- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC) Office of National Ocean Service (NOS) Project to Repair Heating, Ventilating, and Air Condition (HVAC) Unit Located at the Flower Garden Banks National Marine Sanctuary (FGBNMS) Galveston Labs Building 216, Galveston Texas Identification Number: WC-133C-15-RQ-0477 1. Identification of the agency and contracting activity (FAR 6.303-2(b)(1)). The NOAA Acquisition and Grants Office (AGO) Eastern Acquisition Division located in Kansas City, proposes to enter into a contract on a basis of other than full and open competition in support of the NOS FGBNMS Galveston Lab located in Galveston Texas. 2. The nature and/or description of the action being approved (FAR 6.303-2(b)(2)). NOAA intends to award a firm-fixed contract to Mesa Mechanical located in Galveston Texas to make repairs to the HVAC; including repairing or replacing the chiller line, isolation valves, and insulation. Repairs are needed to correct a large leak from the HVAC system and to replace any parts that might be damaged due to excessive moisture. 3. A description of the supplies or services required to meet the agency's needs (including the estimated value) (FAR 6.303-2(b)(3)). The requirement is to repair or replace the chiller line, isolation valves, and insulation to correct and stop a large leak from the existing HVAC system located at NOS FGBNMS Galveston Labs Building 216 in Galveston Texas at the cost of $49,960 for the period of performance of 60 days. These repairs will prevent possible HVAC failure and further water damage to the building. 4. An identification of the statutory authority permitting other than full and open competition (FAR 6.303-2(b)(4)). The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(2) as implemented by paragraph 6.302-2 (b) of the Federal Acquisition Regulation (FAR) 5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority (FAR 6.303-2(b)(5)). The NOS FGBNMS Galveston Labs Building 216 is approximately 100 years old and is eligible for the National Register of Historic Places. The building falls under the protection of the Historic Properties located at 4700 Avenue U Galveston, Texas. Building 216 houses the administrative offices for the Flower Garden Banks National Marine Sanctuary (FGBNMS), which includes research, laboratory, and office space, and a large meeting and exhibit room. Recently, the Government discovered a large leak coming from the HVAC unit located in the attic area of Building 216. This severe leak has caused damage to the HVAC equipment and to areas on the first and second floors of the building. There is a concern that the leak could get worse or that the HVAC system could shut down entirely. The chiller loop which provides make-up air in the building is failing to reduce the humidity in the building, therefore raising concern of safety of personnel (staff) due to potential mold problems. Since the equipment is old and appears to be in danger of shutting down, it is critical to get work immediately started to prevent any further damage or building shut down. FGBNMS would likely be forced to cease operations if there is a HVAC failure which would have consequential impacts on the sanctuary research program. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR 5.2 and, if not, which exception under FAR 5.202 applies (FAR 6.303-2(b)(6)). In accordance with FAR 5.202(a)(2), a synopsis was not issued for the services described herein. Due to the determination that the nature of this work is of unusual and compelling urgency, the Government would have been seriously injured should this work be delayed to allow full and open competition. 7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable (FAR 6.303-2(b)(7)). The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on the technical evaluation conducted by the project manager and estimator on April 28, 2015. The contractor's quote and the IGCE were very close, with the IGCE being slightly higher. 8. A description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted (FAR 6.303-2(b)(8)). N/A due to the considerations listed in paragraph six above. 9. Any other facts supporting the use of other than full and open competition (FAR 6.303-2(b)(9)). All facts have been documented in paragraph five above. There are no additional facts to be reported in this section. 10. A listing of any sources that expressed a written interest in the acquisition (FAR 6.303-2(b)(10)). None. Requirements were not synopsized due to urgency. 11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated. The Government will continue to conduct thorough market research to gauge the marketplace capabilities for future requirements. The Government will seek competition of future acquisitions for these services. 12.
