Description
Department of State 2015 Construction for US Embassy Prague, Czech Republic Request for Information - Market Research This is a Request for Information (RFI) as outlined in FAR 15.201(c) (7). The purpose of this RFI is to accomplish market research pursuant to Federal Acquisition Regulation (FAR) Part 10, and to identify businesses capable of performing the functions described herein. The government is requesting information regarding the availability and feasibility of attracting firms to support the requirements of THE U.S. DEPARTMENT OF STATE (DOS), Bureau of Overseas Buildings Operations (OBO) for the Prague, Czech Republic. The project will consist of construction services to construct a Compound Security Upgrade on the campus of the U.S. Embassy Prague, Czech Republic. This notice is issued solely for information and planning purposes and DOES NOT constitute a Request for Proposal (RFP) or a commitment on the part of the government to conduct a solicitation for the below-listed services in the future. Responders are advised that the government will not pay for information submitted in response to this RFI, nor will it compensate responders for any costs incurred in the development/furnishing of a response. Please note that a decision not to submit a response to this RFI will not preclude a vendor from participating in any future solicitation. 1. Project Description (Secret Facility and Personnel Security Clearances NOT Required) The U.S. Embassy is housed in the Schoenborn Palace, within the central historic city core, at Tržiště 15, 118 01 Praha 1 - Malá Strana, Czech Republic. The 10,735 m 2 (11,5551 ft 2) building is a four story masonry structure with basement built between c. 1600 and 1769, acquired by the USG in 1925. The Chancery and Gardens located in a UNESCO World Heritage Area and are Cultural Monuments protected under Czech Law. The project will consist of the construction of Security Upgrades at the Embassy Complex. Construction scope may include: historic perimeter wall replacement and repair, perimeter security fence replacement, a new access pavilion, surface parking, site lighting, a new pedestrian entrance, interior improvements, replacement and relocation of an electrical transformer, main electrical service room and equipment, and back-up generator. The project will require work in historically sensitive areas and will include some restoration of historic finishes. Work on such finishes and the reconstruction of the perimeter wall will require engagement of locally certified craftsmen able to perform the work in the manner required by Czech Heritage Authorities. Approximate construction cost: $9 - 14 million. 2. Project Solicitation: The project solicitation will consist of two phases. Phase I - Pre-Qualification of Offerors This announcement of solicitation of pre-qualification submissions is Phase I. DOS will evaluate the pre-qualification submissions based on the evaluation criteria set forth below. The Government may conduct an information session for interested Offerors prior to the receipt of pre-qualification submissions. A separate announcement will be issued on the Federal Business Opportunities webpage (www.FBO.gov) to specify the location, date, and time. Phase II - Requests for Proposals from Pre-Qualified Offerors Those Offerors determined to be pre-qualified in accordance with this notice will be issued a formal Request for Proposal (RFP) for the project and invited to participate in a site visit and submit technical and pricing proposals in Phase II. Phase II proposals will provide pricing for the construction. The contract will be "firm fixed-price." Construction services will include providing construction labor and materials to execute the design; on-site organization with management to ensure overall project coordination; and overall control throughout the life of the project. Required services include preparation of construction documents, quality control plans, safety plans, project schedules and project close-out activities. The Phase I pre-qualified Offerors will be required to participate in a visit to the project site, anticipated to be within 10 to 15 days after the issuance of the Phase II RFP. 3. Prior Pre-Qualification: - NOT APPLICABLE Complete prequalification package submission required. Detailed Instructions Submission Requirements for Phase I, Pre-Qualification of Offerors: The Offeror shall submit sufficient documentation to allow DOS to evaluate its capabilities with the qualification criteria listed. Submissions that are missing the required information or otherwise do not comply with the submission requirements may be eliminated from consideration at the Contracting Officer's determination. Copies. Provide one original plus one copy in printed form, and one electronic copy in PDF format on compact disc. PDF shall be identical to the printed version and book marked by section, if applicable. DOS may review either the electronic or the printed submittal; therefore, both formats shall be complete and identical to each other. To demonstrate performance of similar construction work for Percy Amendment purposes, offerors will need to provide information demonstrating that it has successfully completed in the United States or at a U.S. diplomatic or consular mission a construction contract or subcontract involving work of the same general type and complexity as the solicited project and having a contract or subcontract value of at least 35% of the low-end estimated value of the solicited project ($3,150,000.00). The value of the work provided to demonstrate successful completion of work of the same general type and complexity as the subject project will not be adjusted for inflation or any other market forces. 