- Special Notice Request for Information (RFI) Re: Information on Patent Characteristics and Prior Art The government does not intend to award a contract on the basis of this request for information. This is not a request for proposals, nor a guarantee for a future solicitation. This is an exploratory request for information purposes only. GAO is beginning work that looks at patent examination at the U.S. Patent and Trademark Office (PTO). We plan to examine U.S. patent quality characteristics and PTO's identification and application of prior art during patent examination. GAO seeks information regarding whether the use of commercially available data driven approaches can link patent application characteristics with the incidence of infringement litigation or overall patent quality, as well as information regarding the potential application of additional or alternative uses of commercially available data analysis systems or data in the patent examination process. To help inform our further efforts in examining these topics, we are interested in information on the availability of: •· Data analysis systems and datasets that produce measures that may be correlated with the likelihood a U.S. patent will end up in an infringement lawsuit in the United States or in a challenge at the Patent Trial and Appeals Board and/or systems for predicting the likelihood a patent would survive a validity challenge in either forum especially with respect to section 102 and 103 of Title 35 of the U.S. Code (for a sample of 1,000 or more patents). •· Data analysis systems and datasets, potentially including text-based analytical systems that can characterize the clarity and/or breadth of a given patent (i.e., its claims) and/or its overlap with other U.S. or foreign patents. For example, we would be interested in systems that could identify specific patent characteristics or metrics such as: •o The extent to which the claimed invention is narrowly defined. •o The similarity of a given patent to other U.S. or foreign patents (and the ability to generate lists of such other similar patents for comparison). •· Data analysis systems and datasets that might assist in examining a U.S. patent application, including systems to aid in classification or in the identification of relevant prior art (such as foreign patents and non-patent literature). For example, we would be interested in systems that could identify: •o Related patent applications, patent families, or non-patent literature. •o Measures of the relevance of prior art. •· We are also interested in data systems that might provide insights into a given patent's examination at PTO, including information on applicant disclosures, continuations, pendency, appeals, and patent examiner characteristics. GAO's auditing standards require that we obtain sufficient information to assess (a) the quality of any analytic approaches or methodologies that produce results we plan to report, and/or (b) sufficient information to assess the completeness and accuracy of data we plan to analyze and report. While not a requirement for responding, to assess analytic approaches or methodologies that produce results we plan to report, GAO would ultimately require: •· Detailed information and documentation that can demonstrate the accuracy and logic of the system and its approach. •· Descriptions and/or documentation on the steps taken to ensure any and all data inputs and outputs are accurate, complete, and reliable. GAO will consider different approaches to demonstrate the quality and accuracy of any data analytics we might consider. (Again, these are not required to respond to this RFI.) Some examples might be: •· descriptions or documentation on any algorithms the system uses to produce results •· detailed descriptions or documentation on the mechanics of the analyses •· examples of data output from such systems for GAO review •· information on and the results of other validation methods •· reliable outside sources that could corroborate results generated We would also consider other methods that can demonstrate the quality and accuracy of the results a system produces that we have not outlined here. This Request for Information (RFI) is being issued consistent with and in the spirit of an exchange of information with industry as per Federal Acquisition Regulation Part 10. This RFI is prepared for planning purposes only and is issued with the intent of obtaining price, delivery, capabilities, or other market information, and is not being issued with the intent of awarding a contract. In accordance with FAR 52.215-3, the Government will not pay for any information/items submitted in response to this synopsis. The Government will neither award a contract solely on the basis of this synopsis nor will it reimburse the contractor for any costs associated with preparing or submitting a response to this notice. This RFI is issued for information gathering purposes only. Interested parties are highly encouraged to participate. It is the intent that input gathered during this RFI process will directly influence scope and requirements of a future technical solution. Failure to participate in the RFI will not impact an interested party's ability to participate in any future competitive process, should GAO opt to pursue one.
