Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval {J&A) For Other Than Full and Open Competition {>$150K) 1.Contracting Activity: Department of Veterans Affairs, VISN 20, The Mann-Grandstaff Medical Center has the requirement to continue uninterrupted Primary Care Services for veterans in the Lincoln County, MT Community Based Outpatient Clinic (CBOC) utilizingoooooooooo 2.Nature and/ or Description of the Acti on Being Processed: The Mann-Grandstaff VAMC is currently conducting an internal audit to determine the best avenue for providing Primary Care Services for the veterans at the Lincoln.County, MT Community Base Outpatient Clinic (CBOC). Until the audit results can be reviewed for viability and implemented the Mann-Grandstaff VAMC requires services to continue with the incumbent contractor to ensure uninterrupted services to Veterans in the CBOC catchment area. The current contract (VA260-P-0771) expires May 31,2015 and there are no options or extensions available. 3. 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): In accordance with Federal Acquisition Regulation (FAR) 6.302-1,no other sources can provide the services required for this procurement. Additionally, due to Impending expiration of the current contract there is not sufficient time available to properly process this requirement in accordance with the Medical Sharing Office's review requirements. The VA should have a decision made and implemented before the expiration of this bridge contract. This will allow sufficient time for a proper long term solicitation to be completed and transition from one contractor to another, if necessary. The current contractor meets the VA's standards for performance in providing primary care services to eligible beneficiaries. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This is a follow-on contract with the incumbent contractor that will allow uninterrupted services to continue at the Lincoln County, MT CBOC. Continuation of this contract will help improve local access and reduce beneficiary travel cost. There is not sufficient time to OFOC SOP Revision 03 Revision 03 Date: 10/27/2014 Page 1of 3 compete and transition to a new contractor as the VA requires facility inspections; as well as, contractor employee background checks to be completed. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The price reasonableness has been established as fair and reasonable in comparison with the Independent Government Estimate (IGE) and is in the best interest of the Government. I 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A review of the current contract indicated that there were two-pr-eposals-A-g00gle-sear<::h-was performed seekilinics T e current market research did not yield any differences in the availability of primary care clinics in Libby, MT. If the results of the audit affirm that CBOC services should continue,both contractors will be solicited for the long term acquisition. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None 10.Listing of Sources that Expressed, i n Writing, an I nterest i n the Acquisition: No other parties expressed interest in this acquisition without interrupting services provided to the Veterans in the Lincoln Country, MT catchment area. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The are not other actions available to remove barriers to competition without interrupting services for this acquisition.
