Description
THE RECOVERED CHEMICAL MATERIEL DIRECTORATE (RCMD), CHEMICAL MATERIALS ACTIVITY, HAS THE MISSION RESPONSIBILITY, AS MANDATED BY PUBLIC LAW 102-484, FOR THE DISPOSAL OF ALL APPLICABLE DEPARTMENT OF DEFENSE RECOVERED CHEMICAL WARFARE MATERIEL (RCWM) IN A SAFE AND ENVIRONMENTALLY ACCEPTABLE MANNER. IN SUPPORT OF THIS MISSION AND BASED ON ITS MARKET RESEARCH, THE GOVERNMENT HAS IDENTIFIED THE COMMERCIALLY EXISTING DAVINCH-LITE AS A TECHNOLOGY THAT CAN ADDRESS LARGE QUANTITIES OF RECOVERED CWM IN A MANNER THAT WILL BE COST EFFECTIVE, EFFICIENT IN TERMS OF SCHEDULE, AND MINIMIZES THE GENERATION OF HAZARDOUS WASTES. THIS WAS BASED ON A MARKET SURVEY CONDUCTED BY THE JOINT PROJECT MANAGER FOR ELIMINATION ON BEHALF OF RCMD AND BASED ON THE RCMD MINIMUM REQUIREMENTS SUCH AS: THE SYSTEM MUST BE ABLE TO: (1) DESTROY A MINIMUM 7 POUNDS OF PERSISTENT CWM (E.G., MUSTARD GAS) PER PROCESS/BATCH/DETONATION, TO BELOW THE APPROPRIATE ARMY REGULATION REGARDING SHORT TERM EXPOSURE LEVEL(S) (STEL); (2) DESTROY A MINIMUM 12 MUNITIONS PER 10-HOUR WORK DAY; AND, (3) REQUIRE NOT MORE THAN 20 DAYS TO SET UP AND BE OPERATIONALLY READY UPON ARRIVAL AT THE PROJECT SITE. UNDER THIS SOURCES SOUGHT SYNOPSIS, IT IS BEING PLANNED BY THE GOVERNMENT TO AWARD A STANDALONE CONTRACT, IN ACCORDANCE WITH FAR 6.302-1, TO KOBE STEEL OF JAPAN FOR THE PURPOSES OF LEASING AND TESTING THE DAVINCH-LITE. AS CURRENTLY PLANNED, THE GOVERNMENT INTENDS TO CONDUCT TESTING AND EVALUATION OF THE DAVINCH-LITE AT THE ABERDEEN PROVING GROUND, MARYLAND WITH AN OPTION TO PURCHASE THE SYSTEM PENDING THE RESULTS OF THE TESTING. AS DESCRIBED IN FAR 6.302-1(A)(2), THE ABOVE UNIQUE AND/OR HIGHLY SPECIALIZED SUPPLIES AND SERVICES BEING PLANNED ARE AVAILABLE ONLY FROM DAVINCH-LITE THAT WAS DEVELOPED AND IS OWNED BY KOBE STEEL OF JAPAN. THE DAVINCH-LITE IS CONSIDERED TO BE PROPRIETARY TO KOBE STEEL AND TO BE DEVELOPED EXCLUSIVELY WITH PRIVATE FUNDING. THE GOVERNMENT HAS DETERMINED THAT PROCUREMENT BY OTHER THAN FULL AND OPEN COMPETITION IS NECESSARY BECAUSE THE TECHNOLOGY IS UNAVAILABLE TO THE GOVERNMENT BEING PROPRIETARY TO KOBE STEEL. IN ADDITION, BASED ON THE GOVERNMENT?S MARKET RESEARCH, THE DAVINCH-LITE WAS IDENTIFIED AS THE ONLY COMMERCIALLY EXISTING TECHNOLOGY THAT MEETS THE ABOVE REQUIREMENTS. IT IS NOT ANTICIPATED THAT KOBE STEEL WOULD BE AGREEABLE TO ENTER INTO A LICENSING AGREEMENT WITH THE GOVERNMENT TO USING THEIR DATA FOR COMPETITIVE PURPOSES. EVEN IF KOBE STEEL WOULD AUTHORIZE THE GOVERNMENT TO USE ITS PROPRIETARY DATA, A NEW CONTRACTOR DOES NOT HAVE THE TECHNICAL, MANUFACTURING, PERFORMANCE, OR TESTING NUANCES TO REPLICATE THE DAVINCH-LITE WITHOUT UNDERGOING ADDITIONAL DEVELOPMENT AND DEMONSTRATION/OPERATIONAL TESTING OF ITS TECHNOLOGY. BASED ON THE GOVERNMENT?S MARKET RESEARCH, NO OTHER CONTRACTOR OTHER THAN KOBE STEEL HAS THE UNIQUE EXPERIENCE, CAPABILITIES, AND INSTITUTIONAL KNOWLEDGE TO DELIVER AN EXISTING AND FUNCTIONAL DAVINCH-LITE WITHIN THE TIMEFRAME REQUIRED BY THE GOVERNMENT. THE PROPOSED CONTRACT ACTION IS FOR THE LEASE AND TEST OF THE DAVINCH-LITE SYSTEM. IN ADDITION, TECHNICAL SUPPORT, THE PROPRIETARY TECHNICAL DATA PACKAGE, AND DATA RIGHTS WILL BE AN OPTION TO PURCHASE IF EXERCISED AS WELL AS MISCELLANEOUS ITEMS SPECIFIC TO THE DAVINCH-LITE SYSTEM FOR WHICH THE GOVERNMENT INTENDS TO SOLICIT AND NEGOTIATE, UTILIZING ALPHA CONTRACTING TECHNIQUES WITH KOBE STEEL, UNDER THE AUTHORITY OF FAR 6.302-1. AS SUCH, NO WRITTEN REQUEST FOR PROPOSAL WILL BE ISSUED. INTERESTED PERSONS UNDER THIS SOURCES SOUGHT SYNOPSIS MAY IDENTIFY THEIR INTEREST, CAPABILITY, EXPERIENCE, AND EXISTING TECHNOLOGY TO MEET THE ABOVE REQUIREMENTS AND GOVERNMENT?S PROJECTED TEST AND EVALUATION SCHEDULE. HOWEVER, THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. ALL SUBMITTED INFORMATION BY INTERESTED PARTIES THAT IS RECEIVED WITHIN THIRTY (30) DAYS AFTER DATE OF PUBLICATION OF THIS SYNOPSIS WILL BE CONSIDERED BY THE GOVERNMENT. A DETERMINATION BY THE GOVERNMENT NOT TO COMPETE THIS PROPOSED CONTRACT ACTION BASED UPON RESPONSES TO THIS NOTICE IS SOLELY WITHIN THE DISCRETION OF THE GOVERNMENT. THE SUBMITTED INFORMATION BY INTERESTED PARTIES WILL BE CONSIDERED SOLELY FOR THE PURPOSE OF DETERMINING WHETHER TO CONDUCT A COMPETITIVE PROCUREMENT.
