Description
JUSTIFICATION FOR OTHER THAN·FULL AND OPEN COMPETITION (JOFOC) Office of National Marine Sanctt1Bries (ONMS)/ Removal and Inspection of Floating Dock and Gangway Located! at Stellwagen Bank National Marine Sanctuary, Scituate MA Identification Number: WC-1330-15-SE-0411 1. ldentification of the agency and contracting activity (FAR 6.303-2(b)(1)). The.NOAA Acquisition and Grants Office (AGO) Eastern Acquisition Division located in Kansas City, proposes to enter into a contract on a basis of other than full and open competition in support of the ONMS $tellwagen Bank National Marine Sanctuary {SBNMS).located in Scituate MA. 2. The nature and/or description of the act on being approved (FAR 6.303-2(b)(1)). NOAA intends to award a firm-fixed contract to Offshore Marine, Inc. located in Greenbush MA to remove and provide an emergency inspection for a gangway and floating dock damaged by a strong storm on January 28, 2015. 3. A description of the supplies or services required to meet the agency's needs (including the estimated value) (FAR 6.303-2(b)(3)). The requirement is to provide services for the removal,cleaning, inspection, cost estimate for the repair of the northwestern gangway and dock located at the Stellwagen Bank National Marine Sanctuary (SBNMS), Scituate MA at the cost of $13,750 for the period of performance of 30 days. This will allow the ONMS Stellwagen Bank National Marine Sanctuary (SBNMS) to accomplish its mission of safely removing the dock and gangway and getting a cost determination for immediate repairs. 4. An identification of the statutory authority permitting other than full and open competition (FAR 6.303-2(b)(4)). The statutory authority permitting other than full and. open competition 41 U.S.C..253 (c)(2) as implemented by paragraph 6.302-2 (b) of the Federal Acquisition Regulation (FAR) 5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority (FAR 6.303-2(b)(5)). The northeast area has been hit with four major winter snows in the past 30 days, High winds with blizzard warnings, severe cold temperatures, and heavy snow have incapacitated the area. There is heavy damage on the shoreline with limited movement available due·to the large amount of snow on the ground.. The floating dock and· gangway are temporary secured, but they are in danger breaking away from the bank due to high winds. The danger is that if the floating dock and gangway break away from the shore line, they could float into the local harbor and cause damage to.other vessels or structures. The · replacement value for the dock and gangway is also estimated over $80 thousand. The floating dock and gangway also needs to be repaired no later than March 15, 2015, in order to facilitate boat traffic and research needs for Stellwagen Bank NMS.Failure to provide the critically needed supplies and services will impose a significant negative impact on the affected research vessels. Based on the weather, damage in the area, and SBNMS knowtedge of the area; the.Government feels that there.are limited contractors registered in System for Award Management(SAM) that react quickly enoughfor the requirement. SBNMS has identifiecl Offshore Marine, Inc. Offshore is registered in SAM and is qualified to perform the work. Because they·are l o c a l, Offshore can immediately begin work. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR 5.2 and, if not, which exception under FAR 5.202 applli ies (FAR 6.303-2(b)(6)). In accordance with FAR 5.202(a)(2). a synopsis was not issued for the services described herein. Due to the determination that the nature of this work is unusual and compelling urgency, the Government would have been seriously iinjured should this work be delayed to allow full and open competition. 7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable (FAR 6.303-2(b)(7)). The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on the technical evaluation conducted by project manager and estimator on February 4, 2015. The contractor's quote and the IGCE were very close, with the IGCE being slightly higher. 8. A description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted (FAR 6.303-2(b)(8)). N A due to the considerations listed in paragraph six above. 9. Any other facts supporting the use of other than full and open competition {FAR 6.303-2{b)(9)). All facts have been documented in paragraph five above. There are no additional facts to be reported in this section. 10. A listing of any sources that expressed a written interest in the acquisition (FAR 6.303-2(b)(10)). None. Require:ments were not synopsized due to urgency. 11. A statement of any actions the agency may take to remove or overcome any barriers to competition, iIf subsequent acquisitions are anticipated. The Govemment will continue to conduct thorough market research to gauge the marketplace capabilities for future requirements. The Government will seek competition of future acquisitions for these services. 12.
