- NOTICE OF CONTRACT ACTION (NOCA) - AFLCMC/EBDK intends to issue a sole-source contract to The Boeing Company, Saint Louis MO, for production of the Small Diameter Bomb I (SDB I) weapon system. The Government anticipates award on or about 30 June 2015 of an Indefinite Delivery/Indefinite Quantity (ID/IQ) order using a firm fixed price contract type. The SDB I weapon system includes All Up Rounds (AURs). The statutory authority which permits other than full and open competition for this acquisition is 10 United States Code (USC) 2304(c)(1) as implemented by FAR 6.302-1. This authority is supported by an approved SDB I Class J&A. Under the contemplated order, The Boeing Company will provide all supplies necessary for approximately 268 AURs. This notice neither constitutes a Request For Proposal (RFP) nor an Invitation For Bid (IFB), nor does it restrict the Government in any way to an ultimate acquisition approach. THIS IS NOT A REQUEST FOR PROPOSAL, AND IS NOT TO BE CONSTRUED AS A COMMITMENT BY THE GOVERNMENT. The Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1. In accordance with FAR 5.207(c)(16)(ii), all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Submission of any of these documents shall be at the contractor's expense. Capability statements shall demonstrate how the source can provide engineering sustainment services for the SDB I system without substantial duplication of costs to the Government or unacceptable schedule delays. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. AFLCMC Headquarters has appointed an Ombudsman to hear concerns from potential offerors relating to this acquisition. The Ombudsman does not diminish the authority of the Program Director or Contracting Officer, but communicates contractor concerns, issues, disagreements, and recommendations to the appropriate Government personnel. When requested, the Ombudsman will maintain strict confidentiality as to the source of the concern. The Ombudsman does not participate in the evaluation of proposals or in the source selection process. Matters of a routine or administrative nature concerning this acquisition should not be addressed to the Ombudsman, but rather the Contracting Officer.