3.A. Omnibus Diplomatic Security and Antiterrorism Act of 1986. Firms being considered for award under this acquisition are limited to "United States Person" bidders as defined in the Act. The Offeror must complete and submit as part of its pre-qualification package the pamphlet "Certifications Relevant to Public Law 99-399, Statement of Qualifications for Purpose of Section 402 of The Omnibus Diplomatic Security and Antiterrorism Act of 1986." (The pamphlet is not attached to this FEDBIZOPPS announcement and may be obtained from the DOS Contract Specialist listed at the end of this notice.) If a Joint Venture (JV) is formed, the company having 51 percent or greater interest in the JV must be the one completing the pamphlet. This is a pass/fail evaluated area. Submissions from Offerors who do not receive a pass rating in this area will not be further evaluated. Sufficient information should be provided in the Certifications and attachments thereto to determine eligibility under Public Law 99-399, but the Department reserves the right to consider information available from other sources, or to obtain clarifications or additional information from the Offeror. IMPORTANT NOTE: Organizations that wish to use the experience or financial resources of any other legally dependent organization or individual, including parent companies, subsidiaries, or other related firms, must do so by way of a joint venture. A prospective offeror may be an individual organization or firm, a formal joint venture (where the arrangement among the co-venturers has been reduced to writing), or "de facto" joint venture (where no formal agreement has been reached, but the offering entity relies upon the experience of a related U.S. person firm that guarantees performance). To be considered a "qualified United States joint venture person," every joint venture must have at least one firm or organization that itself meets all the requirements of a U.S. person listed in Section 402. The U.S. person co-venturer will be required to sign a guarantee making the U.S person individually responsible for performance of any contract awarded, notwithstanding the terms of any joint venture agreement. We are seeking Companies in the following Socio-Economic Categories: Small Business (SB), Women Owned Small Business (WOSB), HubZone (HUBZ), 8(a), and Service Disabled, Veteran Owned Businesses under NAICS code 236220. All interested companies must have an active registration in the System for Award Management (SAM) and not be on the Excluded Party List. 4. Technical Requirements 4.A. Submission Requirements and Format: 4.A.1 Organization. Organize submittals by factor according to the list in Section C below. Tab and clearly identify each factor in the submittal. 4.A.2 Language. Use only the English language. Submit an English translation for all information originally provided in another language. If an English translation is not provided, DOS will not review or consider the information submitted only in another language. Non-English language pages are not included in any page counts. 4.A.3 Page Limits. Maximum page limits for each factor are identified in Section C. If a submission exceeds the allowable page limits, DOS may consider only the designated number of pages, starting with the first page of each factor. The pages comprising the pre-printed package required for the Certifications Relevant to Public Law 99-399, and the JV Agreement, where applicable, are not included in any page counts. 4.A.4 Page Size. Pages are based on a single-sided 8 ½" x 11" (or A4) sheet. Page equivalencies are: one double-sided page = two single-sided pages; 11"x17" fold-outs = two pages per side. Except where otherwise specified, the maximum paper size permitted is 11" x 17" (or A3). 4.A.5 Font. Submit offers in size 12 font minimum. Only the Standard Form (SF) 330, required for use by the design subcontractors, may be prepared in size 10 font. SF 330 is available through: http://www.gsa.gov/portal/forms/type/TOP 4.A.6 Color. Submit text as black writing on a white background. Text that is difficult to read due to the use of colored text, colored background, and/or font selection may result in a failure of one or more factors. 4.A.7 Format and Copies. Provide one electronic copy on compact disk and one original plus three copies in printed form. Index the electronic copy identical to the printed version. DOS may review either the electronic or the printed submittal; therefore both formats shall be complete and identical to each other. 4.A.8 Missing Information. A proposal submission discovered to be incomplete or missing the required information may be eliminated from further consideration. 4.A.9 Additional Information. Offerors are cautioned that DOS will consider only the information in the submission and that obtained by DOS from additional sources concerning past performance. 4.B. Definitions: 4.B.1 Where the term "Offeror" is used, it is intended that requirements for the Offeror apply equally to either a single Contractor or to all parties of a Joint Venture (JV), where applicable. 4.B.2 The project(s) included in this solicitation are referenced as "the Project" in Section 4.C. 4.C. CONTENT OF SUBMISSIONS AND FACTORS FOR EVALUATION: FACTOR 1: Joint Venture Agreement/Signed Statement of JV Intent & Description of Partnership. The failure of Factor 1 will result in the failure of the entire submittal. DOS will not review the remaining portions of the submittal if there is the failure of Factor 1. 1.1 Page limit: Three. The JV agreement or Statement of Intent to form a JV does not count against the page limit for this factor. 1.2 If the planned organizational structure for the Offeror is a JV, provide a Statement of Intent to form a JV, signed by all parties to the JV. If a formal JV has already been formed, the JV agreement may be submitted in lieu of the Statement of Intent. If the Offeror is not submitting as a JV, so state. 