Description
JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY AUTHORITY: FAR 16.505(b)(2)(i)(B) (CONTRACT/TASK ORDER #) D11PC20063/D12PD00645 1. Identification of the agency and the contracting activity, and specific identification of the document as a "Justification for Exception to Fair Opportunity." Requiring Agency: Defense Advanced Research Projects Agency (DARPA) Contracting Activity: Department of the Interior (DOI), Interior Business Center (IBC), Acquisition Services Directorate (AQD), Division III Justification for Exception to Fair Opportunity: FAR 16.505(b)(2)(i)(B) 2. Nature and/or description of the action being approved. Approval is being requested for a six month period of performance (PoP) extension utilizing the authority provided under FAR 52.217-8 and an increase to the overall task order ceiling for Contract D11PC20063 Task Order D12PD00645, titled, DARPA Defense Science Office (DSO) Falcone Technical Support Task. Due to delays associated with the restructuring of the DARPA organization, the PoP extension will allow the necessary time for DARPA's organizational transition and ensure the continuity of services. The overall PoP end date of the task order will be extended from 03/31/2015 to 09/30/2015, for a total PoP of 04/01/2012 through 09/30/2015. It is anticipated $230,000.00 of the Option 2 ceiling will be realigned to the Extended Period. An increase to the overall task order ceiling is not anticipated and will remain unchanged at $1,594,943.00. 3. A description of the supplies/services required to meet the Agency's needs DARPA DSO has three multiple award IDIQ contracts established which provide advisory and assistance services (A&AS), specifically Scientific Engineering and Technical Assistance (SETA) support. Task Order D12PD00645 provides A&AS/SETA support to the successful execution of the DSO Program Manager's portfolio. This includes technology evaluations, participation at meetings, coordination with related Government and performer organizations, program planning, background research and bibliographic research, meeting preparation, and presentation production. The contractor shall also provide inputs to the PM, assisting in responses to internal/external inquiries related to the research. The contractor shall provide, as required, informal feedback to the PM, as well as formal feedback at critical program events/activities. The total ceiling price of the task order is $1,594,943.00.   4. Identification of the exception to fair opportunity and the supporting rationale, including a demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the exception cited. As stated in FAR 16.505(b)(2)(i)(B), the contracting officer shall give every awardee a fair opportunity to be considered for a delivery-order or task-order exceeding $3,000.00 unless only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. DARPA has expressed a need for the continuance of the support being provided under task order D12PD00645 beyond 03/31/2015. The incumbent, Booz Allen Hamilton, Inc., has been supporting the task order since inception. If required to select another contractor, prior to 04/01/2015, to perform these duties at the level of quality required, a non-recoverable loss of program/system knowledge and an unacceptable delay in services would result as the replacement contractor personnel familiarized themselves with the program's development cycle, business practices, and technical requirements. Additionally, key aspects of program performance could be permanently lost during this crucial timeframe. The knowledge that is carried over from previous experience within this program is invaluable, required to ensure success, and brings the best value to the Government. 5. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The contracting officer determined that the anticipated cost to the Government will be fair and reasonable based on the proposed rates being consistent with the IDIQ contract and the rates evaluated as part of the task order competition. Additionally, the rates compare favorably to fully burdened rates approved on other IDIQs similar in nature. 6. Any other facts supporting the exception to fair opportunity. Re-competing the task order, at this time, would not be in the best interests of the Government. a. The issuance of a RFP could result in higher proposed costs than what is already established in this task order due to a change in the Awardee, labor categories, rates and hours proposed. b. It cannot be guaranteed that complications will not arise during the re-competition and award creation process which could result in unacceptable delays. c. The subject task order was competed amongst the DSO multiple award IDIQ contracts; D11PC20051 (Strategic Analysis, Inc.), D11PC20063 (Booz Allen Hamilton, Inc.), and D11PC20064 (System Planning Corporation). Strategic Analysis, Inc. "No Bid" response, while System Planning Corporation submitted a proposal. A time and materials award was made on 04/01/2012 to Booz Allen Hamilton, Inc. for a 12-month Base Period and two (2) 12-month Option Periods.   7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made. The DARPA DSO multiple award IDIQ contracts, D11PC20051, D11PC20063, and D11PC20064 are currently being re-competed. It is anticipated the new multiple award IDIQ contracts and task orders will be awarded prior to 09/30/2015. 8. Contracting officer certification that the justification is accurate and complete to the best of the contracting officer's knowledge and belief.
