- The U.S. Department of Commerce, NOAA, Eastern Acquisition Division-Kansas City (EAD-KC) and the National Weather Service (NWS) intend to award a purchase order to Belfort Instrument Company which will replenish Crossarm Assemblies and End caps for the ASOS Visibility Sensor to replenish logistics spares. All spares for this system are required to be identical to the item which was provided with the original equipment. It is not possible to substitute for this item; any logistical spares must be form, fit, and function identical to the original equipment item. Belfort considers this item as proprietary and is the only known source of supply. The original equipment was subjected to a stringent qualification tests which included operational testing, field testing, and environmental qualification testing. Acceptance of any item other than the original equipment would require that testing be completely reaccomplished. This is not acceptable, as it would require significant funding and time to accomplish and would result in fielded ASOS systems being unavailable during the period. For this reason, only Belfort part number 33135-2 (Crossarm Assembly) and 31190 (Endcap) are deemed acceptable at this time. 25 EA ASOS Visibility Sensor Crossarm NSN: 5340-01-368-4827 78 EA ASOS Visibility Sensor End Cap NSN: 5340-01-389-1359 This acquisition is proposed to be sole sourced to Belfort as the only known qualified source of this part due to the proprietary nature of the design. The intended procurement is for supplies for which the Government intends to acquire under the guidelines of FAR Part 13, Simplified Acquisition Procedures Part 12 Commercial Items. The Government intends to solicit and negotiate with only one known source under the authority of FAR 13.106-1(b). The unique characteristics and physical form of these items make them the only acceptable parts. Because the design is the intellectual property of Belfort Instrument the Government does not have access to the specific design features. The Government has no design rights to the items and does not possess the drawings that specify the parts. The NAICS code for this requirement is 334513. The proposed contract action is for supplies for which the government intends to solicit and negotiate with only one source. Interested persons may identify their interest and capability to respond to the requirements or submit proposals. This sources sought is not a request for competitive proposals. However, all proposals received by closing date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. All responsible sources may submit a proposal which shall be considered by the agency. Interested firms shall include, in writing, the company name, address, point of contact, telephone number, and business size; a statement regarding their capabilities and to provide the supplies. Submissions received in response to this notice shall be evaluated based on the technical ability and demonstrated past experience to meet the requirements described in the description section above.