1.3 Organizations that wish to rely upon the experience or financial resources of any other legally related entity or organization, including parent companies, subsidiaries, or other related firms, must do so by way of a JV or a "de facto" JV. In cases of a "de facto" JV where no formal joint venture agreement is in place, the parties must agree, in writing, to be jointly and severable liable for performance of any contract awarded. 1.4 Describe the relationship of the JV parties. 1.5 Identify each JV party's role. 1.6 Identify the type and percentage of work assigned to each JV party. 1.7 For a "de facto" JV, provide the signed written agreement identified in section 1.3 above. Identify the parties' intended roles in the Project. If the Offeror is organized as a Joint Venture, DOS will evaluate whether the roles and responsibilities of the JV parties have been adequately described. This factor is not applicable if there is no JV or "de facto" JV. FACTOR 2: Technical Project Experience and Past Performance. The failure of Factor 2 will result in the failure of the entire submittal. DOS will not review the remaining portions of the submittal if there is the failure of Factor 2. For factor 2a(1) and 2a(2), there is no specific page limit. Offeror's submittals must be sufficiently complete to conclusively demonstrate each relevant attribute. For each different project, a short project narrative which includes the award and completion date (or the scheduled contract completion date if the project is ongoing). Conciseness, relevance of each narrative, and the organization of responses will be considered in determining the Offeror's capability relative to other bidders. Factor 2a(1): Critical attributes (must include all requested information to be fully considered. This factor may be satisfied with 3 or more projects. Each project need not be responsive to every sub-factor. When considering the project dollar value, only the Offeror's contractual amount will be considered (e.g. the Offeror's project value on a $100M job where they were a subcontractor for $20M of work shall be considered for the purposes of this evaluation as a $20M project. Financial records and references are requested to assess suitability and confirm performance on jobs of similar scope and complexity. The Offeror should expect that the government will contact provided references as part of the review of your experience. Financial: The successful Offeror shall demonstrate the following financial capabilities: 1. Ability to obtain full bonding for the project - This capability shall be demonstrated by providing evidence that the Offeror has bonded a minimum of three projects in the past 5 years of at least 80% of the minimum estimated dollar value 2. Ability to manage project finances - This capability shall be demonstrated by providing evidence in the form of accounting records that demonstrate the Offeror's ability to manage project finances on jobs with accounts payable and accounts receivable balances of commensurate size on at least 3 projects of at least 80% the minimum estimated dollar during the past 5 years. For this project, the estimated maximum three month running average value of accounts payable and receivable is $2.0M for each. 3. Credit worthiness - This capability will be demonstrated by providing evidence in the form of binding letters of credit and bank statements indicating that, if awarded this contract, creditors will extend sufficient credit to the Offeror to fund startup and on-going project operations. This sub-factor shall be considered fully satisfied if the Offeror's total borrowing capacity plus cash on deposit equals to or exceeds 3 months of accounts payable. Organizational: The successful Offeror shall demonstrate the following organizational capabilities: • Ability to manage subcontract formation and administration - This capability shall be demonstrated by providing evidence that the Offeror has managed the process of subcontract formation administration and closeout for at least 3 projects in the past 5 years of at least 80% of the minimum estimated value of this project. For Offerors who intend to self-perform all aspects of this project, adequate evidence shall consist of names and contact information for all suppliers of major equipment, and materials for each representative job. For Offerors who intend to form subcontract agreements with other general contractors, adequate evidence shall include names and contact information of general contractors with whom the Offeror has previously worked. • Ability to establish foreign business operations - This capability shall be demonstrated by providing evidence that the Offeror has established business operations in foreign locations for a minimum of 3 jobs in the past 5 years of at least 80% of the minimum dollar value of this project. Adequate evidence shall consist of business licenses, tax receipts, or other similar documentation showing a business address remotely located from the Offerors home address. • Ability to manage logistics - This capability shall be demonstrated by providing evidence that the Offeror has managed projects with complex logistics on a minimum of 3 jobs in the past 5 years of at least 80% of the minimum dollar value of this project. Adequate evidence shall consist of a brief (300 word maximum) narrative describing each projects principal logistical challenges along with receipts from vendors (e.g. shipping companies, freight forwarders, hotels, travel agents, housing rental companies). For the purpose of this factor, project logistics will be considered "complex" if they possess any three of the following attributes: • conducted outside of the country of normal operations, • projects in locations where business is principally conducted in a language other than the Offeror's native language, • projects where there is limited site area for laydown operations • projects in urban locations with restricted operating hours. • Ability to plan