. 5.8.Responsibility: The contractor shall complete the construction as defined in the attached drawings and exhibits to provide a secure perimeter as detailed in the PWS. 5.9.Material: Materials shall be standard products of a manufacturer regularly engaged in the manufacturing of such products. 5.10.Security: The Contractor shall be responsible for the receipt, unloading, security and handling of materials required for the completion of this work. The contractor shall identify storage area requirements and coordinate all locations with the KO or COR. 5.11.Required Items: See material specifications and Chain-Link Security Fence Details. This diagram provides installation and material specifications. Construct and install 8 foot tall chain link fabric fencing wire. The fence shall be triple strand barb wire in a V formation secured to the top. The fence is supported by a tension wire at the top and a tension wire at the bottom running the entire length of the fence. The fence is also supported by bracing rails running the entire length of the fence. The fence posts are supported by a concrete foundation that is 1 foot x 1 foot x 2 feet deep. The fence line shall contain two locking personnel gates, as well as two locking vehicle gates. The gates will be on the western perimeter near the main public road and the eastern perimeter near the airfield runway. The personnel and vehicle locking gates will be adjacent to each other. Posts for gates are supported by a concrete foundation that is 1.5 foot x 1.5 foot x 3 feet deep. 5.12.Personnel Gate. The gate opening inward is a height that is equal to the finished height of the fence structure and width of approximately one hundred (100 cm) (3.28 feet). 5.13.Vehicle gate: Shall be a double leaf gate. The width of the gate opening will be approximately five and one half (5.5) meters (18.04 feet). The gate opening will have no overhang when opened fully, to allow vehicles of any height to pass through unimpeded. 6.Material Specifications 6.1. Chain Link Fence Materials. Gate and line posts: Gate and line posts, shall be installed to a depth equal to the difference between the proposed fence height and the specified pipe length shown. Posts shall be set in the center of the concrete pile. The top of the concrete footer shall be sloped to shed water away from the posts and be installed to meet finished grade. Posts shall be plumbed and set to give correct alignment. There will be no bending of posts to give correct alignment. Weatherproof post tops/caps shall be securely attached to eliminate removal by hand. Eye top caps shall allow for the insertion of a top rail in a horizontal position. Maximum spacing between centerline of posts shall not exceed (3.048 meters) 10 feet apart. Straining posts shall be installed at all sharp changes in grade and where directed by the KO or COR. 6.3. All bolts and carriages: Shall be galvanized steel. Weather proof post tops/caps, receptacles Weather proof post tops/caps, receptacles, and fittings will be adequate strength and will be aluminum alloy, malleable steel or pressed steel. All ferrous metals will be hot dip galvanized. 6.4. Wire Fabric Installation: Fabric shall be stretched taut to the correct tension as specified by the manufacturer. Where posts have been installed in concrete piles, fence fabric shall not be installed until piles have cured. Fabric shall be installed on the outside of the fence. Clearance between bottom of fabric mesh and ground surface shall be no less than (30 mm) 1.1811 inch or more than (40 mm) 1.5748 inches, unless otherwise indicated on the drawing or approved by the COR. 6.5. Wire Fabric: Fabric shall be No. 9 gauge steel wire woven into a uniform (50 mm) 1.9685 inches diamond pattern mesh. Size of mesh shall be determined by measuring the minimum clear distance between the wires forming the parallel sides of the mesh. Permissible variation in size of mesh shall be 3 mm (1/8 quote mark ). Diameter of wire shall be no less than 3.68 mm (0.145 quote mark ). The top and bottom selvage shall be knuckled. Fabric shall be zinc coated before weaving by the hot dip process. Mesh fabric shall not be excessively rough, or have blisters, sal ammoniac spots, bruises or flaking. 6.6.Wire Fabric clips: Fabric clips shall be used to fasten the fabric to the top rail at 450 mm (18 inches) spacing and to line posts at 380 mm (15 inches) maximum spacing. Wires ties on the top rail and bottom rail or tension wire shall have a minimum of two twists around mesh. Tension bars, bands and bolts shall be used to fasten the fabric to terminal posts. Maximum spacing for tension bands and bolts shall be 380 mm (15 inches). Top of tension bars shall not protrude above the bottom of the top rail. The bottom tension wire shall be stretched taut along the bottom of the fabric and securely attached to all terminal and line posts and attached to the bottom edge of the fabric at 450 mm (18 inches) maximum spacing using hog rings. The top tension wire shall be stretched taut along the top of the fabric and securely attached to all terminal and line posts and attached to the top edge of the fabric at 450 mm (18 inches) maximum spacing using hog rings. 6.7.Gates: Gate frames shall be made from schedule 40 hot dip galvanized steel pipe; not less than 43 mm (1.69 inches) outside diameter, electrically welded at all joints with ample bracing to provide a rigid frame free from sag or twist. Gates shall be supplied and installed complete with hot dip galvanized malleable iron hinges, latches, and a gate latch suitable for padlock, which is accessible from the inside part of the gate. Gates 2500 mm (98 inches) or more in width shall have three hinges per section. Hinges shall permit the gate to swing back 180 degrees in line with the fence and shall be installed so as not to permit easy removal of the gate. 6.8.Top Guard: A double top guard shall be constructed on all perimeter fences. The top guard shall be an overhang of barbed wire along the top of a fence, facing outward and inward. The top guard supporting arm shall face upward at a 45 degree angle. Top guard supporting arms will be permanently affixed to the top of the fence posts to increase the overall height of the fence by at least (30 cm) 1 foot. Three strands of barbed wire spaced (15 cm) 6 inches apart should be installed on the supporting arms. The top guard of fencing adjoining gates may range from a vertical height of (45.72 cm) 18 inches to the normal 45 degree outward protection, but only for sufficient distance along the fence to open the gates adequately. The barbed wire will be twisted, double-strand, 12.5 gauge wire, zinc, or aluminum coated with four-point barbs spaced no more than (12.7 cm) 5 inches apart. The distance between strands will not exceed 6 inches. 