- Notice of Intent The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, under authority of FAR 13.106(b)(1), with Comsol Multiphysics of Burlington, MA for the procurement of the renewal of Comsol Multiphysics license and modules used by NIST's Center for Nanoscale Science and Technology. COMSOL Multiphysics is the sole contractor authorized to provide the licenses and respective modules to the NIST CNST based upon the following: NIST has multiple external users that utilize Comsol Software, including Caltech, U.Calgary, Worcester Polytechnic Institute and the University of Dayton. NIST collaborates with them through the exchange of simulation model files, working on building simulations together, etc. If NIST were to switch to another software, the capability to collaborate and interchange information with other users and internally would be impacted significantly, resulting in a serious delay of the operations and mission of the division and projects. In addition, NIST CNST requires a floating network license as it allows for flexibility to install the software on multiple computers, which access is specifically based on license counts currently in use. No other vendor is authorized to provide COMSOL licenses, in addition, no other software license is fully compatible with the current Comsol licenses, modules, and software in use. The North American Industry Classification System (NAICS) code for this acquisition is 511210, with a size standard of $38.5M. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No solicitation package will be issued. This notice of intent is not a request for competitive quotations. However, responses received by March 26, 2015 will be considered by the Government.
