- LIMITED SOURCES JUSTIFICATION ORDER >$150,000 FAR PART 8.405-6 2237 Transaction # or Vista Equipment Transaction #: 436-15-1-112-0001 This acquisition is conducted under the authority of the Multiple Award Schedule Program. The material or service listed in par. 3 below is sole source, therefore, consideration of the number of contractors required by FAR Subpart 8.4 - Federal Supply Schedules, is precluded for the reasons indicated below. Restricted to the following source: BD Diagnostic Systems 7 Loveton Circle Sparks, MD 21152 1 The requested material or service represents the minimum requirements of the Government. (1) AGENCY AND CONTRACTING ACTIVITY: Department of Veterans Affairs, VISN 19, Rocky Mountain Network. (2) NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED: This is a VISN 19 wide requirement that will support the Fort Harrison, Sheridan, Cheyenne, and Grand Junction VAMCs. The requirement to be approved is for the sole source acquisition of Becton Dickinson Diagnostics Systems(BD) Bactec FX Instruments (top unit) along with the compatible BD Bactec Blood Volume Monitoring Software for one base year and four option years. (3)(a)A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEED: The equipment named above is the only available hardware/software system on the market that automates the College of American Pathologist's accreditation requirement that specifies that testing labs have a system to monitor the volume of blood collected in each Blood Culture vial. BD is the only vendor of a patented resin media that can neutralize antibiotics with Lytic media that increases detection of bacteria contained inside white blood cells. (b)ESTIMATED DOLLAR VALUE: $303,240 (c)REQUIRED DELIVERY DATE: July 1, 2015 (4) IDENTIFICATION OF THE JUSTIFICATION RATIONALE (SEE FAR 8.405-6), AND IF APPLICABLE, A DEMONSTRATION OF THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SUPPLY OR SERVICE. 1Specific characteristics of the material or service that limit the availability to a sole source (unique features, function of the item, etc.). Describe in detail why only this suggested source can furnish the requirements to the exclusion of other sources. The BD BACTECBlood Culture System is the only commercially available FDA approved fully automated microbiology growth and detection system that incorporates resins. Incorporating unique resin formulations have been shown to effectively neutralize antibiotics and increase recovery of organisms over standard media. Furthermore, the BD BACTEC blood culture system is the only system to offer two premium media anaerobic bottle types. In addition to the resin anaerobic media, the BD BACTEC Lytic bottles contain a unique lysing agent to increase detection and recovery of organisms partially phagocytized by white blood cells. BD BACTEC blood culture bottles have a unique safety neck, designed to be used with adapters that fit standard phlebotomy tubes. Bottles from alternative suppliers require the addition of multiple adapters and additional staff training. Improper training and incorrect use can result in the risk of increased needle stick injuries and contamination rates. The MD flexible and unique modular design, maximizing valuable floor space by offering the smallest footprint available in the market and thus the most number of bottles per linear foot. The BD provides advanced data management for all BD Microbiology systems. (5) DESCRIBE WHY YOU BELIEVE THE ORDER REPRESENTS THE BEST VALUE CONSISTENT WITH FAR 8.4 TO AID THE CONTRACTING OFFICER IN MAKING THIS BEST VALUE DETERMINATION: These units are on an FSS schedule (V797D40095) which assures competitive pricing. Several products offered by vendors to include Biomerieux Inc, Siemens Healthcare Diagnostics, and Thermo Scientific were reviewed. Although Biomerieux Inc offered a small product, they did not offer a fully automated microbiology growth and detection system that incorporates resins. Neither Thermo Scientific nor Biomerieux Inc offers a product with level sense technology. The level sense technology measures the additional volume in each media bottle attributed to the amount of blood from the patient added to the media at the initial inoculation. This determination is important in determining the validity of the culture - too little blood added means that the test is suboptimal and may need to be repeated. No other vendor has this. Biomerieux states they are working on such a feature but do not have it at this time. Thermo Scientific does not either. Thermo Scientific does not offer a fully automated microbiology growth and detection system that incorporates resins. Siemens does not offer this type of blood culture analyzer system. (6) DESCRIBE THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED: Contracts for Federal Supply Classification (FSC) Groups 65 and 66 items are mandatory for use by VA and can be found at the following sources. FSS and NAC schedules were reviewed for SIN 66 III, Clinical Analyzers, Laboratory, Cost per Test, Category 605-51, Clinical Microbiology Analyzers. Three schedules were reviewed: BECTON DICKSON AND COMPANYV797D-400957 LOVETON CIRCLESPARKSMD21152 BIOMERIEUX INC.V797P-7128A100 RODOLPHE ST.DURHAMNC27712- SIEMENS HEALTHCARE DIAGNOSTICS,V797D-30175115 NORWOOD PARK, SOUTHNORWOODMA01062-4633 (7) ANY OTHER FACTS SUPPORTING THE JUSTIFICATION: The software provides the user with multiple standard reports, as well as the ability to write your own unique reports. This reporting can show epidemiological trends and metrics that are correlated to clinical care. With the BACTEC automated blood culture system, BD is the only manufacturer to offer Blood Volume Monitoring which allows customers to measure, track, and report blood volumes of blood culture bottles. This unique feature aids in meeting CAP regulatory requirements and allows the user to take corrective action when the expected volume draws are not within the recommendations. (8) A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS THAT LED TO THE RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE: The government will continue assess competitor products and market availability for best value and fair and reasonable price. The government will continue to monitor all FSS schedules available for new entrants providing microbiology products, services, and technologies. (9) REQUIREMENTS CERTIFICATION: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