6.9. Concrete: Concrete shall be sulphate resistant. Water-cement ratio should not exceed 0.5. The concrete will need to cure for five days before stretching wire fabric and hanging fence. Posts set in concrete need to be level and in line. 7.Site work. 7.1.The US Government will provide the contractor access to the site prior to the start of the project to gather all relevant information and take exact measurements of the site and obtain site conditions. Access will be obtained from the main highway running North and South on the Western site of the work site. 7.2.The contractor shall smooth soil around construction area and remove all debris and equipment from area once all concrete work is completed. 7.3.The contractor shall remove existing fence, haul away, and dispose of all construction related debris. 7.4.The contractor shall coordinate removal of the existing fence in order to maintain a constant secured perimeter during construction of the new fence. 8.Acceptance Tests and Approvals: Acceptance tests shall be performed by the contractor in the presence of the KO or COR on the operation of the gates. The contractor shall give advance notice prior to performing this test for Government acceptance. 9.TECHNICAL EXHIBIT 2: PERFORMANCE REQUIREMENTS ASSESSMENT SUMMARY 10.Section I. Copies of sub-contractor certifications, if subcontractors are used, shall also be retained by the contractor. Non-local national contractor personnel must comply with theater clearance requirements per Foreign Clearance Guide located at https://www.fcg.pentagon.mil/fcg.cfm. 16.PERMITS. Without additional cost to the U.S. Government, the contractor shall obtain all permits, licenses, and appointments required for the prosecution of work under this contract. The contractor shall obtain these permits, licenses, and appointments in compliance with applicable host country laws. Application, justification, fees, and certifications for any licenses required by the host government are entirely the responsibility of the contractor. 17.PERSONNEL SECURITY: Upon contract award, the contractor shall provide the Contracting Officer, COR or the U.S. Embassy a written list of personnel, including sub- contractor personnel, who will be conducting work under this contract. The list shall include full names, birth date, address and job title for all contracted and sub-contracted employees. The contractor shall ensure all employees are eligible for employment under host nation laws, have no negative police reports, and have no significant criminal charges that can affect the safety of equipment and personnel participating in the mission. 18.BACKGROUND CHECK: Award of this contract is subject to background checks conducted by the U.S. Embassy's security personnel as part of force protection at Government's sole discretion. Failure to pass a background check is justification for not awarding or terminating an existing contract. 19.INFORMATION SECURITY: The contractor and all associated employees will not disclose sensitive information obtained as a result of working this contract, to include the personal identity of personnel working in support of this mission. This includes names, addresses and other contact information. 20.FORCE PROTECTION: The contractor and all associated subcontractor employees shall comply with applicable local area policies and guidance for access security procedures provided by the U.S. Government and the host nation military. The contractor workforce must comply with all personal identity verification requirements as directed by the U.S. Government and the host nation(s). In addition to the changes otherwise authorized by the changes clause of this contract, should the force protection condition (FPCON) at any individual facility, installation or location change, the U.S. Government may require changes in contractor security matters or processes. 21.iWATCH / iSALUTE Training: The contractor and all associated subcontractors shall brief all employees on the local iWATCH / iSALUTE program (training support will be provided by the requiring activity Anti-Terrorism Officer (ATO)). This training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed prior to employees commencing performance/work, with the results reported to the COR. 22.U.S. BASED CONTRACTORS DEPLOYING TO THE USAFRICOM AOR: U.S. based contractors must comply with the theater clearance requirements provided in the Foreign Clearance Guide located at https://www.fcg.pentagon.mil/fcg.cfm. Theater clearance/entry requirements for U.S. based contractors traveling to Africa must be completed prior to travel to the area. The contractor shall submit confirmation of authorized travel to the Contracting Officer. Theater entry requirements can also be found online at http://www.africom.mil/staff-resources/travel-to-africa. U.S. based contractor employees and associated subcontractor employees must receive Government-provided AT awareness training for the area where service is performed, as directed by AR 525-13. 