Description
JUSTIFICATION AND APPROVAL TO PROCEED USING OTHER THAN FULL AND OPEN COMPETITION 1. Identification of the agency and the Contracting Activity The Regional Procurement Support Office (RPSOFR) in Frankfurt, Germany is requested to conduct this acquisition for 25 diesel generators. 2. Nature and/or Description of the Action Being Approved The proposed action is for the award of a purchase order is for the purchase and delivery of twenty-five (25) pre-tested and fueled, 5 kW diesel generators at a unit price of $2,360.00 (total amount $59,000.00), with an option to purchase an additional quantity of twenty-five (25) identical generators at the same price within ninety (90) days after award of the basic order. 3. Description of the Supplies or Services Required to Meet Agency's Needs Twenty-five (25) units of new diesel generators with minimal nominal power of 5KW each, minimum power output of 230V, 50 HZ cycle, 3-phase (400/230V), with mechanical starter, and with one (1) option to purchase an additional quantity of twenty-five identical generators. All generators shall be delivered, pre-tested and fueled before delivery. 4. Identification of the Statutory Permitting Other than Full and Open Competition The statutory authority is 41 U.S.C. 253(c)(2). The regulatory authority is FAR 6.302-2, -- Unusual and Compelling Urgency. 5. Demonstration that the Contractor's Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited. Due to the urgent and compelling need to deliver the generators in less than 30 days, RPSOFR has identified three (3) local companies that have a sufficient number of conforming generators on stock so as to be able to pre-test, fuel, and deliver the required quantity, ready for use, in less than 30 days. Of these three (3) companies, one company has submitted the technically acceptable offer with the lowest evaluated price. Also, the selected company has a satisfactory past performance record from numerous orders performed for the U.S. Government in recent years. 6. Description of Efforts Made to Ensure that Offers Were Solicited from as many Potential Sources as Was Practicable. RPSOFR sought out to several local distributors of diesel generators. Of these, three (3) local companies submitted offers showing that they would be able to deliver conforming generators at the required quantities and within the required time: 7. Determination of the Contracting Officer that the Anticipated Cost to the Government Will be Fair and Reasonable Based on an evaluation/price comparison of the three quotes received, the Contracting Officer has determined that (1) satisfactory price competition is available; and (2) the prices offered by the proposed awardee in the proposed total amount for the basic quantity of generators, $59,000.00, and $118,000.00 for the basic and the optional quantities, is fair and reasonable, price and other factors considered. 8. A Description of the Market Survey Conducted and the Results or a Statement of the Reasons A Market Survey was not Conducted RPSOFR sought out several local distributors of the required diesel generators. Of all vendors contacted, only three (3) vendors were responsive. Other vendors were either not willing to provide the items without pre-payment or did not have a sufficient number of the required generators on stock that could be delivered within 30 days after the award of an order. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition None. 10. A Listing of Sources if Any, that Expressed, in Writing an Interest in the Acquisition None. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Include a statement that this J&A for other than full and open competition will be published on FedBizOpps in accordance with FAR Section 6.305 within 14 days of award (or within 30 days if the J&A is for unusual and compelling urgency.) RPSOFR will continue its effort to identify additional vendors that may have developed capabilities to perform similar services in the future. As required, this Justification and Approval will be published on FedBizOpps in accordance with FAR 6.305 within thirty days after award of the resulting order.
