- SOLE SOURCE ANNOUNCEMENT 1. Introduction The USACE Seattle District intends to award a sole source contract to Douglas County Sheriff's Office. Douglas County, Washington. 2. Description of Services The Douglas County Sheriff's Department (County) shall provide law enforcement of civil and criminal laws of the State and County, including investigations of and to enforce State boating laws in and immediately adjacent to Chief Joseph Dam project lands and recreation facilities within the Douglas County. The County shall provide the necessary certified personnel, equipment, and vehicles or vessels required to provide patrols in the Project area. For purposes of this contract, the Project area is defined as including: the powerhouse, spillway, transformer yard, switchyard, shops and storage areas, the Visitor Center and adjacent communications building, and all associated roads, parking areas, and access points (including the south end of the intake structure accessed from Pearl Hill Road). The Project area is located in Bridgeport WA on U.S. Highway 17, and effectively includes all areas accessed from Pearl Hill Road. The NAICS code is 922120. 3. Authority DFARS 206.302-1, Only One Responsible Source. 4. Reasons for Sole Source (a) Background: After the events of September 11, 2001, the Federal Government authorized the use of law enforcement to make emphasis patrols to protect project areas such as Chief Joseph Dam. Memorandum for Records: Application of 10 U.S.C. 2465 to Civil Works Projects and Facilities dated September 24, 2001 and Memorandum for Record: Law Enforcement Services at Corps Water Resources Development Projects Under 42 U.S.C. 1962d-5d dated November 2, 2005, document the authorities and legal opinions allowing for law enforcement emphasis patrols during non-duty hours for projects like Chief Joseph Dam. (b) Justification: The Douglas County Sheriff's Department is the only law enforcement agency having the authority and capability to provide the services required on Chief Joseph Dam Project areas. They have full authority to enforce, and make arrests if necessary, local, state, and federal laws on lands and waters associated with the Project (concurrent jurisdiction) and are staffed and equipped to do so on a sustained basis. Deputies who will be providing the services are trained law enforcement officers with the ability to patrol and monitor Project facilities, but more importantly, the authority to take formal action in the event of unlawful or terrorist activity at the Corps facilities. Deputies are available around the clock and are based in the City of Wenatchee, which is close to the Project area. Response time to emergency situations is between five and forty-five minutes under normal conditions. This fast response time is critical to the safety of Corps employees and the public in today's environment. The Douglas County Sheriff also has the ability to call in other agencies to support contracted activities or react to emergencies and security incidents. 5. No solicitation package will be issued. This Notice of Intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 2:00 PM Pacific Time on 18 March 2015. Inquiries will only be accepted via email to Monique.a.paano@usace.army.mil. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
