Description
SOW INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Station Support Contracts and Simplified Acquisitions Branch (SS/SA) on behalf of the National Institute of Neurological Disorders and Stroke (NINDS) intends to negotiate and award a purchase order without providing for full and open competition (Including brand-name) to Thermo Fisher Scientific for a service agreement for a Thermo Fisher Scientific Orbitrap Elite HPLC-MS System. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 811219 with a Size Standard of $20.5 million. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-78, dated December 26, 2014. This acquisition is conducted under the procedures as prescribed in FAR subpart 12-Acquisition of Commercial Items and FAR subpart 15-Contracting by Negotiation at an amount exceeding the simplified acquisition threshold ($150,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of 41 U.S.C. 3304(a)(1) under provisions of the statutory authority of FAR Subpart 6.302-1(a)(2) - Only one responsible source and no other supplies or services will satisfy agency requirements. Background The National Institutes of Health (NIH) is the nation's leading medical research agency and the primary Federal agency whose mission is to seek fundamental knowledge about the nature and behavior of living systems and the application of that knowledge to enhance health, lengthen life, and reduce illness and disability, conducting, supporting and making medical discoveries that improve people's health and save lives. The National Institute of Neurological Disorders and Stroke (NINDS) is a part of the National Institutes of Health (NIH), conducting research into the causes, treatment, and prevention of neurological disorders and stroke. The NINDS mission is to seek fundamental knowledge about the brain and nervous system and to use that knowledge to reduce the burden of neurological disease. The NINDS Protein/Peptide Sequencing Facility (PSF) owns and operates a Thermo Fisher Orbitrap Elite HPLC-MS system. The contractor shall provide service and maintenance for all portions of the above Orbitrap Elite HPLC-MS system in order to ensure operation of the mass spectrometer at maximum performance. The servicing of this instrument requires specialized knowledge of a variety of pieces of equipment that are Thermo Fisher products. These include the following equipment: Ultimate 3000 nano HPLC, WPS-300TPL autosampler, ESI ion source, nano-ESI ion source, Orbitrap Elite mass spectrometer, ETD module for orbitrap. This Orbitrap Elite HPLC-MS system is essential to the PSF to provide the services (including protein identification, protein modification mapping, protein quantitation) for the NIH scientific community for the study of neurological and psychiatric diseases. Purpose and Objectives To procure a new service agreement for the Orbitrap Elite HPLC-MS system that will ensure timely service and maintenance by specially trained Thermo Fisher service engineers. Period of Performance Base Year - January 19, 2015 through January 18, 2016 Option Year One - January 19, 2016 through January 18, 2017 Option Year Two - January 19, 2018 through January 18, 2018 It is anticipated that this award will be a Firm Fixed Price. Project Description Please refer to the attached Statement of Work for complete details and specifications. Other Important Considerations Mandatory Criteria (Requirements) •Service engineers must be specially trained and certified to work on Thermo Fisher Ultimate 3000 HPLC and Thermo Fisher Orbitrap Eltie equipments. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research, specifically the review and evaluation of the responses to the sources sought notice published in the FedBizOpps on January 14, 2015, synopsis number HHS-NIH-NIDA-SSSA-SBSS-2015-075, entitled Service Agreement for the Thermo Fisher Orbitrap Elite HPLC-MS system (High-performance liquid chromatography (HPLC) coupling to Mass Spectrometer (MS)). A signed letter on company letterhead was provided from Thermo Fisher Scientific stating that it is the only company able to service Thermo Fisher Scientific equipment. Furthermore, third party service could void future hardware and software procurement. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by March 13, 2015 and must reference number HHS-NIH-NIDA(SSSA)-15-158.