23.MANAGEMENT: The contractor shall provide a Program Manager (PM) or Point of Contact (POC) and an alternate (if the PM is not available) who shall be responsible for the daily performance of the work and for daily transportation synchronization. Their contact information shall be provided to the Contracting Officer prior to commencement of work. The Contractor shall provide notice to the Contracting Officer or COR of any change of the PM or his alternate within 24 hours following the change. The PM or alternate shall be physically available during normal duty hours and able to respond in person within two hours of notification by the Contracting Officer or the COR if required. The PM or alternate shall be available telephonically at all times for the duration of the performance period. The PM and alternate shall read, write, speak and understand English to the degree that they understand oral and written communications and express themselves in matters pertaining to their duties. 24.CONTRACTOR PERSONNEL STANDARDS: Contractor and sub-contractor personnel shall present a neat appearance and be easily recognizable as working for the Contractor. All work under this contract shall be performed in a professional manner. All contractor personnel performing under the contract shall have training, prior work experience, or demonstrated technical skills required to fulfill the specific contract requirements. Drivers shall be licensed in accordance with local laws for the equipment operated. 25.The Contracting Officer may require the contractor remove from the work site any employee the Contracting Officer deems incompetent, careless, unsafe or otherwise objectionable. The removal from the job site of a contractor employee does not relieve the contractor of the requirement to provide sufficient personnel to perform the work specified in the contract. 26.Contractor and sub-contractor personnel are subject to background checks conducted by US Embassy or U.S. Army security personnel as part of force protection at the U.S. Governments sole discretion. Failure to pass a background check is justification for revoking an award or terminating the contract. 27.The contractor shall not allow its employees while on duty to possess, sell, consume, or be under the influence of intoxicants, drugs, or substances that produce similar effects, including but not limited to Chat. 28.CONTRACTING OFFICER'S REPRESENTATIVE (COR). The Contracting Officer will designate, in writing, the authorized CORs for this contract. The CORs will be responsible for monitoring the performance of the Contractor and adherence to the requirements of the contract. This includes inspection and acceptance of all deliverables. The CORs will also be responsible for reviewing the bills, charges or invoices submitted by the Contractor and informing the Contracting Officer of areas where exceptions are to be taken. Multiple CORs may be necessary based on operations tempo, command guidance or Contracting Officer recommendations. 29.The CORs shall provide technical and administrative guidance on a day-to-day basis. The CORs may deliver documents to the contractor, but in no way shall any understanding or agreement, modification, change order, or other matter deviating from the term of the contract be authorized by the CORs. Purchases or changes from unauthorized persons will result in the contractor not receiving payment for costs incurred. 30.CHANGES TO THE CONTRACT: The only person authorized to make changes to the contract is the Contracting Officer. Failure to notify the Contracting Officer of changes IN ADVANCE of providing service may result in non-payment to the Contractor for work provided outside the scope of this contract. The Contracting Officer shall be notified prior to any additional services/performances necessitating contract modification (that is, those resulting in changes in cost to the Government). Only the Contracting Officer can authorize Change Orders to be issued to the contractor. The contractor will only accept Change Orders issued directly from the Contracting Officer or the COR. 31.CONTRACTOR MANPOWER REPORTING (CMR): The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the Contractor shall report ALL Contractor manpower including subcontractor manpower required for performance of this contract. The Contractor Manpower Reporting (CMR) system is a business process to collect information on funding source, contracting vehicle, organization supported, mission and function performed, and labor hours and costs for contracted efforts. The Contractor is required to completely fill in all the information in the format using the following web address: https://cmra.army.mil/. The required information includes: (1) Contracting Office, Contracting Officer, Contracting Officer's Technical Representative; (2) Contract Number, including task and delivery order number(s); (3) Beginning and ending dates covered by reporting period; (4) Contractor name, address, phone number, e-mail address, identify of Contractor employee entering data; (5) Estimated direct labor hours (including sub-Contractors); (6) Estimated direct labor dollars paid this reporting period (including sub-Contractors); (7) Total payments (including subcontractors); (8) Predominant Federal Service Code (FSC) reflecting services provided by Contractor (and separate predominant FSC for each sub-Contractor if different); (9) 32.Estimated data collection cost; (10) Organizational title associated with the Unit Identification Code (UIC) for the Army Requiring Activity (the Army Requiring Activity is responsible for providing the Contractor with its UIC for the purposes of reporting this information); (11) Locations where Contractor and sub-Contractors perform the work (specified by zip code in the United States and nearest city, country, when in an overseas location, using standardized nomenclature provided on website); (12) Presence of deployment or contingency contract language; and (13) Number of Contractor and sub- Contractor employees deployed in theater this reporting period (by country). As part of its submission, the Contractor shall also provide the estimated total cost (if any) incurred to comply with this reporting