work and manage work to a schedule - This capability shall be demonstrated by providing evidence that the Offeror has completed a minimum of 3 jobs in the past 5 years of at least 80% of the minimum contract value of this project within 7 days of the contract scheduled completion date. Adequate evidence of this capability shall consist of an as-built level 2 schedule showing the "as-planned" start and end dates and "statused" with as-built dates. This schedule should be the original approved project schedule. In the event of contract modifications effecting project duration, the original schedule should be "statused" through the time of modification, and the "re-baselined" scheduled also provided. Schedules should be provided with a brief narrative listing the project start and end dates along with milestone dates affecting the schedule. Schedule and data dates should match the narrative. Schedules used as reporting and forecasting tools (i.e. where durations, activities, and sequencing are regularly updated) are not responsive to this sub-factor. Factor 2a(2) Preferred Attributes The to be fully considered, each Offeror shall submit evidence demonstrating experience on a minimum of 3 projects with 3 or more of the following characteristics and of a contract value in excess of 80% of the minimum project value. Experience on projects of similar size and complexity with: • Has experience working on historically significant and protected structures and landscapes in full compliance with preservation requirements. • Has experience constructing security upgrades compliant with Department of State approved security standards, materials and methodologies. • Has experience in site drainage and courtyard paving installation • Has experience with complex phasing requirements with critical milestone and completion dates • Has experience constructing electrical and mechanical upgrades and installations in existing buildings. • Has experience managing complex construction projects at facilities which must remain fully functional during the entire construction period. • Has experience working successfully in the European Union in compliance with EU building code and labor requirements. 2A.3 Compliance with the Omnibus Diplomatic Security and Antiterrorism Act of 1986 (Omnibus): Section 5, Mandatory Pre-Qualification Requirements, indicates whether this project is required to comply with Omnibus. Project examples submitted to demonstrate technical project experience are permitted to be different than those necessary to demonstrate compliance with Omnibus, if the Offeror desires. 2A.4 Limits on Subcontracting. This project is subject to subcontracting limits of no more than 50% of the total value of the contract, as identified in 22 U.S. Code Section 4852. Subfactor 2B Past Performance 2B.1 Page limit for each explanation in 2B.2 and 2B.3: One. 2B.2 Quality: For the past five years on any project the Offeror was involved with, identify whether the Offeror has had any of the following problems, and if so, explain the reasons for and the remedy/resolution of the problem: 2B.2.1 Been terminated for default; 2B.2.2 Been issued a cure notice; 2B.2.3 Been issued a show cause notice; 2B.2.4 Been assessed liquidated damages; 2B.2.5 Had its performance and payment bond surety notified that the contractor was not fulfilling its contract obligations; 2B.2.6 Had its performance during design or construction evaluated as unsatisfactory or unacceptable; 2B.3 For each relevant project example submitted in 2A, identify performance problems other than those specified in 2B.2 above, including schedule deviations, and describe how the problems were remedied. 2B.4 References: Provide the form attached to the solicitation, Past Performance Questionnaire, to three previous clients for whom the Offeror has completed projects within the past three years. Do not include questionnaires from DOS staff on OBO projects. Instruct the clients to place the completed questionnaire in an envelope, sealed, with the signature of the person who filled out the questionnaire over the seal, and return it to the Offeror. Provide the three sealed envelopes in the submittal. If an Offeror previously submitted information responding to this factor for a different FY12 project, DOS will accept the previously-submitted information. In this case, identify the name of the project and contract number for which the references were submitted. 2B.5 Compliance with DOS Criteria 2B.5.1 The Offeror is not required to submit any information for Section 2B.5. 2B.5.2 DOS will gather information from interviews with the Bureau of Diplomatic Security, OBO's Office of Security Management, and OBO's project staff who have worked with the Offeror, to assist in the evaluation of the Offeror's past performance with respect to compliance with DOS criteria. 2B.5.3 Contractors who have no previous experience with DOS shall be given a neutral rating for this portion of the past performance section. DOS will evaluate the quality of the Offeror's past performance based on information submitted for Factors 2B.1-4. DOS will evaluate the Offeror's record of compliance with Industrial Security and Construction Security requirements for Factor 2B.5. DOS will evaluate the Offeror's record of project completion and close-out, its approach to problem and change resolution, and its responsiveness to issues and problems raised by OBO for Factor 2B.5. Additionally, DOS may gather information from other sources to assist in evaluating the quality of the Offeror's past performance. NOTICE: As prescribed in the Federal Acquisition Regulation at 15.305(a)(2)(iv), an Offeror without a record of relevant past performance or for whom information on past performance is not available will receive a neutral rating. 5. Closing Deadline for Submissions ALL SUBMISSIONS MUST BE RECEIVED BY 3:00 P.M. Eastern Time on May 22, 2015.
