- Sole Source Justification Intent to Sole Source The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Region Acquisition Division, Simplified Acquisition Branch intends to negotiate on a sole source basis with SEVENCs GmbH Zirkusweg 1 Hamburg Germany 20359 using the procedures in FAR Part 13, to provide 35 SEVENCs software licenses. The Marine Chart Division produces over 1000 Electronic Navigational Charts (ENCs) that cover the territorial waters of the United States. These products have been mandated by the International Maritime Organization to be carried on large commercial vessels for safe navigation. In order to produce a compliant ENC to the standards set by the International Hydrographic Organization (IHO) it must be validated against their S-58 standard. Currently MCD needs to provide an additional tool to provide quality control for its ENC production. ENC Analyzer provides ENC validation checks in a single software package that runs on a concurrent license server. This means, that by procuring a set of 35 concurrent licenses it will be able to meet the production needs of 80 employees for ENC validation. This will also allow MCD to reduce overall software maintenance costs. ENC Analyzer is a package that incorporates the International Hydrographic Organizations S-58 Recommended ENC Validation Checks into a single software package. The Marine Chart Division will utilize this package as an additional check to ensure that NOAA ENCs adhere to the international S-57 standard for ENC. The Marine Chart Division needs to be able to maintain second independent checking software to continue to produce ENC's for the mariner. The statutory authority for other than full and open competition is FAR 13.106-1(b)(1)(i), Only one responsible source. The North American Industry Classification Code (NAICS) for this acquisition is541511 Application Software Programming Services, Custom Computer. This is not a solicitation for competitive quotes. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. A statement of capabilities must be received by 11:00am, March 26, 2015 will be considered by the Government. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of ability to provide the required services. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the foregoing requirements.
