- Attached Sole Source Justification for Intelex Intelex - Enterprise License Support & Maintenance Renewal The Department of Commerce, National Oceanic and Atmospheric Administration (NOAA), and the Eastern Region Acquisition Division (ERAD) Simplified Acquisition Branch on the behalf of the Office of Marine and Aviation Operations (OMAO), Operations Division, Norfolk, Virginia intends to negotiate on a sole source basis with Intelex using the procedures in FAR Parts 6 and 13. The Operations Division requires the purchase of an annual enterprise support and maintenance license renewal (R-90U2). The period of performance is April 24, 2015 through April 23, 2016 and contains four one-year option periods. This service is required to provide continued support, critical security updates, and upgrades of the licensed products. The Operations Division has utilized Intelex software licenses since 2006. This software is proprietary in nature and specific to the Operations Division's enterprise platform. If this office were to utilize different software, an entire platform change and migration of systems would be required. The statutory authority for other than full and open competition is FAR 13.106-1(a)(2)(b)(1)(i), Only one responsible source. The applicable NAICS code is 511210 with a Small Business Size Standard of $38.5 million. The Product Service Code, (PSC) is D319. This notice of intent is not a request for competitive quotes, however, all quotes received by 9:00 A.M. EST on April 22, 2015 shall be considered by the Government. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of ability to perform the requirement. Responses to this notice, if any, must show clear and convincing evidence that competition would be advantageous to the government. A firm-fixed-price purchase order will be made using FAR 13, Simplified Acquisition Procedures. Offerors must be registered in the System for Award Management (SAM) database at www.sam.gov; offerors must also obtain a Data Universal Numbering System (DUNS) number and provide it with the offer.
