Description
NOTICE INFORMATION Diesel Fuel Services The Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), intends to establish a Blanket Purchase Agreement (BPA) with a total ceiling not to exceed $25,000.00 with a single firm for local area fuel services for the emergency backup generator. The period of performance shall be 36-months from date of award. (I) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice and in accordance with the simplified acquisition procedures authorized in FAR Part 13. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. A determination by the Government not to complete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. (II) The Government will consider responses submitted within ten (10) calendar days from the publication of this notice to Robin.Burress@noaa.gov. No telephone requests will be honored. (III) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-73. (IV) The solicitation number is EE-133E-15-RQ-0326 and is issued as a request for quotations for diesel fuel service. The associated North American Industrial Classification System (NAICS) code for this procurement is 324110 with a small business size standard of 50 employees. This requirement is a Small Business set-aside and only qualified offerors may submit bids. (V) This combined solicitation/synopsis is for purchase of the following commercial item(s): Fuel and delivery services for the Center's emergency power generator. (VI) Description of the requirement is as follows: oSee attached Statement of Work for complete requirements. oVendor will submit an invoice for payment after completion of each service call. oThe invoice shall contain the following minimum information: Name of supplier BPA number Date of Purchase Purchase number Itemized list of services furnished. (VII) Place of delivery and acceptance NOAA/National Centers for Environmental Information, 151 Patton Ave., Asheville, NC 28801 and FOB Destination. (VIII) FAR 52.212-1, Instructions to Offerors -- Commercial Items (2005-56), applies to this acquisition. (IX) FAR 52.212-2, Evaluation - Commercial Items (2005-56), The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors shall be used to evaluate offers: Offers that provide all requirements according to the specifications and scope of work will be evaluated on price. (X) FAR 52.212-3, Offeror Representations and Certifications - Commercial Items (2005-56), with its quote. An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically at https://www.sam.gov/portal/public/SAM/. If an offeror has not completed the annual representations and certifications electronically at the SAM website, the offeror shall complete only paragraphs (c) through (m) of this provision. (XI) The clause at FAR 52.212-4, Contract Terms and Conditions - Commercial Items (2005-56), applies to this acquisition. (XII) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (2005-56) applies to this acquisition. The following clauses under subparagraph (b) apply: (21, 24, 25, 26, 27, 29, 36, 38) CAR 1352.201-70 Contracting Officer's Authority CAR 1352.209-73 Compliance with the Laws CAR 1352.209-74 Organizational Conflict of Interest CAR1352.213-70 Evaluation Utilizing Simplified Acquisition Procedures CAR 1352.233-70 Agency Protests CAR 1352.233-71 GAO and Court of Federal Claims Protests (XIII) Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction Under Any Federal Law {Class Deviation) {March 2014) (1) In accordance with Sections 536 and 537 of Division B of Public Law 113-76 Consolidated Appropriations Act, 2014, none of the funds made available by Consolidated Appropriations Act, 2014 funding may be used to enter into a contract with any corporation that- (a) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless the agency has considered suspension or debarment of the corporation and has made a determination that this further action is not necessary to protect the interests of the Government, or {b) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government. (2) The Offeror represents that, as of the date of this offer- (a) It is [ ] is not [ ] a corporation that was convicted of a felony criminal violation under a Federal law within the preceding 24 months. (b) It is [ ] is not [ ] a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability. (XIV) The Government will use a purchase card as the method of payment for this service. The offeror should state if payment via purchase card is an acceptable method of payment on their submitted quote. (XV) Quotes are required to be received in the contracting office no later than 12:00 p.m. Eastern Time on April 01, 2015. All quotes must be emailed to the attention of Robin Burress.
