GENERAL SERVICES ADMINISTRATION North Branch, Real Estate Acquisition Division Justification for Other than Full and Open Competition 4PA0321 <Redacted> Pittsburgh, PA 1. Nature and/or description of the action being approved. To pursue a 10 year, 4 year firm term succeeding lease for the <Redacted> <Redacted>. 2. Description of the supplies or services required to meet the agency’s needs (including the estimated value). <Redacted> <Redacted> is in 19,798 ABOA sqft of space (21,391 RSF). <Redacted> A succeeding lease with a 4 year firm term will provide <Redacted> with time to develop their long term requirements. The lease has been extended for nine (9) months and expires November 30, 2014. This document seeks approval to negotiate a 4 year firm, 10 year succeeding lease for <Redacted> 3. Identification of the statutory authority permitting other than full and open competition. 41 U.S.C. 253 (c) (1) and FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. 4. Demonstration that the proposed contractor’s unique qualifications or nature of the acquisition requires use of the authority cited. In accordance with 41 U.S.C. 253 (c) (1), the agency’s minimum needs can only be satisfied by unique supplies or services available from only one responsible source and no other type of property or services will satisfy the needs of the agency. By awarding a succeeding lease, the agency will not incur move or tenant improvement costs related to relocating. Please refer to the attached cost benefit analysis that shows the substantial cost savings associated with remaining in place versus relocating the office. 5. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable An advertisement was placed on Federal Business Opportunities, March 17, 2014, and ran for two weeks. No responses were received. Market research was done by searching <Redacted> which located 5 buildings within the delineated area. 6. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. <Redacted> <Redacted> rental rates range from $23.50/RSF - $31.50/RSF for a fully serviced lease. <Redacted> 7. Description of the market research conducted and the results. Market research was conducted as stated above in #5. See attached market survey report for more details. 8. Other facts supporting the use of other than full and open competition. In addition to staying in place due to move and build out costs, the agency is very satisfied with the landlord’s upkeep of the building. The landlord’s property managers quickly respond to any complaints or issues from the tenant agency. No issues have ever been left outstanding and the GSA field office has no complaints about this building. <Redacted> 9. List of any sources that expressed in writing an interest in the acquisition No other source has expressed in writing an interest in the acquisition. 10. Statement of actions the agency may take to remove or overcome any barriers to competition Prior to lease expiration the agency’s requirements will be assessed and a fully competitive lease action will be initiated, if applicable. Contracting Officer’s certification I hereby certify that the above information is accurate and complete to the best of my knowledge. Agency requirements supporting this Justification for Other Than Full and Open Competition are certified as accurate and complete.