requirement. Reporting period will be the period of performance not to exceed 12 months ending September 30 of each Government fiscal year and must be reported by 31 October of each calendar year. Contractors may use a direct XML data transfer to the database server or fill in the fields on the website. The XML direct transfer is a format for transferring files from a Contractor's systems to the secure web site without the need for separate data entries for each required data element at the web site. The specific formats for the XML direct transfer may be downloaded for the web site.. 33.WIDE AREA WORKFLOW (WAWF): Electronic Submission of Payment Requests (reference DFARS Subpart 232.70). The Government will use Wide Area Work Flow (WAWF) at https://wawf.eb.mil as the electronic method to receive payment requests. Prior to contract award, the successful bidder shall be registered in WAWF and Central Contractor Registration (CCR) at www.ccr.gov for the use of WAWF for invoicing. 34.SYSTEM FOR AWARD MANAGEMENT (SAM) REGISTRATION. 34.1.NON-U.S. VENDORS. Prior to contract award, vendors should make every attempt possible to register in SAM. The Contracting Officer may assist the contractor in registration. Vendors should register at https://www.sam.gov. See FAR Clause 52.204-7, CCR Registration, for additional details. 34.2.U.S.-VENDORS. Prior to contract award, vendors shall register in SAM. The Contracting Officer may assist the contractor in registration. Vendors shall register at https://www.sam.gov. See FAR Clause 52.204-7, CCR Registration, for additional details. 35.INSURANCE: The contractor shall be bonded and/or insured against damage by employees during the performance of this contract. Bondage/insurance shall be in accordance with local and national laws. The contractor, at the contractor's expense, shall maintain enough public liability and property damage insurance during the continuance of this contract, insuring the contractor against all claims for injury and damage. The U.S. government does not provide medical insurance or medical services to contractor personnel. All medical, dental and medical insurance services, including (but not limited to) routing and emergency medical treatments, evacuation by air or ground, and ambulance services shall be the responsibility of the contractor. Occasionally medium to light vehicles will be used on the site and sometimes used by heavy equipment such as container delivery trucks and material handling equipment like cranes and tractors. 1.1.2The contractor shall clear trees, vegetation and prepare the site as required to facilitate in the installation of the fencing at Exercise Reception Facility (ERF) Libreville, Gabon The performance will require logistical support services by local vendors to ensure a successful completion. 1.2LOCATION: Libreville, Gabon - Airfield 1.3PERIOD OF PERFORMANCE (POP): to begin 12-15 January 2015. 1.3.1 The exact dates to begin work are to be coordinated through the Contracting Officer's Representative (COR) by the contractor at time of award. 1.4NORMAL WORK HOURS: 0700 to 1900 (7 a.m. to 7 p.m. Local Time) 2. SCOPE OF WORK. 2.1 Contractor shall execute grubbing and clearing of.84 Acres as specified of land inside the Exercise Reception Facility (ERF) Libreville, Gabon in accordance with Technical Exhibit 1 to facilitate site preparation for future use. Contractor shall execute Earthwork and Site Preparation of the.84 acres to facilitate use of the ERF in accordance with Technical Exhibit 2. The site will be finished with a gravel cap suitable to support containerized storage. The gravel cap should be at least 3 inches thick and will require approximately 310m3. 3.SPECIFICATIONS: 3.1. Area Grubbing and Clearing. The Contractor shall conduct grubbing, clearing, and earthwork for the outlined area shown in Paragraph 6 (ERF) Libreville, Gabon in accordance with Technical Exhibit 1. 3.2. Site Preparation Finishing. The Contractor shallconduct finishing that includes drainage management, leveling, and gravelling of the outlined area shown in Paragraph 6 (ERF) Libreville, Gabon in accordance with Technical Exhibit 2. 3.3 GOVERNMENT FURNISHED ITEMS AND SERVICES: None 4. DELIVERABLES 4.1. Daily Reports. The contractor shall establish a daily status report to the COR that shall contain the following: a daily list of personnel performing on the work site by Name, Employer and Task. 5. PERFORMANCE REQUIREMENTS SUMMARY (PRS) AND QUALITY ASSURANCE (QA): 5.1. The contractor shall establish a quality control program. 5.2. The contractor shall utilize licensed personnel to perform the requirements of the contract. The contractor shall provide personnel appropriate to the requirements of this contract. The contractor shall maximize opportunities to use host country national personnel, materials, products and equipment. The contractor shall, to the maximum extent practicable, hire host country national (HCN) personnel in cooperation with the diplomatic agreements between the USG and the host nation. 5.3. The contractor shall be assessed for performance of services by the KO or COR according to the measures identified in Technical Exhibit 2. 6. SITE OF WORK:. Figure 4 - Perspective looking toward K-Span structures TECHNICAL EXHIBIT 1: GRUBBING, TREE CLEARING, EARTHWORK SPECIFICATIONS 1.1 DESCRIPTION OF WORK The contractor shall perform the following: clear, grub, and prepare the site; remove and dispose of all debris; excavate as required; handle, store, transport, and dispose of all excavated material; all necessary sheeting, shoring, and protection work; prepare subgrades; pump and dewater as required; protect adjacent property; backfill; construction of fills and embankments; surfacing and grading; and other appurtenant work. The Contractor shall incorporate the applicable requirements of this section to the specific project. 