This announcement constitutes the only solicitation; quotations are being requested, and a written solicitation document will not be issued. This solicitation is a Request for Quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-80 and Department of Defense FAR Supplement DPN 20150326. This solicitation and resultant contract is conducted as unrestricted under full and open competition using NAICS code 339112 and the associated small business size standard is 500 employees. All responsible sources may submit an offer which shall be considered by the government. The Western Regional Contracting Office, EACH Contracting Cell, Fort Carson, CO is seeking to purchase a brand name or equal Angiodynamics VenaCure 1470 Endovenous Laser. The following solicitation provisions apply to this acquisition: 1.FAR 52.212-1, quote mark Instructions to Offerors-Commercial Items quote mark (April, 2014) applies to this acquisition and the following addenda is provided. Addendum to 52.212-1: This procurement is for new equipment ONLY. No remanufactured or quote mark gray market quote mark items are acceptable. All equipment must be covered by the manufacturer's warranty. Vendor shall be an Original Equipment Manufacturer (OEM), authorized dealer, authorized distributor, or authorized reseller for the proposed equipment such that OEM warranty and service are provided and maintained by the OEM. All software licensing, warranty, and service associated with the equipment shall be in accordance with the OEM terms and conditions Offerors are required to submit documentation from the manufacturer stating that they are an authorized distributor for the specific items being procured. (b) Replacements to 52.212-1: Paragraph 52.212-1(b), Submission of Offers, Replace with the following: (a) General: (i) Whenever, the words quote mark offer, quote mark quote mark proposal, quote mark quote mark offerors, quote mark or similar terms are used in this solicitation, they shall be read to mean quote mark quotation, quote mark quote mark quoter, quote mark or similar corresponding term to reflect that this solicitation is a request for quotation and not a request for proposal or an invitation for bids. (ii) Once the Contracting Officer has decided to whom an offer will be issued, an offer requiring the quoter's signature will be issued. A contract will be in existence once both the offeror and the Contracting Officer have signed the contract. (b) Quotation packages shall consist of the following items. (i) Quotation package should reference solicitation number W91YU0-15-T-0176, and be signed by an authorized company representative. (ii) Contract Line Item Numbers (CLINs). Provide pricing for each CLIN. (iii) Complete copy of FAR 52.212-3 Offeror Representations and Certifications - Commercial Items Alt I, or a statement indicating that you have completed on-line at https://orca.bpn.gov/. (iv) Complete copy of FAR 52.219-28, Post-Award Small Business Program Rerepresentation (Jul 2013). (v) Complete copy of FAR 52.225-18, Place of Manufacture (Mar 2015). (vi) Product Narrative (two copies, one copy redacted). (vii) Verified, up-to-date name, address, E-mail address & telephone number of the offeror's representative authorized to sign contract actions. Paragraph 52.212-1(c), Period for Acceptance of Offers. Replace with the following: Government Minimum Acceptance Period. The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers, unless the Government specifies another time period in an addendum to the solicitation. The Government will not consider offers providing less than 90 calendar days for Government acceptance. Paragraphs 52.212-1 (d), (e), (h), (i) are deleted. Paragraph 52.212-1(m), Filing of Agency Protest. Add the following: Protests received at a level higher than the contracting officer will be referred to the contracting officer. Protestor may request a review by the contracting officer or an independent review at a level higher than the contracting officer. Requests for appeals or independent review will be addressed to the contracting officer for referral to the review authority. Questions on this process will be referred to the cognizant contracting officer identified in the solicitation. Paragraph 52.212-1(n) The non-FAR Part 12 discretionary FAR, DFARS, AFARS, and MEDCOM provisions included herein are incorporated into this solicitation either by reference or in full text. If incorporated by reference, see provision 52.252-1 for locations where full text can be obtained. 2. The provision at 52.212-2, Evaluation -- Commercial Items, applies to this acquisition. The specific evaluation criteria to be included in paragraph (a) are as follows: Award will be made using Lowest Price Technically Acceptable (LPTA) process. On a separate sheet of paper, not to exceed 2 pages, the offeror shall provide specific product information demonstrating that the product quoted will meet the salient characteristics provided. The product narrative will be determined as quote mark acceptable quote mark or quote mark unacceptable quote mark (technically acceptable). To be rated acceptable, the offeror's proposed equipment must meet or exceed the salient characteristics identified in CLIN0001. Past performance will be evaluated using PPIRS, FAPIIS or other means and will be rated as quote mark pass quote mark or quote mark fail quote mark. In order to receive a quote mark pass quote mark, the offeror must not have any negative evaluations in PPIRS or FAPIIS in the last three years. Offerors with no relevant past or present performance history shall be treated neither favorably nor unfavorably. Award will then be made on the basis of the lowest evaluated price of offers meeting or exceeding the technical acceptability standards. The government intends to award a contract without discussions with respective offerors. The government, however, reserves the right to conduct discussions if deemed in its best interest. Paragraphs (b) and (c) will be used and remain unchanged. Post-Award Small Business Program Rerepresentation (Jul 2013) (a) Definitions. As used in this clause-- Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority. Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is quote mark not dominant in its field of operation quote mark when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity. (b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following: (1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract. (2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract. (3) For long-term contracts- (i) Within 60 to 120 days prior to the end of the fifth year of the contract; and (ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter. (c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. (d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees. (e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update. (f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.
