Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: The Veterans Integrated Services Network (VISN) 6 Network Contracting Office (NCO) on behalf of Department of Veterans Affairs, Medical Center, Fayetteville, North Carolina plans to contract by other than full and open competition. 565-15-1-090-0021. 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for Maquet Servo-I Critical Care Ventilator. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Critical Care Ventilators need during patient procedures. 4.Statutory Authority Permitting Other than Full and Open Competition: ( ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( X ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability Or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This Ventilator is the only FDA approved ventilator on the market that utilizes NAVA the NAVA (Neurally Adjusted Ventilatory Assist) delivers vent assist that is directly proportion to the patient's EDI signal. The EDI is a signal that brain sends to the diaphragm to breath. NAVA Technology uses this EDI signal to recognize the patient's effort to provides synchrony with the ventilator; which reduces time spent on the Ventilator, makes weaning the patient off the ventilator better and easier for the patient. The NAVA helps to reduce Ventilator Induced Lung Injury which is caused by asynchrony. ? 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A search of GSA E-Library did not locate contractors interested in this requirement. Three contractors were contacted however none were able to meet the requirement as none had the NAVA feature. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The price is fair and reasonable based on previous purchases sole the Department of Veterans Affairs. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market Research conducted on GSA E-Library category A-49 Oxygen Respirators/Resuscitators in which 34 contractors are listed of which 28 are small business. As mentioned above three contractors were contacted and none meet the requirement. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Hamilton Medical, Covidien, Draeger Medical and PROAIM Medical. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: A determination based on market research will determine if a requirement can be competed as a full and open requirement when a need for new or replacement Ventilators.