1.2 GENERAL REQUIREMENTS The contractor shall provide adequate working space and clearances for the work to be performed therein and for installation and removal of concrete forms. Subgrade surfaces shall be clean and free of loose material of any kind when concrete is placed thereon. Figure 5 - Eastern Edge of Work Area Figure 6 - Western Edge of Work Area 1.4 CLASSIFICATION OF EXCAVATED MATERIALS No classification of excavated materials will be made. Excavation work shall include the removal and subsequent handling of all materials excavated or otherwise removed in performance of the contracted work, regardless of the type, character, composition, or condition thereof. PART 2 - PRODUCTS 2.1 EROSION CONTROL: Erosion control materials indicated in locations shown on the drawings may consist of any of the following products: a. Knitted yarn with uniform openings interwoven with strips of biodegradable paper. b. Machine-produced mat of curled wood excelsior of 80 percent, six-inch or longer fiber length, with the top side of the blanket covered with a biodegradable extruded plastic mesh. c. Any type of erosion control material approved by the Contacting Officer's Representative. PART 3 - EXECUTION 3.1 WORKMANSHIP Materials and equipment shall be installed by workmen skilled in the type of work required and in accordance with the recommendations of the manufacturer and good construction practice. 3.2 CLEARING AND GRUBBING Perform clearing and grubbing as specified herein, as required, or as shown on the drawings prior to beginning any type of earthwork on any designated area, unless specifically instructed otherwise by the Contracting Officer's Representative. 3.2.1 Clearing Cut off trees, stumps, roots, brush, and other vegetation flush with or below the original ground surface, except for such trees and vegetation as may be indicated or directed to be left standing. Do not remove trees, shrubs, or other living vegetation outside of areas that are to be cleared unless their removal is authorized by the Contracting Officer's Representative. 3.2.2. Grubbing Grubbing shall consist of the removal and disposal of stumps, roots larger than 3 inches in diameter, and matted roots from the designated grubbing areas. Excavate this material, together with logs and other organic or metallic debris not suitable for foundation purposes, and remove to a depth of not less than 18 inches below the original surface level of the ground in areas indicated to be grubbed and in areas indicated as construction areas under this contract, such as areas for buildings, airfield areas to be paved, roads, streets, shoulder areas, sidewalks, and railroad embankments. In airfield areas to be paved, excavate and remove unsuitable material to a depth in excess of 18 inches below the original ground surface where required to permit proper compaction. Fill depressions made by grubbing with satisfactory material and compact to make the surface conform with the original adjacent surface of the ground. Remove and dispose of all trees identified by the COR to interfere with physical security. 3.3 DISPOSAL OF CLEARED, GRUBBED, AND STRIPPED MATERIALS 3.3.1 Disposal of Non merchantable Materials With the exception of such timber as may be ordered salvaged as provided for above, all logs, stumps, roots, brush, rotten wood, and other refuse from the clearing and grubbing operations shall be burned, buried, scattered, chipped, piled, or windrowed, as determined by site conditions and as approved by the Contracting Officer's Representative. The Contractor shall be responsible for compliance with local laws and regulations and with reasonable practice relative to the building of fires. Burning or other disposal of refuse and debris and any accidental loss or damage attendant thereto shall be the Contractor's responsibility, but reasonable care shall be taken to prevent damage or loss. 3.3.3 Conservation of Topsoil Where indicted, remove topsoil without contamination by subsoil and spread on areas already graded and prepared for topsoil, or transport and deposit topsoil in stockpiles convenient to areas for late application or at locations specified. Strip topsoil to full depth, store separate from other excavated materials, and pull free of roots, stones larger than 2 inches in diameter, and other undesirable materials. Stockpile in designated locations or remove from the site any surplus topsoil from excavations and grading. 3.4 DITCHES, GUTTERS, AND CHANNEL CHANGES Cut ditches, gutters, and channel changes accurately to the cross sections and grades indicated. Trim and dress or remove to conform to the slope, grade, and shape of the section indicated all roots, stumps, rock, and foreign matter in the sides and bottom of ditches, gutters, and channel changes. Take care not to excavate ditches and gutters below the grades indicated. Backfill excessive ditch and gutter excavation to grade either with satisfactory, thoroughly compacted material or with suitable stone or cobble to form an adequate gutter paving as directed. Maintain all ditches and gutters excavated under this section until final acceptance of the work. Place satisfactory material excavated from ditches and channel changes in fill areas. Dispose of unsatisfactory and excess excavated material in accordance with directions in paragraph EXCAVATION. Do not deposit excavated material closer to the edges of the ditches than indicated, and in no case less than 3 feet. 3.5 BACKFILL ADJACENT TO STRUCTURES Place and compact backfill adjacent to structures uniformly and in such manner as to prevent wedging action or eccentric loading upon or against the structures. Step or serrate slopes bounding or within areas to be backfilled to prevent sliding of the fill. During backfilling operations and in the formation of embankments, do not use equipment that will overload the structure in passing over and compacting these fills. Backfill for storm drains and subdrains, including the bedding and backfill for structures other than culverts and drains, shall conform to the additional requirements in other applicable sections. 