- Federal Acquisition Regulation (FAR) 52.212-3, Offeror Representations and Certifications - Commercial Items (MAR 2015) that must be completed and submitted with the offer. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. The procurement is conducted under Simplified Acquisition procedures pursuant to the authority of FAR Subpart 13.5, Test Program for Certain Commercial Items (10 U.S.C. 2304(g) and 2305 and 41 U.S.C. 253(g) and 253a and 253b); FAR Part 12, Acquisition of Commercial Items (Title VIII of the Federal Acquisition Streamlining Act of 1994 (Public Law 103-355)); and FAR 37.4, Nonpersonal Health Care Services (10 U.S.C. 2304 and 41 U.S.C. 253). This announcement constitutes the only solicitation; therefore, a written solicitation will not be issued. The Billings Area Indian Health Service (IHS) reserves the right to award a single contract or multiple fixed-price commercial item contracts in response to Request for Quotation (RFQ) 10-15-025-REL. The solicitation is restricted to 100% Small Business concerns. The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-80. The associated North American Industry Classification System code is 621210 and the small business size standard is $7.5 million. Potential offerors shall propose an all-inclusive hourly rate. GRAND TOTAL: $___________________. This procurement is a nonpersonal health care service contract, as defined in FAR 37.101, under which the Contractor is an independent contractor. The Government may evaluate the quality of professional and administrative services provided, but retains no control over the medical and professional aspects of services rendered (e.g., professional judgments, diagnosis for specific medical treatment). The Contractor shall indemnify the Government of any liability producing acts or omissions by the Contractor, its employees and agents occurring during contract performance. The Contractor shall maintain medical liability insurance, which is not less than the amount normally prevailing within the local community for the medical specialty concerned. The Contractor is required to ensure that its subcontracts for provisions of health care services contain the requirements of the clause at 52.237-7, including the maintenance of medical liability insurance. PERIOD OF PERFORMANCE: On or about April 1, 2015, through September 30, 2015, with four 12-month options. PURPOSE OF THE CONTRACT: To provide Pediatric Dentistry Services onsite at the Wind River Service Unit. The contractor shall visit the Fort Washakie Health Center, Fort Washakie, Wyoming, one day every week between the hours of 8:00 a.m. and 4:45 p.m. and/or the Arapahoe Health Center, Arapahoe, Wyoming, one day every week between the hours of 8:00 a.m. and 4:45 p.m. The contractor shall take a history and perform an appropriate examination. The contractor shall document patient findings in the patient's electronic health record or medical chart. The written consultation shall include the findings, impressions, and recommendations about the management of the patient care. The Government will provide space, support assistance, laboratory services, and pharmacy services. STATEMENT OF WORK: Duties primarily involve clinical services and occasional training activities. Typical duties include, but are limited to, the following as privileged. A. Standard Dental Practices/Procedures: (1) Provides oral and radiographic examination of the oral cavity and provides diagnosis of pathological or irregular conditions; (2) Participates in an integrated oral health program with other health services; (3) Training activities involve working with dental auxilliary trainees during their clinical assessments and trainings; (4) Performs restoration of simple and compound cavities with standard and prescribed material; (5) Performs single and relatively uncomplicated multiple extractions of teeth; (6) Practices prosthetic dentistry by studying patient's oral cavity to determine type of restoration required. Takes oral impressions and bite registrations for space maintenance appliances; (7) Performs uncomplicated root canal therapy; (8) Performs routine restorative procedures such as amalgams, resins and stainless steel crowns on pediatric dental patients. Fabricates and places fixed passive space maintainers where indicated. Often the use of behavior management techniques may be required. B. Difficult Dental Practices/Procedures: (1) Removes unerupted and impacted teeth, residual root tips and teeth with exostosed roots; (2) Reviews localized foreign bodies from the gingival tissues and alveolar sockets; (3) Applies corrective treatment in cases of abnormal formation where proper occlusion is difficult to attain; (4) Treats cases of rampant caries in children; treats acute cases of cellulitis associated with dental pathology; treats diseases of salivary glands and their ducts; and performs mucogingival surgery; (5) Plans and executes community dental health programs for oral disease prevention and patient education; (6) Manages actual or potential behavioral problems that require skill in patient management, involving both children and adult patients; (7) Works with difficult patients due to behavior problems either in clinic setting of quiet rooms utilizing passive restraint systems, local anesthetic and nitrous oxide or in operation room situations utilizing more profound forms of anesthesia for the children too young to be treated in the clinic with major dental reconstruction needs. C. May direct 1-2 dental support staff. D. Driving is sometimes necessary in this position. Driver's license is required. E. Performs other related duties as assigned. Works with the Chief Dental Officer, Service Unit Dental Program, who relies on the contractor to independently perform professional dental work in many cases where the dental health problems are of greater-than-usual difficulty. The contractor