Description
General Services Administration (GSA) Public Building Service Leasing Division Justification for Other than Full and Open Competition (REDACTED) Justification and Approval Project No. 2PR0117 Lease No. GS-02P-LPR19216 Proposed Action : The current lease extension expired. The Government requested a new ten (10) year, five (5) year firm Succeeding Lease to secure its occupancy at its current location. Description of Requirement : The term of the current second one-year extension expired and the Government has negotiated a ten (10) year Succeeding Lease, five (5) years firm, with the current Lessor, which will establish a new Lease. There is an anticipated increase in negotiated rent due to the effect of current market rates, the need for a full service lease, the right to return space in whole or in part at any time after the firm term and the cost of amortized General and Customization Tenant Improvement (TI) allowances. Certification of Statutory Authority : 41 U.S.C. 253 § 3304 Unique Qualifications : The current location was constructed to meet the needs of Government but will require some minimal additional TI improvements. I f the Government were to relocate under a competitive lease procurement, substantial TI improvements would be required. Remaining at its current location will require minimum TI improvements, amortized over the firm term. Continued occupancy at the existing location also eliminates the costs associated with a physical move, including moving costs and the cost of replicating telecommunication and data installations (collectively with most of the cost of TI improvements, "Relocation Costs"). A Succeeding Lease will protect the Government's occupancy in a manner that is consistent with its plans will be fair and reasonable. Determination that Anticipated Costs will be Fair and Reasonable : The anticipated cost for the new Succeeding Lease period is fair and reasonable. Based upon a review of market data known to the Lease Contracting Officer and obtained from the internet and local Brokers, the total anticipated Succeeding Lease rent inclusive of shell rent, operating cost, TI and excluding relocation cost, is within the market range as confirmed by a Market Analysis. However, when relocation costs are added to the shell rent, operating cost and TI, the aggregate rental cost at a new location would increase. By staying at the current location and paying the aggregate rent, the Government would realize a savings over the five year Succeeding Lease term. In view of there being no acceptable locations other than the existing Lessor and a cost benefit analysis based on surveyed properties listed and offered, it is therefore determined that it is in the Government's best interest to secure continuing occupancy at the current premises.