3.6 PREPARATION OF GROUND SURFACE FOR FILL Before the fill is started, strip or otherwise remove all vegetation, such as roots, brush, heavy sods, and heavy growth of grass and all decayed vegetable matter, rubbish, and other unsatisfactory material within the area upon which fill is to be placed. In no case leave unsatisfactory material in or under the fill area. Plow, step or bench, or break up, as directed, in such manner that the fill material will bond with the existing surface any sloped ground surface steeper than one vertical to four horizontal on which fill is to be placed. Wet or dry any prepared surfaces on which compacted fill is to be placed, as may be required to obtain the compaction specified. 3.7 FILLS AND EMBANKMENTS Construct fills and embankments at the locations and to lines and grades indicated. The completed fill shall conform to the shape of the typical sections indicated or shall meet the requirements of the particular case. Use material removed from the excavation in forming the fill. Place the material in successive horizontal layers of 8 to 12 inches in loose depth for the full width of the cross section and compact as required. Compact each layer before the overlaying lift is placed. 3.8 COMPACTION Moisten or aerate material as necessary to provide the moisture content that will readily facilitate obtaining compaction of the material with the equipment used. Compact each layer in accordance with the drawings and as approved by the Contracting Officer's Representative. Each layer shall be compacted with approved compaction equipment. Water content shall be maintained during the compaction procedure to prevent pumping or rutting. In all places not accessible to the rollers, compaction shall be accomplished by hand-operated power tampers. Compaction shall continue until each layer is compacted through the full depth in accordance with the drawings and as approved by the Contracting Officer's Representative. The Contractor shall make such adjustments in compacting or finishing procedures as may be directed to obtain true grades, to minimize degradation and segregation, to reduce or increase water content, and to ensure satisfactory compaction. Any materials that are found to be unsatisfactory shall be removed and replaced with satisfactory materials, or reworked, as directed by the Contracting Officer's Representative, to meet the requirements of this specification. -- End of Section -- TECHNICAL EXHIBIT 2: SITE FINISHING SPECIFICATIONS 3.9 FINISHED EXCAVATION, FILLS, AND EMBANKMENTS 3.9.1. Uniformly smooth-grade all areas covered by the project, including excavated and filled sections and adjacent transition areas. The finished surface shall be reasonably smooth, compacted, and free from irregular surface changes and in reasonable compliance with the surface drainage pattern shown on the drawings, or as directed by the Contracting Officer's Representative. The degree of finish shall be that ordinarily obtainable from blade-grader operations, except as otherwise specified. Finish ditches and gutters to permit adequate drainage. Finish the surface of areas to be turfed to a smoothness suitable for the application of gravel or turfing materials. 3.9.2. For subgrade areas to be used as a road or vehicular entrance, the following shall be accomplished as required: replace soft or otherwise unsatisfactory material with satisfactory excavated material or other approved materials; excavate rock encountered in the cut sections to a depth of 6 inches below finished grade for the subgrade; bring up low areas resulting from removal of unsatisfactory material or from excavation of rock to require grade with satisfactory materials, and shape the entire subgrade to line, grade, and cross section and compact as specified. The surface of embankments or excavated areas for road construction or other areas on which a base course or pavement is to be placed shall vary not more than 0.1 foot from the established grade and approved cross section. Other surfaces shall be finished not more than plus or minus 0.15 foot from the established grade or approved cross section. 3.9.4. Uniformly smooth-grade all areas covered by the project including excavated and filled sections and adjacent transition areas. The finished surface shall be reasonably smooth. 3.9.5. Gravel Finished Site. The completed surface of the site will be gravel covered in 3 inches of compacted gravel. Gravel will be laid on a barrier material suitable to prevent gravel and existing surface material from mixing and creating an environment for vegetative growth. 3.9.5.1.The gravel will be of a uniform shape and minimal variation of size (5/8 quote mark - or equivalent) that promotes drainage. The consistency of material will be similar to rolled stone or river rock and not have a binding capacity like crushed stone. The gravel will be of a size and laid at a depth that is conducive to foot traffic and drainage. The gravel will be cleaned prior to installation moderately free of fines and organic material. -- End of Section -- TECHNICAL EXHIBIT 3: PERFORMANCE REQUIREMENTS ASSESSMENT SUMMARY Section I. The Service member or Department of Defense civilian with the legal authority to enter into, administer, modify, and/or terminate contracts. 4.6.2. CONTRACTING OFFICER'S REPRESENTATIVE (COR). A COR is responsible for monitoring contract performance and performing duties specified by their appointment letter. The contractor will only take direction from the Contracting Officer (KO) or Contracting Officer Representative (COR). The limit of the COR's authority will be in writing and given to the contractor. TECHNICAL EXHIBIT 4 GENERAL REQUIREMENTS (SERVICES) 1. LANGUAGE: All written and oral correspondence shall be in English. 