- Tennessee Valley Authority, 1101 Market Street, Chattanooga, Tennessee 37402-2801 TRANSMITTED VIA E-MAIL - NO HARD COPY ISSUED March 30, 2015 QUALIFICATION CERTIFICATION FOR ENGINEER PROCURE CONSTRUCT (EPC) FOR A NATURAL GAS FIRED COGENERATION PROJECT In the near future, TVA may be issuing a solicitation document to request proposals from experienced firms for the award of an EPC contract for a Natural Gas Fired Cogeneration Project (the TVA Cogen Project) on a firm, fixed price basis. In addition to the required primary proposal on a fixed price basis, the Offeror may also submit an alternate proposal methodology for an optional commercial approach. The alternate proposal may address such alternate commercial terms where the Offeror believes there is commercial benefit to TVA. The detailed scope of work will be defined for the TVA Cogen Project, and will be provided in the Request for Proposals (RFP) to all those prospective Offerors that certify they meet the Mandatory Minimum Qualifications and submit detailed supporting documentation to substantiate meeting all mandatory minimum qualification requirements. Any solicitation for the TVA Cogen project will be subject to TVA obtaining the appropriate internal project approvals, environmental reviews, etc., and TVA does not commit to award a contract under this solicitation or to pay any costs incurred in the development and submission of any subsequent proposal. Description of the Scope of Work for the TVA Cogen Project TVA is constructing a Combined Heat and Power (CHP) facility on the Johnsonville site in New Johnsonville, Tennessee. The site is located on the existing TVA Johnsonville power plant (JOF) site. The CHP facility consists of utilizing an existing GE 7EA combustion turbine (CT 20) that currently is run in simple cycle mode to be converted to a heat recovery cogeneration cycle to produce process steam to the adjacent Steam Customer's plant. In addition, there will be two TVA furnished Auxiliary Boilers that will also provide process steam to the adjacent Steam Customer's plant. These Auxiliary Boilers will work in conjunction with the heat recovery steam generator (HRSG) to insure that the Steam Customer's process steam demand is met 99.5% of the time. The HRSG will include supplemental duct firing capability with natural gas to increase the production of process steam. URS Energy & Construction, Inc. (URS) has previously developed a technical specification for TVA's use for this TVA Cogen Project which TVA intends to use as the technical specification in the RFP for the selected project. Even though an organizational conflict of interest may arise therefrom, in order to encourage submissions from the most qualified firms TVA will not exclude URS from a possible subsequent award of an EPC contract for the project should TVA decide to move forward therewith, provided that URS agrees not to withhold information developed during the preparation of the specification from TVA or place any restriction on the ability of TVA to fully disclose such information to other prospective Offerors for such follow-up work. URS has also committed that none of its personnel, employees, agents or contractors that participated in the development of that specification will participate in any manner in the development of its proposal in connection with a TVA project that utilizes that specification. An "organizational conflict of interest" is a situation in which because of other activities or relationships with others, an Offeror/Contractor is unable or potentially unable to render impartial advice or assistance to TVA, or its objectivity in performing contract work is or might be otherwise impaired, or it has an unfair competitive advantage. Page 2 March 30, 2015 Notwithstanding the foregoing, TVA reserves the right to take such steps as it deems appropriate to neutralize or mitigate organizational conflicts of interest on the part of Offerors, contractors, subcontractors, or their affiliates. URS will not participate in the review or evaluation of any proposals from Offerors and was not involved in the development of the commercial specification of the requirement.