independently examines, diagnoses and treats commonly encountered dental diseases or oral health problems. When work involves unusual oral health problems, contractor appropriately, consults with other dental officers or refers the case for treatment by others. Contractor consults with physician when there is a medical as well as dental problem involved. Work is reviewed in terms of overall efficiency and adequacy of dental services rendered as well as conformance to policies, procedures, and practices relating to health care delivery. Professional guidance is provided by the Chief Dental Officer, Service Unit Dental Program. KNOWLEDGE AND EXPERIENCE REQUIRED: Must have a degree in DDS or DMD from a dental school accredited by the Commission on Dental Accreditation, plus completion of a residency program of 2-4 years in the specialty of Pedodontics plus 5 years or more of professional experience and training pertinent to the specialty. Must be board certified in Pediatric dentistry with a valid Wyoming Dental license and have the capability to become privileged at local hospitals. The successful contractor will have 60 days to become privileged at the local hospitals. GUIDELINES: Guidelines available include Public Health Service regulations and the Indian Health Manual, procedures, guidelines, and policies or a number of issues. In addition, traditional and currently accepted medical practices are available in the form of specialty consultation, medical journals and textbooks. The pediatric dentist's judgment is the key factor in determining whether guidelines are to be adhered to, or deviated from, or whether new guidelines need to be developed. COMPLEXITY: The work consists of the broad general practice of dentistry, involving superior knowledge in the area of dealing with problems of the primary dentition and its development related to the skeleto-facial growth patterns of children both prior to, during, and after puberty diagnosis. The contractor diagnoses and treats very difficult cases with very little or no guidance or consultation. The work includes cases in which there are both patient-behavior and patient-management problems involving minors and their parents. SCOPE AND EFFECT: The purpose of the contract is to provide services in the area of specialty Pedodontics. The appropriate National Clinical Dental Pedodontic consultant and/or Area Pedodontic specialist provides specialty professional guidance. PERSONAL CONTACTS: Personal contacts include patients, patient's families, Indian Health Service employees and representatives of other federal organizations including PHS hospitals and Indian Health Service Area Office; representatives of non-federal organizations and individuals, including medical and administrative staff of referral hospitals, tribal representatives, and other non-federal medical personnel. PURPOSE OF CONTACTS: Personal contacts are to elicit pertinent medical information from patients, who are sometimes uncooperative, skeptical or fearful. The contractor must be skillful in securing sufficient information upon which s/he will base his/her diagnosis and treatment. In addition, a significant amount of contact involve resolution of problems in treatment of patients through discussion with consulting specialists, federal and state health officials, patients and families with their own set of beliefs, objectives and goals. PHYSICAL DEMANDS: The work requires some physical exertion and stamina and involves extensive walking, standing, bending and similar activities with long periods of time sitting with periods of intense concentration while provides services to patients. Dealing with uncooperative minor patients and their parents on a regular basis. It is the contractor's responsibility to inform the Indian Health Service, Wind River Service Unit, if his/her ability to cope with the stresses is being exceeded. WORK ENVIRONMENT: The work is performed in a dental clinic setting with continual exposure to patients having a variety of illnesses and communicable diseases. In the clinic and hospital setting, the specialist is regularly exposed to radiation, airborne debris, waste anesthetic gases and wears surgical masks, gloves and eyeglasses while performing clinical work. May involve exposure to potentially violent persons. GOVERNMENT FURNISHED PROPERTY: The IHS shall provide all necessary equipment and supplies. The Wind River Service Unit will be responsible for getting the Contractor access/clearance to all pertinent computer services necessary to carry out his/her duties. COMPUTER SECURITY: Pursuant to the Federal Information Security Management Act of 2002 (FISMA), the contractor will be required to complete a course in Computer Security Awareness Training (CSAT). This training must be completed annually by all employees including contractors, volunteers, students, and summer externs. The Contractor will be required to comply with the Federal Information Processing Standards Publication (FIPS PUB) Number 201, "Personal Identity Verification of Federal Employees and Contractors," and the associated Office of Management and Budget (OMB) implementation guidance for personal identity verification for all affected contractor and subcontractor personnel. Access/clearance to all pertinent computer systems, including completing the Rules of Behavior form, Security training; and if necessary, a Business Partner Interconnection Security Agreement (BPISA), should be coordinated with the Site Manager. CONTRACTING OFFICER AUTHORITY: Authority to negotiate changes in the terms, conditions or amounts cited in this contract is reserved for the Contracting Officer. CONTRACTING OFFICER'S REPRESENTATIVE: The COR shall be responsible for: (1) Monitoring the Contractor's technical progress, including surveillance and assessment of performance and recommending technical changes; (2) Interpreting the Statement of