2. LEGAL COMPLIANCE AND CERTIFICATIONS: The Contractor shall hold or obtain upon award current certifications required by local law, if any, to perform the service and be registered with the Chamber of Commerce and Ministry of Defense as applicable in accordance with local laws and regulations. Copies of sub-contractor certifications, if subcontractors are used, shall also be retained by the Contractor. Non-local national contractor personnel must comply with theater clearance requirements per Foreign Clearance Guide located at https://www.fcg.pentagon.mil/fcg.cfm. 3. PERMITS. Without additional cost to the U.S. Government, the Contractor shall obtain all permits, licenses, and appointments required for the prosecution of work under this contract. The Contractor shall obtain these permits, licenses, and appointments in compliance with applicable host country laws. Application, justification, fees, and certifications for any licenses required by the host government are entirely the responsibility of the Contractor. 4. PERSONNEL SECURITY: Upon Contract award, the Contractor shall provide the Contracting Officer, COR or the U.S. Embassy a written list of personnel, including sub- contractor personnel, who will be conducting work under this contract. The list shall include full names, birth date, address and job title for all contracted and sub-contracted employees. The Contractor shall ensure all employees are eligible for employment under host nation laws, have no negative police reports, and have no significant criminal charges that can affect the safety of equipment and personnel participating in the mission. 5. INFORMATION SECURITY: The Contractor and all associated employees will not disclose sensitive information obtained as a result of working this contract, to include the personal identity of personnel working in support of this mission. This includes names, addresses and other contact information. 6. FORCE PROTECTION: The contractor and all associated subcontractor employees shall comply with applicable local area policies and guidance for access security procedures provided by the U.S. Government and the host nation military. The contractor workforce must comply with all personal identity verification requirements as directed by the U.S. Government and the host nation(s). In addition to the changes otherwise authorized by the changes clause of this contract, should the force protection condition (FPCON) at any individual facility, installation or location change, the U.S. Government may require changes in contractor security matters or processes. 6.1. iWATCH / iSALUTE Training: The contractor and all associated subcontractors shall brief all employees on the local iWATCH / iSALUTE program (training support will be provided by the requiring activity Anti-Terrorism Officer (ATO)). This training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed prior to employees commencing performance/work, with the results reported to the COR. 6.2. U.S. BASED CONTRACTORS DEPLOYING TO THE USAFRICOM AOR: U.S. based contractors must comply with the theater clearance requirements provided in the Foreign Clearance Guide located at https://www.fcg.pentagon.mil/fcg.cfm. Theater clearance/entry requirements for U.S. based contractors traveling to Africa must be completed prior to travel to the area. The contractor shall submit confirmation of authorized travel to the Contracting Officer. Theater entry requirements can also be found online at http://www.africom.mil/staff-resources/travel-to-africa. U.S. based contractor employees and associated subcontractor employees must receive Government-provided AT awareness training for the area where service is performed, as directed by AR 525-13. 7. MANAGEMENT: 7.1. The Contractor shall provide a Program Manager (PM) or Point of Contact (POC) and an alternate (if the PM is not available) who shall be responsible for the daily performance of the work and for daily transportation synchronization. Their contact information shall be provided to the Contracting Officer prior to commencement of work. The Contractor shall provide notice to the Contracting Officer or COR of any change of the PM or his alternate within 24 hours following the change. The PM or alternate shall be physically available during normal duty hours and able to respond in person within two hours of notification by the Contracting Officer or the COR if required. The PM or alternate shall be available telephonically at all times for the duration of the performance period. 7.2. The PM and alternate shall read, write, speak and understand English to the degree that they understand oral and written communications and express themselves in matters pertaining to their duties. 8. CONTRACTOR PERSONNEL STANDARDS: 8.1. Contractor and sub-contractor personnel shall present a neat appearance and be easily recognizable as working for the Contractor. All work under this contract shall be performed in a professional manner. All Contractor personnel performing under the contract shall have training, prior work experience, or demonstrated technical skills required to fulfill the specific contract requirements. Drivers shall be licensed in accordance with local laws for the equipment operated. 8.2. The Contracting Officer may require the Contractor remove from the work site any employee the Contracting Officer deems incompetent, careless, unsafe or otherwise objectionable. The removal from the job site of a Contractor employee does not relieve the Contractor of the requirement to provide sufficient personnel to perform the work specified in the contract. 8.3. Contractor and sub-contractor personnel are subject to background checks conducted by US Embassy or U.S. Army security personnel as part of force protection at the U.S. Governments sole discretion. Failure to pass a background check is justification for revoking an award or terminating the contract. 8.4. The Contractor shall not allow its employees while on duty to possess, sell, consume, or be under the influence of intoxicants, drugs, or substances that produce similar effects, including but not limited to Chat. 9. CONTRACTING OFFICER'S REPRESENTATIVE (COR). 9.1. The Contracting Officer will designate, in writing, the authorized CORs for this contract. 