- Solicitation Statement of Work Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR 6.3 and in accordance with the requirements of FAR 6.303-1, the justification for the use of the statutory authority under FAR 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows: (1) Agency and Contracting Activity. The Office of Contract Operations (CG-9127), Formal Contracts Division VII, the United States Coast Guard (USCG) Headquarters, Department of Homeland Security, Washington, DC, proposes to enter into a contract on the basis of other than full and open competition. (2) Nature and/or description of the action being approved. The USCG has a requirement on a sole source basis to obtain forward and aft shock absorbers and associated parts to operate and maintain the C-27J aircraft. Only the Original Equipment Manufacturer (OEM) can meet the fwd and aft shock absorber parts requirement needed to effectively operate, maintain and repair its C-27J aircrafts. The proposed contractor is: Heroux-Devtek Inc 755 Thurber Ave Longueuil, Canada - QC J4H 3N2 Government Business POC: Sylvain Royer Non US phone: 450-6795450 sroyer@herouxdevtek.com (3) Description of Supplies/Services. The Coast Guard seeks to issue one (1) firm-fixed-price order for the procurement of forward and aft shock absorbers and associated parts as listed within purchase request # 2015070-NF01. The Coast Guard desires delivery by May 2015. Lead times vary depending on part - however the CG will accept early deliveries mitigating inventory needs of spare parts. (4) Identification of the justification and the rationale. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c) (1) as implemented by FAR 6.302-1 entitled "Only one responsible source and no other supplies or services will satisfy agency requirements". (5) Demonstration that the nature of the acquisition requires use of the authority cited. The Coast Guard's C-27J Asset Project Office (APO) requires forward and aft shock absorbers and associate parts to effectively operate and maintain its current aircraft located at Aviation Logistics Center (ALC), Elizabeth City. In total there will be 14 C-27J's located at two Coast Guard air stations (Sacramento and Clearwater). At this time there is an immediate requirement for repairs to A/C 2708 and A/C 2714. APPH is the manufacture of the forward and aft shock absorber and associated parts; however in early 2014 the APPH groups of companies were acquired by Heroux Devtek Inc (cage 36164). The shock absorbers and associated parts are currently installed and operated on the C-27J aircraft. There are currently no spares available supporting the needed repairs of the shock absorbers for both A/C 2708 and A/C 2714 respectively. As documented the Air Force transferred all previously procured DoD C-27J spare parts to the Army Special Forces at Fort Bragg. Without the required C-27J forward and aft shock absorbers the Coast Guard may be unable to maintain its goal of 71% availability index (Ai). Just the same prolonging the purchase may cause increased costs, unjustifiable aircraft on ground, while also decreasing evaluation and operational readiness of aicraft. (6) A description of the efforts made to ensure that offers are solicited from as many potential sources as is practicable. In accordance with FAR 5.201, a sources sought of the requirement is encouraged and requested to be advertised on the Federal Business Opportunities Government Point of Entry (FedBizOpps.gov). The notice should indicate the intent to issue an order on a basis of other than full and open competition. A solicitation for this requirement will be posted to fbo.gov upon approval of this J&A. Any eligible offeror may submit a proposal which will be considered by the Coast Guard. However, Heroux-Devtek is the only known Coast Guard C27J APO authorized supply source and any other offeror will be required to submit evidence of the same certification. Approval and certification of any other source will also be required by C27J Engineering division and authorized personnel. (7) Determination by the Contracting Officer that the anticipated cost to the government will be fair and reasonable. In accordance with FAR 15.402(a) & (a)(2), the Contracting Officer is required to purchase all supplies and services from reasonable sources at fair and reasonable prices and will require the Contractor to submit certified cost or pricing data or other than certified cost or pricing data, in order to perform an analysis of the proposal to ensure that the price is fully justified as fair and reasonable to the Government. This analysis will include input by the government Technical Analyst and Contract Specialist. Pertinent data will include prior acquisition history for the same or comparable wheel and brake assemblies. (8) Description of market research. Market research was conducted within the last month to identify new sources of supply for the components listed within purchase request # 2015070-NF01. The following online (WEB) sources were reviewed; Haystack, Inventory Locator Service, Federal Logistics Data, and Federal Business Opportunities supporting the initial market research with no alternate supply sources identified. Since Heroux-Devtek Inc, has acquired the OEM (APPH) for both the forward and aft shock absorbers and other associate shock assembly items, it is assumed that they will ensure product integrity to its specific applications. Technical data packages, specifications, and documentation necessary to enable full and open competition were and have not been procured by the Coast Guard. Based upon current certification requirements, it has been determined that Heroux-Devtek Inc. is the only manufacturer approved for the items being requested. Any eligible offeror may submit a proposal which will be considered by the Coast Guard; however, consideration for this requirement is restricted for review by the Coast Guard C27J APO Engineering and approved personnel. (9) Any other facts supporting the use of other than full and open competition. The 2014 National Defense Authorization Act (NDAA) authorized the transfer of fourteen C-27J aircraft from the United States Air Force (USAF) to the USCG. In accordance with the congressionally mandated requirements associated with the transfer of those aircraft, the USCG must procure the spare parts, components, and supplies required to fully standup and support the C-27J APO tasking. (10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. In accordance with FAR 5.201, a sources sought of the requirement will be advertised on the Federal Business Opportunities Government Point of Entry (fbo.gov) with a notice of intent to issue an order with limited supply sources on a basis other than full and open competition. It is anticipated that Heroux-Devtek Inc. will be the only respondent to this synopsis. If responses to the solicitation indicate that potential alternate sources are available, the file will be documented accordingly and the Contracting Officer will inform the C27J APO engineering staff for review and approval. If the C27J APO engineering staff approves those additional sources indentified the requirement will be competed among all approved sources. (11) A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for required supplies or services. The USCG will continuously conduct market research to ensure that companies interested in doing business with the USCG are given every opportunity to compete for future USCG requirements. In an effort to increase competition, C-27J APO members intend to annually attend aviation trade shows, conduct internet database research, and ensure procurements are advertised in the FBO.
