Description
INTRODUCTION This is a pre-solicitation non-competitive (notice of intent) synopsis to award a contract without providing for full or open competition (including brand-name). THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR PROPOSAL. A SOLICITATION WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Institute on Drug Abuse (NIDA), Consolidated Station Support and Simplified Acquisitions (CSS/SA) Branch intends to negotiate and award a purchase order to OpAns, LLC for analytical testing of samples without providing for full and open competition (including brand-name). NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 541380 with a Size Standard of $15 Million. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-72 dated January 30,2014. This acquisition is for a commercial item or service and is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures. This acquisition is NOT expected to exceed the simplified acquisition threshold. STATUTORY AUTHORITY This acquisition is conducted under the authority of the authority of FAR Subpart 13.106-1. DESCRIPTION OF REQUIREMENT Purpose and Objectives The National Center for Advancing Translational Sciences (NCATS) requires analytical testing of samples to determine presence, purity and quantity of compounds. Period of Performance The period of performance shall be from date of award to September 30, 2015 Project Description The contractor shall provide the following testing services for NCATS: a. Samples (aqueous or DMSO solutions) provided by the sponsor will be tested by LC/DAD-UV/ELSD/CLND/MS to determine presence, purity and quantity of compound. Calibration and Quality Control samples will be included with every analytical run. b. The HPLC method will be a reversed phase gradient from water to methanol with acid as the modifier in both solvents. The peak capacity of the separation will be determined by the standards used in the system suitability mix. Peak capacity will be defined as peak width at half height divided by linear gradient time. The peak capacity of the system will be >100. c. The ionization source for the mass spectrometer will be electrospray. d. A fast scanning mass spectrometer will operated in the Pos/Neg switching mode and the scan range will be approximately 100 to 1000 m/z. e. A single system suitability mix, containing at least 4 compounds, will be used to both determine the suitability of the system and to calibrate the quantitative detectors. f.A separate QC sample will be prepared containing compound(s) not in the suitability mix. g. Data will be tested to determine if the results confirm the presence of the expected components. Government Responsibilities: The Government shall provide compounds to the contractor for testing in batches of no less than 1,000 compounds at any given time. Delivery or Deliverables: The contractor shall provide a detailed report in an excel file. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specifically, only OpAns, LLC is capable of meeting the needs of this requirement due to these tests beign performed by OpAns, LLC for the past five 95) years. In order to maintain consistency, and reproducibility, in the data it is essential that the work remain with OpAns, LLC. Years of research, protocols, and methods are based on the previous work and must be maintained as NCATS moves forward. The intended source is: OpAns, LLC 4131 S. Alston Ave, Ste 101 Durham, NC 27713 CLOSING STATEMENT THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by the closing date and time of this announcement and must reference the solicitation number.