9.2. The CORs will be responsible for monitoring the performance of the Contractor and adherence to the requirements of the contract. This includes inspection and acceptance of all deliverables. The CORs will also be responsible for reviewing the bills, charges or invoices submitted by the Contractor and informing the Contracting Officer of areas where exceptions are to be taken. Multiple CORs may be necessary based on operations tempo, command guidance or Contracting Officer recommendations. 9.3. The CORs shall provide technical and administrative guidance on a day-to-day basis. The CORs may deliver documents to the contractor, but in no way shall any understanding or agreement, modification, change order, or other matter deviating from the term of the contract be authorized by the CORs. Purchases or changes from unauthorized persons will result in the contractor not receiving payment for costs incurred. 10. CHANGES TO THE CONTRACT: The only person authorized to make changes to the contract is the Contracting Officer. Failure to notify the Contracting Officer of changes IN ADVANCE of providing service may result in non-payment to the Contractor for work provided outside the scope of this contract. The Contracting Officer shall be notified prior to any additional services/performances necessitating contract modification (that is, those resulting in changes in cost to the Government). Only the Contracting Officer can authorize Change Orders to be issued to the contractor. The contractor will only accept Change Orders issued directly from the Contracting Officer or the COR. 11. CONTRACTOR MANPOWER REPORTING (CMR): The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the Contractor shall report ALL Contractor manpower including subcontractor manpower required for performance of this contract. The Contractor Manpower Reporting (CMR) system is a business process to collect information on funding source, contracting vehicle, organization supported, mission and function performed, and labor hours and costs for contracted efforts. The Contractor is required to completely fill in all the information in the format using the following web address: https://cmra.army.mil/. The required information includes: (1) Contracting Office, Contracting Officer, Contracting Officer's Technical Representative; (2) Contract Number, including task and delivery order number(s); (3) Beginning and ending dates covered by reporting period; (4) Contractor name, address, phone number, e-mail address, identify of Contractor employee entering data; (5) Estimated direct labor hours (including sub-Contractors); (6) Estimated direct labor dollars paid this reporting period (including sub-Contractors); (7) Total payments (including subcontractors); (8) Predominant Federal Service Code (FSC) reflecting services provided by Contractor (and separate predominant FSC for each sub-Contractor if different); (9) Estimated data collection cost; (10) Organizational title associated with the Unit Identification Code (UIC) for the Army Requiring Activity (the Army Requiring Activity is responsible for providing the Contractor with its UIC for the purposes of reporting this information); (11) Locations where Contractor and sub-Contractors perform the work (specified by zip code in the United States and nearest city, country, when in an overseas location, using standardized nomenclature provided on website); (12) Presence of deployment or contingency contract language; and (13) Number of Contractor and sub- Contractor employees deployed in theater this reporting period (by country). As part of its submission, the Contractor shall also provide the estimated total cost (if any) incurred to comply with this reporting requirement. Reporting period will be the period of performance not to exceed 12 months ending September 30 of each Government fiscal year and must be reported by 31 October of each calendar year. Contractors may use a direct XML data transfer to the database server or fill in the fields on the website. The XML direct transfer is a format for transferring files from a Contractor's systems to the secure web site without the need for separate data entries for each required data element at the web site. The specific formats for the XML direct transfer may be downloaded for the web site.. 12. WIDE AREA WORKFLOW (WAWF): Electronic Submission of Payment Requests (reference DFARS Subpart 232.70). The Government will use Wide Area Work Flow (WAWF) at https://wawf.eb.mil as the electronic method to receive payment requests. Prior to contract award, the successful bidder shall be registered in WAWF and Central Contractor Registration (CCR) at www.ccr.gov for the use of WAWF for invoicing. 13. SYSTEM FOR AWARD MANAGEMENT (SAM) REGISTRATION. 13.1. NON-U.S. VENDORS. Prior to contract award, vendors should make every attempt possible to register in SAM. The Contracting Officer may assist the contractor in registration. Vendors should register at https://www.sam.gov. See FAR Clause 52.204- 7, CCR Registration, for additional details. 13.2. U.S.-VENDORS. Prior to contract award, vendors shall register in SAM. The Contracting Officer may assist the contractor in registration. Vendors shall register at https://www.sam.gov. See FAR Clause 52.204-7, CCR Registration, for additional details. 14. INSURANCE: The Contractor shall be bonded and/or insured against damage by employees during the performance of this contract. Bondage/insurance shall be in accordance with local and national laws. The Contractor, at the Contractor's expense, shall maintain enough public liability and property damage insurance during the continuance of this contract, insuring the Contractor against all claims for injury and damage. The U.S. government does not provide medical insurance or medical services to Contractor personnel. All medical, dental and medical insurance services, including (but not limited to) routing and emergency medical treatments, evacuation by air or ground, and ambulance services shall be the responsibility of the Contractor.
