- THIS IS A PRE-SOLICIATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPOSIS TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Station Support Contracts and Simplified Acquisitions Branch (SS/SA) on behalf of the National Institute of Aging (NIA) intends to negotiate and award a contract without providing for full and open competition (including brand-name) to Pierce Biotechnology, Inc, a subsidiary of Thermo Fisher Scientific, at 3747 North Meridian Road, Rockford, IL 61101, for a new service agreement for the ThermoFisher ArrayScan Reader System that will ensure timely service and maintenance by service engineers specially trained and certified to work on the ThermoFisher ArrayScan Reader System. NORTH AERMICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE: The intended procurement is classified under NAICS code 811219 with a Size Standard of $20.5 million. REGULATORY AUTHORITY: The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-80, dated March 2, 2015. This acquisition is conducted under the procedures as prescribed in FAR Part 13-Simplified Acquisition Procedures, Subpart 13.106-1(b)(1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts using FAR Part 13 Simplified Acquisition procedures are exempt from the requirements of FAR Part 6-Competition Requirements. STATUTORY AUTHORITY: The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-80, dated March 2, 2015. DESCRIPTION OF REQUIREMENT: Background: The National Institute on Aging (NIA) Laboratory on Neurogenetics (LNG) owns and operates a ThermoFisher ArrayScan Reader System, specifically, "Thermo Scientific ArrayScan VTI High Content Screen Reader". The servicing of this instrument requires specialized knowledge of a variety of pieces of equipment that are ThermoFisher products. These include, but are not limited to the following equipment: M&S-ArrayScan HCS Reader Platform, and M&S Live Cell Chamber. This ArrayScan Reader is essential to the LNG to provide the resources for the NIA scientific community for the study of neurodegenerative diseases using live cell imaging techniques. Purpose and Objectives: The purpose of this requirement is to procure a new service agreement for the ThermoFisher ArrayScan Reader system that will ensure timely service and maintenance by service engineers specially trained and certified to work on ThermoFisher ArrayScan Reader System. Period of Performance: May 1, 2015 through March 31, 2016. Project Requirements: The contractor shall provide service and maintenance for all portions of the above ThermoFisher ArrayScan Reader System in order to ensure operation of the scanner at maximum performance. This includes but not limited to the scanner computer system, gradient and RF amplifiers, transmit and receiver subsystems, peripheral gating modules, shim coils, magnet, cryogen monitoring and cryogen fills, power supplies, gradient and RF. The specific requirements are as follows: 1. Supply all replacement parts as required on an exchange (good-as-new) or new part basis in order to maintain the equipment at Original Equipment Manufacturer's (OEM's) specifications. 2.Locate a service engineer during the coverage period 8am-6pm, Monday through Friday to assure efficient service of the scanner. 3.Standard Coverage: The Contractor shall provide on-site remedial service and maintenance during normal working hours (from 8:00 AM to 6:00 PM local prevailing time, Monday through Friday). On-call backup service support shall be provided when the on-site service engineer is not available (e.g. holidays, vacations, illness, and training periods). The on-call backup service engineer shall be on the site within three hours of the NIH placing a telephone service request. 4.Regular scheduled maintenance inspections and adjustments shall be performed as specified by the manufacturer for all subsystems of the scanner. Scheduled maintenance shall be performed at a mutually agreed upon time Monday through Friday). 5.Technical support and remote diagnostics shall be provided by the Contractor 5 days per week from 8:00 AM to 6:00 PM local prevailing time, Monday through Friday. 6.The Contractor shall provide upgrade services for the scanner and accessories on an as needed basis. The upgrades shall be subject to the Changes Clause, FAR 52.243-1, Alternate II. Upgrade services include, but are not limited to: delivery/installation of hardware or software, and reconfiguration of the system. The Contractor shall provide all hardware and software necessary for requested upgrades. The Contractor shall continue to provide maintenance of the system as upgraded. 7.Contractor Responsibilities: The Contractor shall provide all necessary documentation, repair parts, spare parts, accessories, maintenance supplies, all special tools, test and support equipment, travel and transportation, personnel skill requirements, and other related services required in performance of maintenance tasks to keep the equipment in good operating condition, except for costs of repairs occasioned by fault or negligence of the Government or its agent. 8.Interchangeability of parts is required, (NRCC Wash C8)(Oct 1992). All replacement/spare parts and supplies to be furnished by the Contractor under this contract shall be guaranteed to be equal in all respects (including performance, interchangeability, durability, and quality) to parts specified by the OEM. 9. This contract will allow the future flexibility to procure hardware and software upgrades as deemed necessary for the system to function at the highest quality of performance. Deliverables / Reporting Requirements Technician certifications must be provided for all service engineers assigned to LNG. A written summary report should be turned in within 24 hours of any service or preventive maintenance visit. Travel to the NIH is the sole responsibility of the Contractor. Mandatory Criteria Service engineers must be specially trained and certified to work on ThermoFisher ArrayScan Reader System. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION: The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research, specifically the review and evaluation of the responses to the sources sought notice published in the FedBizOpps on March 18, 2015, synopsis number HHS-NIH-NIDA-SSSA-PSOL-2015-197, Service for ThermoFisher ArrayScan Reader System. The sources sought noticed closed on March 27, 2015 with no responses. Furthermore, the subject equipment in need of maintenance is proprietary to the manufactuerer-ThermoFisher Scientific, Inc. Research found, past order history, to include a Purchase Order Awarded on 4/4/2014: HHSN271201400248P and indicates that only Pierce Biotechnology, a subsidiary of Thermo Fisher Scientific, is the only authorized re-seller of this equipment and services to this equipment. Market research in PRISM indicates no other vendors have performed service on this equipment. Pierce Biotechnology, Inc is the intended source for this award. CLOSING STATEMENT: This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
