Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. The commercial items procedures of FAR Part 12 will be used. Solicitation# RFQ #VA256-15-Q-0311. This solicitation is issued as request for quotation (RFQ). Solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-77, effective November 13, 2014. This is a total set-aside for Service-Disabled Veteran-Owned Small Businesses only. NAICS code is 238390, size standard is $15.0 MILLION. POC: Jennifer Adams, Contract Specialist Phone: 601-206-6955 Email: Jennifer.Adams7@va.gov STATEMENT OF WORK The Contractor shall furnish all necessary supervision, labor, tools and materials to disconnect existing utilities connections (E.g. laboratory gases, drain piping, HVAC, etc.) to biological safety cabinets (BSC) and chemical fume hoods (CFH). Contractor shall repair wall and floor finishing as need to match surroundings. Contractor shall provide miscellaneous work as need to site prep the surrounding were new units will be installed. (E.g. Drywalls, Flooring, Ceiling Tiles, etc.). Contractor shall permanently cap some utilities piping connections and reconnect utilities piping and/or ventilation exhaust duct to others match new BSC, CFH and Laminar Flow Work Stations (LFWS) as described below. (See detailed description for each cabinet). Contractor shall balance rooms as noted. All contractor work to be performed in main building of the Michael E. Debakey VA Medical Center in Houston, TX. Working hours for this project will be varying depending on the room worked. Some locations will be during normal working hours 8:00 am - 3:30 pm, other location will required after hours work from 8:00 pm - 3:30 am. Working schedule will be discussed in advance with Contracting Officer Representative (COR). Contractor will require having a pro-active communication with cabinet vendor in order to correlate specific tasks to be completed by each. All communication shall be coordinated with the COR. Description I. Contractor shall remove utilities to six auxiliary air fume hoods in rooms 3A-110, 3A-120, 3A-210 and 3A-211(3). This includes but no limited to laboratory gases, supply and exhaust ductwork, laboratory vacuum, water, electrical power, etc. Contractor shall coordinate with COR or ECC to assist in shutting down utilities zone affecting the hoods prior to disconnection. Existing exhaust and supply ductwork transition from unit to existing ductwork shall be removed and disposed within industry standards. All ventilation exhaust ductwork shall be temporary capped to maintain cleanliness during further work. Supply duct work from make-up units shall be permanently capped and contractor shall coordinate with Building ECC in order to shut down make up air units. All laboratory air, gas, vacuum and water piping shall be permanently capped at rooms 3A-110 and 3A-210. Vacuum, water and gas piping shall be permanently capped at room 3A-120. At room 3A-211 a total of 3 chemical fume hoods will be replaced with one. All laboratory gas, air and vacuum piping shall be permanently capped for two of the hood and gas and water piping should be permanently capped for the remaining one. After removal of utilities government will remove existing units. After units are removed contractor shall repair any damage flooring, wall or tile ceiling as result of the removal or existing damage assessed during removal. These repairs shall match surrounding and should comply with latest VA design guide and Specs for each work discipline (VA Design Guides and Specs could be found at Appendix A). For detailed information and location removal of units refer to table 1. II. Contractor shall install utilities to one by-pass fume hoods in room 3A-110. This includes exhaust ductwork, electrical power, hood control devices etc. Government will provide units in place before work to begin. Contractor shall provide new ventilation ductwork to connect units to existing exhaust duct. Contractor shall modify or provide laboratory new air and vacuum piping and ventilation ductwork to fit new units (Detailed manufacturer drawings are provided in Appendix B) and install in accordance with manufacturers guidance, NFPA 99, NFPA 54 and latest VA Design Guides and Specs (VA Design Guides and Specs could be found at Appendix A). QUALITY CONTROL I. Mechanical, electrical and associated systems shall be safe, reliable, efficient, durable, easily and safely operable, maintainable, and accessible. II. Standard Products: Material and equipment shall be the standard products of the selected manufacturer, and they should be regularly engaged in the manufacture of such products for at least 3 years. III. All items furnished shall be free from defects that would adversely affect the performance, maintainability and appearance of individual components and overall assembly. IV. Standard Products: Material and equipment shall be the standard products of a manufacturer regularly engaged in the manufacture of the products for at least 3 years. V. The design, model and size of each item shall have been in satisfactory and efficient operation on at least three installations for approximately three years. VI. Electrical Components and Devices: UL listed and labeled for intended use. CONSTRUCTION SECURITY REQUIREMENETS I. Security Plan: i. The security plan defines both physical and administrative security procedures that will remain effective for the entire duration of the project. ii. The General Contractor is responsible for assuring that all sub-contractors working on the project and their employees also comply with these regulations. II. Security Procedures: i. Contractors are required to submit all personal information for a background investigation before MEDVAMC's Human Resources issues a badge. General Contractor's employees shall not enter the project site without appropriate badge. They may also be subject to inspection of their personal effects when entering or leaving the project site. ii. For working outside the "regular hours" as defined