- Q&A (DRAFT) SoW (DRAFT) REC Source Types (DRAFT) This notice is a Request for Information (RFI) only. In accordance with FAR 15.202(e), responses to these notices are not offers and cannot be accepted by the Government to form a binding contract. DLA Energy requests market information from contractors about Renewable Energy Certificates. This is for planning and market research purposes only and shall not be considered as an obligation on the part of the Government to acquire any products. Responses will not be considered as proposals, nor will any award be made as a result of this notice. BUSINESS SENSITIVE, PROPRIETARY, OR OTHERWISE CONFIDENTIAL INFORMATION : As information received in response to this RFI may be made available to the public, respondents are strongly advised NOT to include any information in their responses which may be considered business sensitive, proprietary, or otherwise confidential without clearly identifying the information as such. If your company chooses to submit any business sensitive, proprietary, or otherwise confidential information, it must be marked as proprietary or restricted data in the response. Furthermore, DLA Energy will not reimburse respondents for any costs associated with submission of its response to the RFI. Any information provided is voluntary. DLA Energy is seeking information regarding the REC industry's potential response to a 5-year REC Basic Ordering Agreement. This potential BOA would allow other Government (DoD and Federal Civilian) agencies that have an agreement with DLA Energy to order requirements directly from contractors issued a BOA (i.e. BOA Holders). Below are some topics the Government identifies as ‘in-need-of-feedback' from industry. The below topics does not limit industry from asking any question, or providing any feedback in other areas: 1. The Government seeks ideas regarding ordering strategies. For example, DLA Energy understands that we, in the past, have competitively sourced RECs for all our customers, and in very large quantities which proved to produce a more competitive unit price. In keeping with that mindset, DLA has considered a semiannual requirement which would ‘corral' the requirements of its customers (authorized Government Requesting Agencies allowed to order off the BOA) so that the BOA Holders would be gathering requirements and purchasing RECs much like it was done in the past. Please provide feedback on this process. 2. Please provide suggestions to effectively solicit the delivery date as it's tied to the required Vintage dates, or acceptable dates of generation. The Government continues to have its regulation that (generally) prevents the delivery of supplies to far exceed the fiscal year (Oct 1, - Sept 30th) timeframe. In this context, the rule (Bona fide need) is that, in order to obligate a fiscal year appropriation for payments to be made in a succeeding fiscal year, the contract imposing the obligation must have been made within the fiscal year sought to be charged, and the contract must have been made to meet a bona fide need of the fiscal year to be charged. E.g., 70 Comp. Gen. 664, 667 (1991); 64 Comp. Gen. 359, 362 (1985); 35 Comp. Gen. 692 (1956); 20 Comp. Gen. 436 (1941); 16 Comp. Gen. 37 (1936); 21 Comp. Dec. 822 (1915); 4 Comp. Dec. 553 (1898); B-289801, Dec. 30, 2002; B-257977, Nov. 15, 1995. 3. Considering all non-price factors are contemplated to be previously evaluated by DLA prior to receiving a BOA, would the BOA Holders be able to include a Supply Plan once they are requested to submit pricing? The intent would be that all BOA Holders would be given 10 working days to offer on a semiannual requirement in accordance with the already established basic agreement. 4. If the Governments intent is to evaluate price, and a supply/source plan at the time the Government solicits a firm requirement (referencing the theory in c. above), are there any concerns or limitations that prevent those RECs that are to be delivered, differ from the supply plan evaluated with price? In the past, it has been the Governments position that we must verify the supply/source plan prior to accepting an order. Please share any concerns. 5. On March 19, 2015, the White House issued Executive Order (E.O.), "Planning for Sustainability in the Next Decade". Per the increase to the percentage of electric energy that shall be renewable electric energy, is there any concern with REC scarcity over the next 5 years? 6. The Government attaches a Types of RECs (Draft) document. This is not an official document for an official Government Procurement. Upon review, are there any types of REC that is "scarce", and may lack competition? 7. The Government also includes draft copies of a Statement of Work (SoW) and Q&A document. These are not official documents for any official Government Procurement. Presently, the SoW and Q&A represent "talking points" that may, or may not potentially pertain a future BOA procurement. Should the Government intend to issue a subsequent RFP in an official capacity, feedback on any potential flaws in the SoW and Q&A is appreciated. The deadline to respond is Wednesday, April 29, 2015 at 2pm EDT. If a party is interested in a conference call as a result of this RFI, one-on-one meetings are available IAW FAR 15.201(c)(4). A one-on-one meeting shall be requested before the response deadline. These early exchanges are to encourage information among industry and the contracting officer, and other participants in the acquisition process. Its intent is to identify and resolve concerns regarding the acquisition strategy, including proposed contract type, terms and conditions, and acquisition planning schedules; the feasibility of the requirement, statements of work, and data requirements; the suitability of the proposal instructions and evaluation criteria, including the approach for assessing past performance information; the availability of reference documents; and any other industry concerns or questions. Under no circumstances will any exchanges with industry discuss specific requirements. The DLA Contracting Office handling this inquiry is stated below.