Work; (3) Technical evaluation as required; (4) Technical inspections and acceptance; and (5) Assisting the Contractor in the resolution of technical problems encountered during performance of this contract. INVOICE SUBMISSION AND PAYMENT: The Contractor shall submit its invoice to the Chief Dental Officer at the Wind River Service Unit, PHS Indian Health Center, P.O. Box 128, Fort Washakie, Wyoming 82514. The Contractor agrees to include the following information on each invoice: (1) Contractor's name and address; (2) Contact name, title, and telephone number; (3) Contract Number; (4) Invoice number and date; (5) Description, quantity, unit of measure, unit price, and extended price of supplies delivered or services performed; (6) Remit to Address; (7) Taxpayer Identification Number (Employer Identification Number or Social Security Number); and (8) Data Universal Numbering System (DUNS) number (to ensure payment is made to the correct bank account) and vendor mailing address, as provided in the System for Award Management (SAM), formerly known as the Central Contractor Registration (CCR) database. Payment shall be made by the Billings Area Financial Management Branch, P.O. Box 36600, Billings, Montana 59107. PRO-CHILDREN ACT OF 1994: The Contractor certifies that it will comply with the provisions of Public Law 103-227, Pro-Children Act of 1994, which imposes restrictions on smoking where federally funded childrens services are provided. CHILD CARE NATIONAL AGENCY CHECK AND INVESTIGATION (CNACI). A CNACI must be completed for all Indian Health Service (IHS) contractor personnel within the Billings Area. Public Law (P.L.) 101-630, Indian Child Protection and Family Violence Prevention Act and P.L. 101-647, Crime Control Act of 1990, require the IHS to conduct a character and criminal history background investigation on all contractors performing services in IHS facilities. The character and background investigations will be conducted by the Wind River Service Unit. Fingerprints must also be taken as part of the pre-employment process and must be completed before the dentist is allowed to work. SPECIAL CONTRACT REQUIREMENTS: Contractors cannot serve as expert witnesses in any suit against the Federal Government. Many of the IHS patients receiving services may only speak a native language and/or reside on a Native American Reservation, therefore, the Contractor must demonstrate sensitivity to cross-cultural and language differences. The Privacy Act of 1974 mandates that the Contractor maintain complete confidentiality of all administrative, medical and personnel records, and all other pertinent information that comes to his/her attention or knowledge. The Privacy Act carries both civil and criminal penalties for unlawful disclosure of records. Violation of such confidentiality shall be cause for adverse action. The Contractor shall comply with IHS facility infection control and safety procedures, practices, and standards. PROVISIONS AND CLAUSES: The following provisions and clauses apply to this acquisition. The FAR provision 52.212-1 Instructions to Offerors Commercial Items; and 52.212-3 Offeror Representations and Certifications Commercial Items are incorporated by reference. The provision at 52.212-2 applies to this acquisition and is provided in full text. FAR 52.212-2 EVALUATION - COMMERCIAL ITEMS (JAN 1999): (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. THE CONTRACTOR SHALL PROVIDE EVIDENCE OF, OR SUBMIT A WRITTEN RESPONSE TO, THE FOLLOWING TECHNICAL EVALUATION FACTORS: The following factors shall be used to evaluate offers: (1) CURRENT, UNRESTRICTED STATE LICENSE = 35 POINTS. Potential contractors must submit a copy of State license with the price quote; (2) RESUME OR CURRICULUM VITAE = 35 POINTS. Potential contractors must submit resume or CV with price quote (resume/CV must include information relating to: (a) Professional Education; (b) Certifications; and (c) Previous jobs; and (3) PAST PERFORMANCE = 30 POINTS. The offeror must demonstrate its record of successful performance in past contracts and/or jobs, Government and/or commercial. Each offeror will be evaluated on its performance under existing and prior contracts/jobs. The offeror must list at least three contracts/jobs and include the following information. (1) Name of Government agency/Company; (2) Contract number, if applicable; (3) Dates of Service/Employment; (4) Total contract value/Hourly wage; (5) Description of contract work/Job duties; (6) Contracting Officer/Company Manager and telephone number; (7) Program Manager and telephone number, if applicable. Technical and past performance, when combined, are considered approximately equal to cost or price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. PROPOSAL SUBMISSION INSTRUCTIONS: The Contractor shall provide evidence of, or submit a written response to, the technical evaluation factors in FAR 52.212-2. In addition, the Contractor shall submit a completed copy of FAR 52.212-3 with its offer. Contractors intending to conduct business with the Federal Government must register with the System for Award Management (SAM). SAM replaces the Department of Defense's Central Contractor Registration (CCR) database. SAM is now the primary Government repository, which retains information on Government contractors. You may register via the Internet at www.sam.gov. All responsible offerors may submit a proposal, which shall be considered by the Agency. Offers shall be submitted to the Billings Area Indian Health Service, 2900 Fourth Avenue North, Room 304, Billings, Montana 59101, no later than 5:00 p.m. on March 25, 2015. The offer must be submitted in a sealed envelope, addressed to this office, showing the time specified for receipt, the solicitation number, and your name and address. ACCEPTANCE PERIOD: Your proposal must stipulate that it is predicated upon all the terms and conditions of this RFQ.
