Continuation Page RFP VA786-R-15-0138, Bath National Cemetery, Construct Roadway Access RE: Questions and Answers 1.If the pricing falls under $150,000 is it acceptable to use Tripartite Escrow Agreement to meet payment protection purposes? Typically no bid bond is required unless it's over $150,000. Answer: Yes it is acceptable if proposed price is less than $150,000. Therefore FAR clause 52.228-13 ALTERNATIVE PAYMENT PROTECTIONS (JUL 2000) is incorporated to this solicitation. (a) The Contractor shall submit one of the following payment protections: a payment bond; an irrevocable letter of credit; or a certificate of deposit. (b) The amount of the payment protection shall be 100 percent of the contract price. (c) The submission of the payment protection is required within 15 days of contract award. (d) The payment protection shall provide protection for the full contract performance period plus a one-year period. (e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties. (f) When a tripartite escrow agreement is used, the Contractor shall utilize only suppliers of labor and material that signed the escrow agreement. (End of Clause) 2.Will all equipment including debris near the two storage sheds be moved by VA personal except for the 2 storage sheds and the fence? Answer: Need to be coordinated with the facility through the COR and possibly at the pre-construction meeting. 3.What is the approximate temporary location for the sheds during construction? Answer: Need to be coordinated with the facility through the COR and possibly at the pre-construction meeting. 4.Since there was no published spec for this project is everything to reference NYS DOT specs? Answer: Yes 5.Drawing Sheet three has a note to remove privacy fence and install 225 lf of fence I cannot find a spec for what type of fence this is? Answer: A.Per Section 3.0 u. of the SOW, u. Install approximately 225' of 6 foot green vinyl coated chain link fence with vertical faux pine boughs (similar to PrivacyLink 'HedgeLink') to aesthetically shield the Maintenance Yard from the rest of the cemetery along the top of the creek embankment. Cemetery personnel will indicate the location. B.Contractors can search online with the key words, PrivacyLink 'HedgeLink'; C.Also per the SOW, Section 3.0 c., c.All work is to be performed in accordance with New York State Department of Transportation (NYSDOT) Specifications.
