Description
Procurement of increased law enforcement services for Philpott Lake Project, W. Kerr Scott Dam and Reservoir, John H. Kerr Dam and Reservoir and B. Everett Jordan Lake Project in Franklin County in Virginia and Mecklenburg, Chatham and Wilkes Counties, North Carolina. This acquisition will be processed in accordance with simplified acquisition procedures and under the authority of FAR 13.106-1(b)(1). The North American Industry Classification System code is 922120. Only one award will be made for each county as a result of this solicitation. Each contract will be awarded as a firm fixed price type contract. Period of Performance shall be between April and October of 2015 and may include options for the 2016 and 2017 seasons based on the Sheriff's terms in office within each county. The Patrick, Franklin, Mecklenburg, Chatham and Wilkes County Sheriff's offices are the only sources from which the Government can obtain law enforcement services for the patrol of public use facilities on the Corps managed recreation areas. The deputies can enforce and arrest violators of North Carolina and Virginia laws which Park Rangers cannot. Park Rangers are unarmed and are not quote mark law enforcement officers quote mark but quote mark regulation enforcers of Title 36, Code of Federal Regulations quote mark. Park Rangers are prohibited by regulation from arresting, detaining, searching or seizing any person or property. The situations that arise from dealing with numerous visitors in remote areas and wooded trails present hazards to unarmed park rangers. The sheriff office deputies serve the rangers and the public. They can arrest and remove dangerous and abusive individuals from public lands. District Commanders are delegated the authority to contract and/or enter into cooperative agreements with states and their political subdivisions to obtain increased law enforcement services at civil works water resource projects to meet needs during peak visitation periods and to augment the citation authorities granted to the Corps under 36 CPR Chapter III Part 327 (Title 36.) The county Sheriff's offices are the only known sources with the capability to provide the services required to enforce the law and keep USACE public recreational areas safe for public use. This is not a solicitation for competitive quotations. However, if any interested party believes they can meet the above requirement, they may submit a statement of capabilities. All information furnished must be in writing and must contain sufficient detail to allow the USACE (Contracting) Wilmington District to determine if it can meet the above unique specifications described herein. Any capability statements must be received in the Contracting Office of Acquisitions on or before 11:30 AM EDT on March 31, 2015 through email. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. In order to receive an award, contractors must have valid registration and certification in the System Award Management (SAM) https://www.sam.gov and the Federal Award Performance and Integrity Information System (FAPIIS).
