Description
CD-492 - Sole Source Justification Statement of Work Background: The Department of Commerce (DoC) National Institute of Standards and Technology (NIST) has several contracts with: Flatirons, Inc., Surveying, Engineering & Geomatics, and Kennedy SiteWorks, LLC to address issues with the grading along Skunk Creek and the impact on the existing floodplain. The City of Boulder has requested that a hydraulic analysis be performed and a revised site grading and improvements plan be prepared that mitigates the impact of the previously constructed multi-use path and landscaping improvements adjacent to and located within the Skunk Creek Floodplain. The City of Boulder Engineering Department has been determined that a simple hydraulic analysis of the impacted Skunk Creek channel would be sufficient to demonstrate to the City of Boulder what revised grading work would be necessary to restore the flood conveyance that existed in the floodplain prior to the 2008 parking lot and access road improvements. Purpose: The purpose of this requirement is to pay for the application/permit fee to the City of Boulder for the Skunk Creek floodplain development permit to bring Skunk Creek into compliance with the 100-year floodplain requirements on the Department of Commerce-NIST, Boulder CO site, per City of Boulder Revised Code 4-20-44(b)(2). Market research shows the City of Boulder (INC) is the organization that overseas construction in floodplains for the City and County of Boulder, CO and is the only business that can provide the permit. The City of Boulder (INC) is a public sector entity, per NAICS 926130, small business size standard $7M. Recommend sole sourcing to City of Boulder (INC). Per the current Boulder Revised Code 4-20-44 Floodplain Development Permits and Flood Control Variance Fees, (b) If the floodplain development permit is for a development located within the conveyance zone or the floodway: (2) An applicant for the floodplain development permit where the city manager, pursuant to Paragraph 9-3-6(b)(3), B.R.C. 1981, requires the applicant to furnish a floodplain analysis, the applicant shall pay $3,600.00. Synopsis: The Department of Commerce (DoC) National Institute of Standards and Technology (NIST) Acquisition Management Division (AMD), on behalf of Engineering, Maintenance, Support Services Division (EMSS), intends to procure with the City of Boulder (INC), Boulder, CO on a sole source basis under the authority of FAR Subpart 6.302-1 - Only one responsible source and no other supplies or services will satisfy agency requirements, a flood plain development permit. The NAICS code is 926130. NIST anticipates awarding a firm-fixed-price purchase order the City of Boulder (INC) for this requirement in the second quarter of FY 2015. Interested parties that believe they could satisfy the requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing on or before the response date for this notice. This notice of intent is not a solicitation. Information submitted in response to this notice will be used solely to determine whether competitive procedures could be used for this acquisition.
