- Justification for Other than Full and Open Competition THIS IS A NOTICE OF INTENT. The Broadcasting Board of Governors/International Broadcasting Bureau (BBG/IBB), Office of Contracts (CON) located in Washington, D.C. intends to negotiate and award a non-competitive contract to Sherzard TOTOWAL Logistics Services, Kabul, Afghanistan. The Contractor is currently providing the services this action covers. The planned sole source award will allow the Contractor to continue to provide the BBG with technical and logistics support services because only this Contractor possesses the capabilities to provide the services necessary for the Agency to meet its broadcasting mission in Afghanistan. The Agency plans to award an Indefinite Delivery-Indefinite Quantity (IDIQ) contract. The contract will require the Contractor to perform: (i) firm-fixed –price task and delivery orders to the maximum extent practicable; and (ii) provide corrective maintenance of damaged facilities and equipment and take corrective action when other unpredictable exigencies indicative of broadcasting in Afghanistan occur on a time and materials (T&M) basis. This contract will include a Base Period with four (4) additional one year Option Periods that may be exercised at the Government’s discretion and subject to the availability of funding. The statutory authority permitting other than full and open competition that is applicable to this procurement is 41 U.S.C. 253(c)(1) which is implemented at FAR Subpart 6.302-1 as follows: “When the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for. After having conducted extensive market research, the Agency has concluded that the required work must be done by a single firm, and that the proposed Contractor is the only source that is presently available that can meet the Agency’s requirements. This is due to the fact that firms are reluctant to accept responsibility for their work in Afghanistan as a result of security concerns experienced by those firms such as roadside bombings and kidnappings. In addition, firms are unable to obtain replacement parts for equipment. The Agency’s requirement must be awarded to a single firm because the use of different firms would necessitate the use of different Contracting Officer Representatives (CORs) as well as increase the complexity of ensuring that the Agency meets its broadcasting mission. The proposed Contractor has been able to provide the Agency with continuous and reliable broadcasting. The proposed Contractor has a unique understanding of the distribution network and logistics in Afghanistan, as evident by its ability to operate and maintain the Agency’s numerous broadcasting sites throughout Afghanistan. Discussions have been held with various firms about their capability to handle the Agency’s broadcasting requirement. These discussions have been fruitless because the firms advised us that they will need to obtain security, hire private helicopters for travel, and they are not able to provide BBG with reliable pricing. The proposed Contractor performed same and/or similar work without experiencing the abovementioned problems and is able to provide reliable pricing. See attachment titled “Justification for Other than Full and Open Competition” for more details. This Notice of Intent is not a request for competitive price proposals. Interested firms must submit a written response that demonstrates their ability to provide the above. See attachment titled “Statement of Work” for additional details. Interested firms must state how they would fulfill the requirement above and include appropriate documentation describing the number of years they have been providing such services. The written response received from interested firms shall provide sufficient detail to allow for an evaluation by the Government without the need for the submission of additional information. The written response must be submitted to Myria Carpenter, Contract Specialist, by Monday, May 13, 2015 12:00pm EDST via email at proposalsubmissionMEDC@bbg.gov. ALL RESPONSES MUST BE SUBMITTED IN "PDF FORMAT" AND INCLUDE THE SOLICITATION NUMBER IN THE SUBJECT LINE. PLEASE NOTE THAT THE TOTAL SIZE OF ALL ATTACHMENTS MUST NOT EXCEED 23MB. Telephone or faxed responses are NOT acceptable and will NOT be considered. Any questions regarding this Notice of Intent shall be in writing and submitted to Myria Carpenter, Contract Specialist via e-mail to mecarpen@bbg.gov and must include the solicitation number in the subject line. Any determination to compete or not to compete this proposed contract is solely within the discretion of the Government. This Public Notice is not an RFP, IFB, or RFQ.
