- The United States Army Intelligence and Security Command (INSCOM) Acquisition Center, National Ground Intelligence Center (NGIC) Branch made a sole source, firm-fixed-price award to Data Solutions & Technology (DST), Inc. on 27 September 2014 to provide CJDB Support Services for the Combat Incident Analysis Division (CIAD) at NGIC and Joint Trauma Analysis for the Prevention of Injury in Combat (JTAPIC). The award was made against DST, Inc. Contract GS-35F-0587S, Task Order W911W5-14-F-0034, to provide these services, pending the resolution of protests against the award of NGIC Production and Science and Technical Intelligence (S&TI) Software Programs (NPSP) Contract W911W5-14-D-0001 to Blackhawk Enterprise Incorporated on 5 September 2014. The period of performance of W911W5-14-F-0034 was 27 September 2014 to 27 March 2015. The SBA size challenge and GAO protest were dismissed, but additional delays occurred postponing protest resolution efforts. In light of the underlying reason for the corrective action, the contracting officer was required to re-evaluate the need, and remove a requirement for Intelligence Community Cloud integration. In addition, after GAO dismissed the protest to permit corrective action, there were internal changes to NGIC's IT infrastructure that potentially impacted requirements and needed further evaluation before soliciting final revised proposals. After considering alternatives to the NPSP contracting vehicle, the contracting officer determined that it remained the best method of fulfilling the Agency's requirements. After submission of final revised proposals by offerors, award has been further delayed to permit a more detailed technical analysis. As a result, proposals remain under evaluation. Pursuant to FAR 8.405-6(a)(1)(i)(A), the agency's compelling need for CJDB Support Services was so urgent that following the procedures would result in unacceptable delays. Further, pursuant to FAR 8.405-6 Limiting Sources, a new Limited Sources Justification was required for an extension of services on the sole source award to DST, Inc. The Limited Sources Justification was necessitated by the fact that the option under FAR 52.217-8 was not previously evaluated as part of the contract award. This option exercise will be at the current rate specified in the current contract, as allowed by FAR clause 52.217-8. This option exercise will further allow for solicitation, evaluation, and award of a follow-on procurement. The incumbent contractor, DST, Inc. is the only responsible offeror for the exercise of this option, as the Government would experience unacceptable delays in fulfilling agency requirements if this option were not exercised before the expiration of the current task order's end date (27 March 2015). A contract extension for continued services is essential to maintain continuity of service, prevent unacceptable delays and duplication of cost to the Government in fulfilling agency requirements for up to six (6) months until the new contract is awarded.
