Description
SYNOPSIS: THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source to MIM Software via a contract in accordance with statutory authority permitting other than full and open competition under 41 USC 253(c)(1), as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements". The Michael E. DeBakey VA Medical Center in Houston TX has a requirement for a MIM Encore, Single User, Concurrent License, three MIM Cardiac Add-On, Single User licenses, installation, and training. MIM Software Cage Code is 545A0 and Duns Number is 136977290. This is a proprietary system available exclusively through this manufacturer. A determination has been made by the government for noncompetition of this proposed contract based upon conducted research and prior release of a Sources Sought Notice with MIM Software being the only respondent. ? STATEMENT OF WORK (SOW) MIM Encore Software Licenses Michael E. DeBakey VA Medical Center (MEDVAMC) 2002 Holcombe BOULEVARD Houston TX 77030 1.PURPOSE The purpose is to procure the following items: "One (1) MIM Encore Single User Concurrent License; "Three (3) MIM Cardiac Add-On single User, License must be added to an existing License; "MIM installation; "Network connectivity; and "Application training 2.SCOPE The contractor shall provide all listed software, installation, network connectivity, and application training. All software must meet salient characteristics listed in this section. The suggested software is MIM Encore OR EQUAL (fully compatible with MIM Encore Version 6.5). MIM Encore Add-On Licenses "Requesting one (1) Single User Concurrent License. "Existing license version is MIM Encore 6.2.3 MIM Cardiac Add-On Licenses "Requesting three (3) single user licenses. "License must be added to an existing license. "Existing license version is MIM Encore 6.2.3. Software Installation, Network Connectivity, and Application Training "Contractor shall provide three (3) days (up to 10 hours per day) of MIM software installation, DICOM / network connectivity, and /or application training. "Contractor shall provide all necessary software installation services, including setup, configuration, calibration, and installation for the above Add-On licenses. "Contractor shall ensure all workstations requiring access to the installed software are able to reach the installed software via the network. " Contractor shall provide all necessary training to the designated VA employees on how to use the installed software after installation and setup are complete. 3.MAINTENANCE/WARRANTY "A one year warranty for any bugs or defects within the software OR issues in network connectivity shall be included with the add on licenses. "The Contracting Officer Representative (COR) or designated alternate is the Contractor's reporting and contact official for all service calls required. "Response time: Contractor's field representative shall respond with a phone call to the COR or his/her designee within one (1) hour after receipt of telephoned notification. If the problem cannot be corrected by phone, the field service representative shall commence work (on-site physical response) within eight (8) hours of receipt of the first notification or as approved by the COR. All required fixes/repairs shall commence without undue delay. "All labor costs shall be borne by the Contractor. If the Contractor is unable to repair the ability to use the software to its normal operational state within 24 hours the Contractor shall compensate the Government for the downtime by extending the warranty service in a period equivalent to the downtime of the software. 4.REPORTS/DOCUMENTATION For any services performed on site, upon arrival at the Medical Center, the Contractor's representative shall check in with the COR before performing any installation, warranty, repairs, and/or maintenance services. This check in is mandatory. After completing the service(s), the contractor's field service representative shall document services rendered on Contractor's service report form. A legible signed service report shall be provided directly to the COR following completion of each call, and shall include equipment identification (i.e. serial number), date, and time of service call, list of services performed, results of inspections and/or calibrations, and a description of work accomplished. The report shall be signed or initialed by the COR or authorized representative. 5.TRAINING The contractor shall furnish four (4) user manual and reference guides for the specified software. 6.DELIVERY. "All software, installation, network connectivity, and application training shall be delivered and conducted at the Michael E DeBakey VA Medical Center (MEDVAMC), 2002 Holcombe Blvd., Houston TX 77030. "Contractor will coordinate with the MEDVAC COR for scheduling the installation and training services. 7.TESTING AND CERTIFICATION Upon completing installation of the system, the Contractor shall notify the COR in writing that the system is ready for acceptance testing, and that it meets all requirements as specified. Submission of this notification of system readiness shall be accomplished by the contractor prior to the beginning of the scheduled Government Acceptance Test. 8.Government Acceptance Test "Contractor shall be required to coordinate with the MEDVAMC Contracting Officer's Representative (COR) in writing that the system is ready for acceptance testing. "Notification of system readiness shall be accomplished prior to starting the scheduled Government Acceptance Test. "Contractor shall perform the Government Acceptance Test in the presence of the COR for proof-of-performance. The Government Acceptance Test shall be performed at a mutually agreed date and time. Upon completing the Government Acceptance Test successfully, Contractor shall document the success of this Government Acceptance Test on Contractor's company form which will be certified by the COR's signature as evidence of Government Acceptance of the installed software. A copy must be furnished to the COR before the Contractor's representative departs the premises.
