Description
A provision of the Competition in Contracting Act (CICA) of 1984, authorizes non competitive contracts to be performed by only one or a limited number of sources via 10 U.S.C. 2304(c)(1); Federal Acquisition Regulation (FAR) 6.302-1(a) (2) (iii) (A) and (B). As such, for the purposes described hereunder and in accordance with the Federal Acquisition Regulation (FAR) Subpart 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements, coupled with the Authority 10 U.S.C. 2304(c)(1), the Army Corps of Engineers, Chicago District intends to execute, without competition, a bilateral Contract Modification under Contract W912P6-14-C-0014 (sole source, Modification P00001). The incumbent Contractor is TRADE WEST CONSTRUCTION, INC.; the address for this organization is 211 W. 1st South St., Suite E, Mesquite NV 89027-6320 with Company Cage Code No. quote mark 1MSR9. quote mark This proposed action involves structural improvements to the Northeast (NE) Breakwater sections immediately adjacent to the existing project work limits of the Chicago Harbor Breakwater. The resulting modification would implement new firm fixed-price (FFP) Contract Line Item Numbers (CLINs) as summarized below. The provisions of these new CLINs would allow for significant remediation and prevention of further deterioration of breakwater sections immediately adjacent to the failure repair area. The work items to be included in the proposed modification are: (1) Additional stability grouting of 68' (feet) of the structure encompassing two adjacent breakwater crib sections; and (2) Placement of a concrete overlay on a 94'-3 quote mark length of breakwater to include the current exercised Option Area as well as the adjacent crib sections referenced in item (1). Concrete overlay work also requires associated surface improvements including reconstruction of existing stair blackouts for access, disposal of existing mooring posts, repainting breakwater survey markers, and extending existing relief wells to the new surface elevation. The proposed modification would augment to the Contract's Bid Schedule the following line items: Additional Stability Grouting: CLIN 0022 - Grout Containment Barrier CLIN 0023 - Drilling CLIN 0024 - Hole Connections CLIN 0025 - Grout CLIN 0026 - Performance and Payment Bond Placement of Concrete Overlay and Surface Improvements CLIN 0027 - Concrete Overlay Additional grouting will be required to reinforce the structural stability of the breakwater. The incumbent contractor, Trade West Construction Inc, has recently performed this grouting work on this exact breakwater structure on two separate contract occasions. That is, they performed grout stabilization on 752 LF of the NE breakwater during 2010/2011, and the 111 LF under the 2014 contract, which is ongoing. The experience of Trade West Construction Inc. on the NE breakwater structure makes the Contractor uniquely postured to perform the proposed modification work over the next few months. The grouting, which composes the majority of the cost of the modification work, requires specialized materials and equipment to which the Contractor already has access. The Contractor has proven its ability to perform the work successfully within the limitations of stringent environmental restrictions on the breakwater and in the waters of Lake Michigan. The incumbent Contractor is currently performing demolition and construction activities at the site. The proposed modification work is located directly adjacent to the current contract work limits. Due to the confined footprint of the breakwater itself and the equipment required to perform the work, it is unreasonable to expect two separate contractors to coordinate the work activities simultaneously. Therefore, to avoid undue delay, the proposed work would be most efficiently performed by Trade West Construction Inc., concurrently with the current work. The incumbent Contractor has gained extremely valuable, specific experience during a 2010 contract for similar work, and the current contract, which includes the NE breakwater. The history and configuration of the breakwater structure make its structural condition unpredictable by visual inspection alone. Thus, the incumbent Contractor with current familiarity with the rehabilitation work on the NE is best positioned to utilize available resources and experienced personnel to perform the proposed work. These factors, combined with the importance of the coordination of the proposed work and existing project activities (discussed above), make Trade West Construction Inc. the only responsible source for the proposed work, thereby avoiding undue delays and duplication of costs. The primary purpose of this notice is to publicize this contract action prior to contract modification, as mandated in FAR Subpart 5.2 (Synopses of Proposed Contract Actions) and FAR Subpart 6.3 (Other Than Full and Open Competition). The contract type will remain firm fixed-price, construction, and the period of performance will be extended slightly, if at all. This notice is not a formal solicitation or request for proposal.
