Description
Statement of Work Contract Line Iten Numbers (CLINs) Combined Synopsis/Solicitation Congressional Reporting, SP4705-15-R-2010 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation number SP4705-15-R-2010 is issued as a request for proposal (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-82, effective 7 May 2015. The associated North American Industrial Classification System (NAICS) code for this procurement is 511210 ( Software Publishers ) with a small business size standard of $38,500,000.00. This is an unrestricted RFP. The government has a need for a subscription for online access to the sources, tools, and features identified within that attached Statement of Work (Attachment 1, Section 3.0 Technical Requirement) for up to 15 user licenses within DLA Legislative Affairs, DLA Financial Services, and DLA General Counsel combined. The Government intends to award a firm fixed price contract with a six (6) month base period, and two (2) sequential one (1) year options. In accordance with FAR 13.103, use of standing price quotations is authorized provided pricing information is current and the Government obtains the benefit of maximum discounts before award. Please see the Statement of Work (SOW) for a complete description of the specific requirements. The Statement of Work (SOW) is contained in: Attachment 1. The anticipated award will be a Firm Fixed Price Contract; the award will be made based on the lowest price; technically acceptable. The Government intends to evaluate and award a contract without discussions with offerors. The Government will award the contract resulting from this solicitation to the responsible offeror whose proposal, conforming to the RFP will be the best value to the Government. The award will be made on the basis of the lowest evaluated price of proposal meeting or exceeding the acceptability standards identified under Subfactor A and Subfactor B for non-cost factors (lowest price technically acceptable/LPTA). Proposals will be reviewed for completeness and evaluated for acceptability against the following evaluation factors: Factor 1: Technical Capability Sub-Factor A: • Detailed examples demonstrating how the offeror's proposal meets Government SOW General Requirements, Analytic Requirements, Federal Legislative Tracking Requirements, Transcripts and Testimony of the online subscription to provide continuing online support and access to real-time news, analysis, and commentary on all congressional matters for at 15 users within. These capabilities shall include: • Reports on every public markup on Capitol Hill, every bill taken to markup, and information on every vote on each bill. • The ability to search markup bills online by keyword or committee for the last 10 years. • Transcripts of all defense related congressional hearings including those held by all Armed Services committees, Defense Appropriations committees/subcommittees to include ad hoc requests for hearing coverage within a 24 hour period and a 24-48 hour turn-around. This must also include a minimum of 10 years of transcript archives. System must also include a legislative impact service that details the relationship between pending legislation and current law. • A full email alert capability that can be user-customized to a high degree for content, relevance, and frequency. A single alert that can be established to search nearly all available sources by bill number, key words/phrases, and date. • Continuous tracking of bills as they progress through Congress. • 24/7 legislation tracking and complete news and transcript coverage. • All key legislative tracking and reporting services. These services include daily news stories, markup coverage, and transcripts. Search and alert functions integrated into these services to allow one-touch search of multiple data and information sources. • Flexibility in adding/deleting and changing users on short notice. Sub-Factor B is Detailed demonstration of the contractor's capability to accomplish the Government's Other Requirements - except for Past Performance - as outlined in the Statement of Work (SOW). Factor 2: Past Performance / Performance Confidence Assessment. Provide specific examples of past performance for the last three (3) years to enable assessment of: •• Aspect One is Relevancy of Prior Projects. •• Aspect Two is Quality of Historical Projects. Factor 3: Price Options: The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award (1) Factor 1: Technical Capability: Technical capability will be evaluated based on an evaluation of Technical Capability Factor; the factor will be rated as Acceptable or Unacceptable. Acceptable is defined as the quote clearly meets the required items identified under Subfactors 1 and 2. Unacceptable is defined as the quote does not clearly meet the requirement of the solicitation. A vendor's technical proposal will be considered technically acceptable if its proposal clearly addressed the required items under Section 3.0, Technical Requirement of the SOW. Quotations that do not meet this requirement will be considered unacceptable and will not be considered for award. All proposed licenses must include the specification clearly demonstrate how the licenses proposed will meet requirement identified within the SOW. (2) Factor 2: Past Performance (A) Past Performance - Relevancy of Prior Projects - Contractor must identify at least three projects or contracts which are similar in nature to this solicited requirement. To be considered relevant, offeror must demonstrate ability to perform similar license for government or commercial entities equivalent in magnitude. (B) Past Performance - Quality of Historical Project - Contractor must identify at least three projects or contracts which are similar in nature to this solicited requirement. To be an acceptable quality, the project must be capable of meeting the Technical Requirement as mentioned within Section 3.0 of the SOW. Each past performance citation will be rated on an acceptable/unacceptable basis (see definitions below). These ratings will be based on information obtained from telephone calls to points of contact listed on the citations, as well as sources of information obtained by the Contracting Officer. The Offeror must receive an Acceptable rating to receive an award. This rating is based upon past performance information as follows: RATING DEFINITION Acceptable Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown. (See note below.) Unacceptable Based on the offeror's performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort. Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a) (2) (iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, "Unknown" shall be considered "Acceptable. (3) Factor 3: Price: Price will be evaluated in order to determine if it is reasonable in accordance with FAR Parts 13.106-3 and 15.4. Offers should be sufficiently detailed to demonstrate their reasonableness. Contract line item numbers and items, quantities and units of measure, options and periods of performance in Attachment 2. Offerors must complete Attachment 2 (CLINs). AWARD PROCESS: The Government will first evaluate all quotations on an acceptable/unacceptable basis. Acceptable quotes will then be ranked according to price for both the base period and option years. The lowest priced offeror who is technically acceptable with acceptable past performance will receive the award. The award will be made to that offeror without further consideration of any other offerors. A written notice of award or acceptance of the offer mailed or otherwise furnished to the offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept the offer, whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. THE FOLLOWING TERMS, PROVISIONS AND CLAUSES ARE APPLICABLE TO THIS ACQUISITION: (x) FAR 52.212-3, Offeror Representations and Certifications - Commercial Items (Nov 2013), with Alternate I, is applicable to this acquisition. (d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law. (e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause- (i) 52.203-13, Contractor Code of Business Ethics and Conduct (Apr 2010) (41 U.S.C. 3509). Proposals shall have separate sections addressing the three Evaluation Factors (Technical Capability, Past Performance, and Price). The Technical Capability must address both Subfactor A and B. Submission hard copy shall include one (1) original version, and four (4) redacted copies of the Factor 1 Technical Capability and Factor 2, Past Performance. Submission for the Price factor shall require one (1) original. The redacted copies shall remove any reference to the vendor's name. The original copy must include the Cage Code, DUNs, and RFP # SP4705-15-R-2010.