in the contract, The General Contractor shall give 7 day notice to the Contracting Officer so that arrangements can be provided for the employees. This notice is separate from any notices required for utility shutdown described later in this section. iii. No photography of VA premises is allowed without written permission of the Contracting Officer. iv. VA reserves the right to close down or shut down the project site and order General Contractor's employees off the premises in the event of a national emergency. The General Contractor may return to the site only with the written approval of the Contracting Officer. FIRE SAFETY I. Hot Work: Perform and safeguard hot work operations in accordance with NFPA 241 and NFPA 51B. Coordinate with Project Engineer to obtain a hot work permit from facility Safety Officer in advance of the work. II. Fire Hazard Prevention and Safety Inspections: Inspect entire construction areas weekly. Coordinate with, and report findings and corrective actions weekly to Project Engineer. III. Smoking: Smoking is prohibited in and adjacent to construction areas, inside existing buildings, and additions under construction. IV. Dispose of waste and debris in accordance with NFPA 241. Remove from buildings daily. OPERATIONS AND STORAGE AREAS I. The Contractor shall confine all operations (including storage of materials) on Government premises to areas authorized or approved by the Contracting Officer or his/her representative. The Contractor shall hold and save the Government, its officers and agents, free and harmless from liability of any nature occasioned by the Contractor's performance. II. The Contractor shall, under regulations prescribed by the Contracting Officer, use only established roadways as authorized by the Contracting Officer. When materials are transported in prosecuting the work, vehicles shall not be loaded beyond the loading capacity recommended by the manufacturer of the vehicle or prescribed by any Federal, State, or local law or regulation. When it is necessary to cross curbs or sidewalks, the Contractor shall protect them from damage. The Contractor shall repair or pay for the repair of any damaged curbs, sidewalks, or roads. III. Working space and space available for storing materials shall be as determined by the Project Engineer. IV. Workmen are subject to rules of Medical Center applicable to their conduct. V. Execute work so as to interfere as little as possible with normal functioning of Medical Center as a whole. Use of equipment and tools that transmit vibrations and noises through the building structure, are not permitted in buildings that are occupied except as permitted by the Project Engineer. i. Do not store materials and equipment in other than assigned areas. ii. Schedule delivery of materials and equipment to immediate construction working areas within buildings in use by Department of Veterans Affairs in quantities sufficient for the storage space provided. Provide unobstructed access to areas required to remain in operation. VI. Building 100 will be occupied during performance of work. The contractor shall take all measures and provide all material necessary for protecting entrances, existing equipment and property in affected areas of construction against safety hazards, dust and debris, so that equipment and affected areas to be used in the Medical Centers operations will not be hindered. Contractor shall permit access to Department of Veterans Affairs personnel through other construction areas which serve as routes of access to such affected areas and equipment. Coordinate alteration work in areas occupied by Department of Veterans Affairs so that Medical Center operations will continue during the construction period. VII. Abandoned Lines: All service lines such as wires, cables, conduits, ducts, pipes and the like, and their hangers or supports, shall be removed PROTECTION OF EXISTING STRUCTURES, EQUIPMENT, UTILITIES, AND IMPROVEMENTS The Contractor shall protect from damage all existing improvements and utilities at or near the work site and on adjacent property of a third party, the locations of which are made known to or should be known by the Contractor. The Contractor shall repair any damage to those facilities, including those that are the property of a third party, resulting from failure to comply with the requirements of this contract or failure to exercise reasonable care in performing the work. If the Contractor fails or refuses to repair the damage promptly, the Contracting Officer may have the necessary work performed and charge the cost to the Contractor. RESTORATION I. Remove, cut, alter, replace, patch and repair existing work as necessary to install new work. Except as otherwise shown or specified, do not cut, alter or remove any structural work, and do not disturb any ducts, plumbing, steam, gas, or electric work without approval of the Project Engineer. Existing work to be altered or extended and that is found to be defective in any way, shall be reported to the Project Engineer before it is disturbed. Materials and workmanship used in restoring work, shall conform in type and quality to that of original existing construction, except as otherwise shown or specified. II. Upon completion of contract, deliver work complete and undamaged. Existing work (walls, ceilings, partitions, floors, mechanical and electrical work, lawns, paving, roads, walks, etc.) disturbed or removed as a result of performing required new work, shall be patched, repaired, reinstalled, or replaced with new work, and refinished and left in as good condition as existed before commencing work. III. At Contractor's own expense, Contractor shall immediately restore to service and repair any damage caused by Contractor's workmen to existing piping and conduits, wires, cables, etc., of utility services or of fire protection systems and communications systems (including telephone) which are indicated on drawings and which are not scheduled for discontinuance or