Description
PDF of Combined Synopsis-Solicitation (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The solicitation number is 153267. The solicitation is issued as a Request for Quote (RFQ). (iii) This solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-81. (iv) The corresponding NAICS code is 511210 and the small business size standard is $38.5 million. (v) List of contract line item number(s) and items, quantities and units of measure - One 12-month base period and four 12-month option periods of a custom dtSearch Publish Annual Service Bureau license package, to begin on 07/01/2015. Please reference dtSearch License ID 7543-670. To be technically acceptable, the product quoted shall be dtSearch brand ONLY. Please see section viii for the "Brand Name Justification." (vi) Description of Requirement - The Department of Health and Human Services (DHHS) Office of Investigations (OI) is a federal law enforcement agency with statutory law enforcement authority. Within OI, the Digital Investigations Unit (DIU) is a specialized unit of Forensic Computer Examiners (FCEs) that provide investigative, operational, and technical support to OI special agents in the area of digital forensics. In connection with their mission, the DIU requires a wide variety of forensic software and equipment in order to complete the forensic analysis of electronic data. The dtSearch license is one such type of software. (vii) The period of performance shall be as follows: Base Period: 07/01/2015 - 06/30/2016 Option Period I: 07/01/2016 - 06/30/2017 Option Period II: 07/01/2017 - 06/30/2018 Option Period III: 07/01/2018 - 06/30/2019 Option Period IV: 07/01/2019 - 06/30/2020 (viii) The provision at FAR 52.212-1, Instructions to Offerors - Commercial Items (APR 2014), applies to this acquisition. (ix) The provision at FAR 52.212-2, Evaluation - Commercial Items (OCT 2014), applies to this acquisition. The Government will award a contract resulting from this synopsis/solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Quoters must demonstrate that they are authorized dtSearch resellers. Additionally, FAR 52.217-5, Evaluation of Options (JUL 1990), applies to this acquisition. (x) Offerors are to include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items (MAR 2015), with its offer or acknowledge its listing in the System for Award Management (SAM) website. (xi) The clause at FAR 52.212-4, Contract Terms and Conditions - Commercial Items (MAY 2015), applies to this acquisition. (xii) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (MAY 2015), applies to this acquisition. The Contracting Officer has indicated the following clauses listed in paragraph (b) as applicable and are hereby incorporated by reference: (25) 52.222-3, Convict Labor (JUN 2003); (27) 52.222-21, Prohibition of Segregated Facilities (FEB 1999); (28) 52.222-26, Equal Opportunity (MAR 2007); (30) 52.222-36, Affirmative Action for Workers With Disabilities (OCT 2010); (40) 52.223-18, Encouraging Contractor Policies to Ban Text Messaging While Driving (AUG 2011); (44) 52.225-13, Restrictions on Certain Foreign Purchases (JUNE 2008); and (49) 52.232-33, Payment by Electronic Funds Transfer - System for Award Management (JUL 2013). (xiii) Brand Name Justification - OI/DIU requires the use of the dtSearch license to allow continuity of operations for the FCEs in the performance of their duties relating to forensic analysis of electronic data/digital evidence in criminal investigations. OI/DIU's current and past investigations have used the dtSearch license; thus, continued use of the license is required to allow the FCEs to access and compare previous investigation results. Additionally, use of the dtSearch license enables the FCEs to efficiently complete investigations, as they are trained in the use and application of the tool and have prepared investigations with the knowledge of the license's capabilities. (xiv) The clauses at FAR 52.217-9, Option to Extend the Term of the Contract (MAR 2000); FAR 52.232-40, Providing Accelerated Payment to Small Business Subcontractors (DEC 2013); HHSAR 352.203-70, Anti-Lobbying (MAR 2012); and HHSAR 352.222-70, Contractor Cooperation in Equal Employment Opportunity Investigations (JAN 2010), apply to this acquisition.
