- RFQ And Statement of Work This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the information in FAR Subpart 12.6, as supplemented with the additional information included in this notice. This solicitation is advertised as a small business set-aside. This announcement constitutes the only solicitation; a written solicitation will not be issued. The U.S. Maritime Administration (MARAD), Norfolk, VA intends to award a firm fixed price purchase order for the provision of marine towing services to relocate the CAPE ANN within the James River Reserve Fleet in accordance with the Statement of Work. Anticipated period of performance will be between a mutually agreed upon date/time with the Awardee and the James River Reserve Fleet from May 6, 2015 through June 15, 2015. (d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. Towing Service Provider (Owner) shall maintain, and shall have, and shall furnish a Certificate of Insurance evidencing the insurance coverage listed below. The expense for such insurance coverages shall be for the Owner's account and shall be deemed to be included in the rates payable under this Agreement. All deductible amounts shall be solely for the Owner's account. •· Broad Form Tower's Liability Insurance (including damage to the Tow) on each Tug performing under this Agreement in the minimum amount customary for the trading limits and adequate for the services contemplated herein; •· Tower's Protection and Indemnity liability insurance on each Tug performing under this Agreement in the minimum amount customary for the trading limits and adequate for the services contemplated herein; •· Hull and Machinery Insurance on the Tug(s) performing under this Agreement, with trading limits adequate for the services contemplated herein. •· Except as otherwise specifically provided herein, the Government shall not be liable for any loss, damage, calls, expense, cost, or liability whatsoever and howsoever incurred by the Owner or Tug, or which are imposed upon Owner or Tug by operation of law which is recoverable under any insurance carried by the Owner. •· Owner shall, to the maximum extent practicable, keep the Government, through the Contracting Officer, currently informed in writing as to the potential vitiation, suspension, lapse, or termination of any of Tug's insurance policies as a consequence of this Charter Party. •· The United States of America shall be named as an additional assured with waiver of subrogation under the Owner's Tower's Liability Policy, under the Hull and Machinery policy (and under the Increased Value policy if applicable), and under the Tug's Protection and Indemnity (P & I) entry. The naming of the United States on Owner's P & I policy shall be subject to the provisions of Owner's Privilege Clause, when such clause is substantially the same as Privilege Clauses standard in the industry.
