- Section J, Attachment #9, Contract Drawing List, A00008 Question and Answer Report, dated May 8, 2015 SF30_Amendment A00008 This is the final Request for Proposals for the United States Coast Guard requirement to procure up to twenty-six (26) Fast Response Cutters (FRCs) on a Firm Fixed Price (FFP) basis with an Economic Price Adjustment (EPA). Questions and Answers The USCG recognizes that this RFP may be amended, and intends to answer questions on a weekly basis, as needed. Questions concerning this RFP shall be submitted in accordance with the instructions provided in the attached letter, and RFP, by June 12, 2015. Limited Access/Export Controlled Attachments to RFP Section J, Attachment #2 and Section J, Attachment #9 are subject to Export Control limitations or have otherwise restricted distribution, and have been deemed "limited access" and "export controlled" packages within the FBO system. Vendors will require an "explicit access" grant by the USCG in order to view the documents via the FBO system. In order to access these documents, vendors must be certified as a US or Canadian contractor by the Joint Certification Program (JCP) administered by the Defense Logistic Information Service (DLIS). Instructions and procedures for being certified by JCP can be found at http://www.dlis.dla.mil/jcp/. Only those vendors that have current certification by JCP will be able to be granted explicit access to these packages by the USCG. Other than the documents which cannot be released, the USCG does not intend to grant vendors access to these documents outside of the FBO site. Supplemental Technical Data The USCG is also distributing the supplemental data and referenced materials that constitute the Reprocurement Data Licensing Package (RDLP) from the Phase I FRC contract as a part of this RFP. Included in this data is a 3-D model of an FRC. Documents that cannot be released will be made available to potential Offerors in a controlled reading room. This data in its entirety is subject to Export Control Limitations. As such, potential Contractors and subcontractors interested in receiving a copy of the supplemental data from the RDLP must be certified as a US or Canadian contractor by the Joint Certification Program (JCP) administered by the Defense Logistic Information Service (DLIS). Only those vendors that have current certification by JCP will be able to receive a copy of the RDLP. Please see the attached RFP letter with information regarding distribution of the supplemental RDLP information, as well as reading room access instructions. Limited Use and Non-Disclosure Requirement The USCG has procured a license to use, reproduce, and disclose to others the drawings and data from its existing FRC contractor Bollinger Shipyards, Inc. for the limited purpose of soliciting competitive proposals for the construction of up to 26 FRCs. The drawings and data contained in the RFP may or may not include restrictive markings. No vendor or any other person who gains access to the RFP may use the contents of the RFP, whether marked with restrictive markings or not so marked, for any purpose whatsoever except to submit questions and a response to the RFP to the USCG. Any use of the contents of the RFP beyond the limitation on the USCG's license will injure the USCG and the USCG's existing FRC contractor, and will subject the vendor or any other person who so uses those contents to criminal and civil liability. Any vendor, by seeking access to the RFP, acknowledges the foregoing limitations on the USCG's use and disclosure of drawings and data, acknowledges the fact that any use of the contents of the RFP beyond the limitation on the USCG license will injure the USCG and the USCG's existing FRC contractor, and will subject the vendor and any other person who so uses those contents to criminal and civil liability, and agrees to exercise maximum control over the disclosure of the RFP within the vendor's organization and to other persons so as to prevent such injury from occurring.
