- 1.0 Description: This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Proposals are being requested and a written solicitation will not be issued. This solicitation is issued as a Request for Proposal (RFP) #NLR63310015Q0118. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-81, effective April 10, 2015. The objective of this procurement is to enlist the coaching service(s) of qualified legal writing instructors who have direct experience drafting and writing National Labor Relations Board (NLRB) specific legal documents in order to provide ongoing legal writing coaching support for a set number of participants. 2.0 Agency Background: The NLRB is an independent Federal Agency created by Congress in 1935 to administer the National Labor Relations Act, the primary law governing relations between and among unions, employees, and employers in the private sector. The statute guarantees the right of employees to organize and bargain collectively with their employers or to refrain from all such activity. Generally applying to all employers involved in interstate commerce other than airlines, railroads, agriculture, and government, the Act implements the national labor policy of assuring free choice and encouraging collective bargaining as a means of maintaining industrial peace. Through the years, Congress has amended the Act and the Board and courts have developed a body of law drawn from the statute. The NLRB consists of 51 regional, sub-regional, and resident offices, and a headquarters office. For more information, visit www.nlrb.gov. 3.0 Statement of Work: The selected coach(s) will provide specific guidance on NLRB specific documents to an assigned group of NLRB employees. The maximum number of employees will not exceed 35 (15 employees on the Board side of the Agency and 20 employees on the General Counsel side of the Agency.) The coach(s) must have first-hand knowledge of NLRB writing styles, templates, and documents The topics that may need to be addressed are not limited to but may include the following: - Writing preparation: understanding assignments, pre-writing conference, checklist. - Examining the connection between analysis problems and writing problems. - Getting started: techniques for getting your thoughts down on paper quickly and moving the writing process along at an expeditious pace. - Document introduction, structure and organization: helping the reader. - Organization of law and facts: what's in, what's out, what order. - Paragraphs, sentences, and transitions: working together to create the story. - Details: grammar, word choice, punctuation, and conforming to the NLRB Style Manual - Self-editing: reviewing the document from the reader's standpoint. - Achieving a common understanding of what constitutes good writing, and developing a shared vocabulary for communicating about expectations related to written work products. The coach(s) will review a sample(s) of the employee's unedited work and provide written comment on the above areas or any other area of concern identified by the coach. The coach is expected to follow-up via phone or in person to discuss the identified issues. An initial in-person meeting with the employee and the employee's supervisor is required in order to gather the employee and supervisor's concerns and goals. The NLRB will provide the coach(s) with any necessary documentation such as legal research necessary in order to accurately assess the writer's drafts. The expectation is that the coach will spend around 10-15 hours working with each assigned employee or working on editing documents provided by the employee. The number of assigned employees and schedule will be decided by the NLRB in consultation with the selected coach(s). An in-person meeting is only required for the initial meeting with the employee. All other correspondence and meetings can occur remotely. Deliverable 1: Meetings/Coaching Sessions The coach(s) will have one in-person meeting with each assigned employee and his/her supervisor. Additional meetings will be scheduled by the instructor and/or employee. Deliverable 2: Editing The coach(s) will provide editing services for submitted documents. The documents should not be rewritten. Instead edits should be provided to the employees via written comments/suggestions and or during a live coaching session. Deliverable 3: Evaluation Prior to completion of each employee's coach period, the coach(s) will provide a written evaluation of the employee's weaknesses and areas of improvement. The evaluation will include suggestions on follow-up exercises or resources. 4.0 Contact: All deliverables should be delivered to: National Labor Relations Board Attn: Dustin Norwood 1099 - 14th Street NW Washington, DC 20005 5.0 Period of Performance (POP): • June 1st, 2015 - May 31st 2016 6.0 Security Requirements: The Contractor shall adhere to the security requirements of the NLRB. Performance of this Purchase Order requires that Contractor personnel meet the minimum security clearance or investigation requirements of the NLRB. All Contractor personnel shall be U.S. citizens. There shall be no exceptions to this policy. 7.0 Place of Performance: All work under this Purchase Order must be performed at NLRB Headquarters, 1099 14th Street NW, Washington, DC 20570, or at an alternative work site at the Agency's discretion, should the Agency so require. 8.0 Basis for Award: The NLRB intends to award a Firm Fixed Price Purchase Order to one or multiple awardees. The objective of the NLRB is to select the proposal(s) that represents the best value to the government while meeting or exceeding the requirements. All evaluation factors and their relative importance are set forth in this RFP. The evaluation factors are listed in order of importance. An integrated assessment of proposals using all evaluation factors found in the solicitation will be the basis for award. The award may be made based on the initial submission, with or without discussion, so contractors should submit proposals that clearly meet or exceed the requirements of the RFQ. All responsible sources may submit a proposal which shall be considered by the NLRB. The NLRB is a tax exempt Federal agency; please do not include any sales taxes in proposals for which the Federal Government is exempt. To be eligible for an award, the contractor must be registered in the System for Award Management (SAM) database. A contractor can contact SAMs by email at http://www.sam.gov. 9.0 Evaluation Criteria: Award will be made to the responsible offeror or offerors whose proposal, conforming to the solicitation, will be most advantageous to the Government on the basis of technical, past performance, and price. These factors are listed in order of importance: Factors and Criteria The Government intends to enter into a Purchase Order with the firm(s) who conforms to the RFP and who represents the "best value" to the Government. Factor 1 - Key Personnel Factor 2 - Past Performance Factor 3 - Price Factor 1: Key Personnel: A resume for the facilitator shall be submitted along with "letters of commitment" or "letter of intent" for the facilitator. The resume shall describe the qualifications, capabilities, and experience of the proposed key personnel. The following will be evaluated: a. The degree to which the facilitator is a subject matter expert in the subject matter content by virtue of experience and education. b. The facilitator's experience in coaching others on NLRB specific writing. Factor 2: Past performance: This factor shall be evaluated on a measure of the Government's confidence in the offeror's ability to successfully perform and meet the objective, based on relevant contracts the offeror has undertaken within the past five (5) years or positions that the offeror has held in the past ten (10) years that are both similar in content and scope. No more than three (3) past performance references shall be submitted. Travel expenses will not be reimbursed. 11.0 Proposal Submission: Proposals are to provide the requested information in a brief and succinct manner, making every effort to present information clearly and concisely. Proposals should address the requirements of the project consistent with the evaluation criteria described in this Solicitation. The Offeror shall submit a separate technical and cost Proposal that addresses the Statement of Work.