abandonment. AVAILABILITY AND USE OF UTILITY SERVICES The Government shall make all reasonably required amounts of utilities available to the Contractor from existing outlets and supplies.? (a) Each service employee, laborer, or mechanic employed in the United States (the 50 States and the District of Columbia) in the performance of this contract by the prime Contractor or any subcontractor, regardless of any contractual relationship which may be alleged to exist between the Contractor and service employee, laborer, or mechanic, shall be paid not less than the applicable minimum wage under Executive Order 13658. The minimum wage required to be paid to each service employee, laborer, or mechanic performing work on this contract between January 1, 2015, and December 31, 2015, shall be $10.10 per hour. (b) The Contractor shall adjust the minimum wage paid under this contract each time the Secretary of Labor's annual determination of the applicable minimum wage under section 2(a)(ii) of Executive Order 13658 results in a higher minimum wage. Adjustments to the Executive Order minimum wage under section 2(a)(ii) of Executive Order 13658 will be effective for all service employees, laborers, or mechanics subject to the Executive Order beginning January 1 of the following year. The Secretary of Labor will publish annual determinations in the Federal Register no later than 90 days before such new wage is to take effect. The Secretary will also publish the applicable minimum wage on www.wdol.gov (or any successor website). The applicable published minimum wage is incorporated by reference into this contract. (c) The Contracting Officer will adjust the contract price or contract unit price under this clause only for the increase in labor costs resulting from the annual inflation increases in the Executive Order 13658 minimum wage beginning on January 1, 2016. The Contracting Officer shall consider documentation as to the specific costs and workers impacted in determining the amount of the adjustment. (d) The Contracting Officer will not adjust the contract price under this clause for any costs other than those identified in paragraph (c) of this clause, and will not provide price adjustments under this clause that result in duplicate price adjustments with the respective clause of this contract implementing the Service Contract Labor Standards statute (formerly known as the Service Contract Act) or the Wage Rate Requirements (Construction) statute (formerly known as the Davis Bacon Act). If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers. (b) General Liability: $500,000 per occurrences. (c) Automobile liability: $100,000 per person; $500,000 per occurrence and property damage. VAAR CLAUSES 1. 852.203-70 Commercial Advertising (JAN 2008) The bidder or offeror agrees that if a contract is awarded to him/her, as a result of this solicitation, he/she will not advertise the award of the contract in his/her commercial advertising in such a manner as to state or imply that the Department of Veterans Affairs endorses a product, project or commercial line of endeavor. (End of Clause) 2. 852.219-10 VA Notice of total Service-Disabled Veteran-Owned Small Business Set-Aside (Dec 2009) This solicitation includes (VAAR) 852.219-10, VA Notice of Total Service-Disabled Veteran-Owned Small Business Set- Aside. Accordingly, any contract resulting from this solicitation will include this clause. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) retained by VA to assist in assessing the contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to contractor's offices where the contractor's business records or other proprietary data are retained and to review such business records regarding the contractor's compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an "Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement" to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The contractor is required to cooperate fully and make available any records as may be required to enable the CO to assess the contractor's compliance with the limitations on subcontracting or percentage of work performance requirement. 3. 852.232-72 Electronic Submission Of Payment Requests (NOV 2012) (a) Definitions. As used in this clause- (1) Contract financing payment has the meaning given in FAR 32.001. (2) Designated agency office has the meaning given in 5 CFR 1315.2(m). (3) Electronic form means an automated system transmitting information electronically according to the Accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests. (4) Invoice payment has the meaning given in FAR 32.001. (5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract. (b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required. (c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following: (1) VA's Electronic Invoice Presentment and Payment System. (See Web site at http://www.fsc.va.gov/einvoice.asp.) (2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI). The X12 EDI Web site (http://www.x12.org) includes additional information on EDI 810 and 811 formats. (d) Invoice requirements. Invoices shall comply with FAR 32.905. (e) Exceptions. If, based on one of the circumstances below, the contracting officer directs that payment requests be made by mail, the contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for: (1) Awards made to foreign vendors for work performed outside the United States; (2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information; (3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies; (4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or (5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above. (End of Clause) 4. 852.237-70 Contractor Responsibilities (APR 1984) The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees fault or negligence, and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of Arkansas. Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from. (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
