- Notice of Intent to include brand name components in a future contract for the Village of Richton Park Water Main Replacement - Section 219, Cook County, IL Provisions set forth by the Federal Acquisition Regulation (FAR) 6.302-1(a) (2) (ii) (A) authorizes the use of brand name only supplies in solicitations/contracts when supplies may be deemed to be available only from the original source in the case of a contract requiring the use of highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in substantial duplication of cost to the government that is not expected to be recovered through competition. As such, for the purposes described hereunder and in accordance with the Federal Acquisition Regulation (FAR) Subpart 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements, coupled with the Authority 10 U.S.C. 2304(c)(1), the Army Corps of Engineers, Chicago District intends to issue a competitive solicitation that will include brand name only items. Specifically, the winning contractor will be required to purchase the following brand name Critical Systems in support of Village of Richton Park Water Main Replacement Contract: Fire Hydrants - East Jordan Iron Works, Inc. (6 each), Tapping Saddles - Smith-Blair, Inc.(40 each), Corporation Stops - Mueller Company (40 each), Curb Stops - Mueller Company (40 each), Curb Boxes - Mueller Company (40 each), Valve Boxes - Tyler Union (6 each), Valve Box Stabilizers - Adaptor Inc. (6 each) Note: Critical Systems are defined as components that are in either intermittent or continuous operation and that would cause additional failures within the Village of Richton Park Water Main Replacement should they no longer become operational. The use of the original manufacturer of materials and components is required to prevent issues of system functionality and extensive additional costs. The use of any other manufacturer would cause a need to replace in essence complete parts and accessories thus creating complete new systems. Therefore, the future contract will need to use brand name descriptions peculiar to one manufacturer for a specific system with whom a turn-key solution can be provided meeting all government requirements. The government has already developed plans and specifications to install the Water Main Replacement Systems and intends to utilize competitive procedures for the future solicitation/contract of the construction project requiring the brand name only components. The future solicitation will be numbered as W912P6-15-B-0002 and competed as a small business set aside. The North American Industry Classification System (NAICS) for the project is 237110 with a small business size in dollars of $33.5M. Interested parties may identify their interest and submit clearly articulated product information. Product information lacking the particular features that do not meet, or cannot be modified to meet, this agency's needs cannot be considered.
