- The U.S. Army Corps of Engineers (USACE) Omaha District, Contracting Division intends to negotiate and award on a sole source basis, a construction contract to Kiewit-Turner, a Joint Venture (KT) for the continued construction of the Department of Veteran Affairs' (VA) Eastern Colorado Health Care System (ECHCS) Replacement Medical Center in Aurora, Colorado. The Medical Center has 11 buildings connected by a four-level concourse, consisting of a diagnosis and treatment facility; two (2) inpatient and three (3) outpatient facilities; a research building, a central energy plant; and three (3) separate garages. The sole source award will permit KT to complete construction of the ECHCS that is currently partially physically complete. The contract will establish the terms and conditions upon which the contractor will perform a wide variety of construction tasks necessary to complete the construction of the ECHCS Replacement Medical Center. The magnitude of construction for a contract award resulting from this Notice of Intent is estimated at over $500,000,000 and is subject to availability of funds. The proposed contract action is for construction services that the Government intends to solicit and negotiate with only one source pursuant to Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. Per FAR 6.302-1(a)(2)(iii), these services are deemed to be available only from the original source, KT, for the continued provision of highly specialized services since an award to any other source would likely result in substantial duplication of cost to the Government that is not expected to be recovered through competition, as well as unacceptable delays in fulfilling the agency's requirements. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS and no solicitation will be issued; however, any System for Award Management (SAM) registered firm that believes it can meet the requirement may give written notification to the Contracting Officer in the form of a capability statement. Supporting evidence in sufficient detail that demonstrates the ability to comply with the requirement listed must be furnished to the point of contact listed below by 10:00 AM CST on Monday, March 2, 2015. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. The USACE, Omaha District, will not reimburse for any costs connected with supplying sufficient detail to demonstrate the ability to comply with the requirement listed. This acquisition falls under Classification Code Y, Construction of Structures and Facilities; and the North American Industrial Classification System code 236220, Commercial and Institutional Building Construction with a size standard of $36,500,000.
