- This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the information in FAR Subpart 12.6, as well as supplemented with the additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. This combined synopsis/solicitation SHALL be posted on both FEDBIZOPPS and NECO (http://www.neco.navy.mil/). The RFQ number is N00244-15-R-0035. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-82 and Defense Federal Acquisition Regulation Supplement (DFARS) Publication Notice 20150602. The North American Industry Classification System (NAICS) code is 811219 and the business size standard is $20.5M. The Government intends to solicit and negotiate with only FEI Company under the authority of FAR 6.302-1(c). FEI Company was found to be the sole provider of for the preventative maintenance of the Osiris Tecnai Transmission Electron Microscope in the United States of America. No other entity is known to provide this type of Original Equipment Manufacturer (OEM) approved maintenance. See Justification and Approval (J and A) Document Attached. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE QUOTES. However, all proposals or quotations received by the closing response date will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. THIS NOTICE IS FOR INFORMATION ONLY AND IS NOT A REQUEST FOR PROPOSALS OR A SOLICITATION OF All prospective offerors are cautioned that in the event the Government is unable to determine price reasonableness based upon the offers received and market analysis, the Government will not issue a contract. This decision is solely the decision and the right of the Government. All efforts performed and all costs expended by prospective offerors in providing information requested by the solicitation are not subject to reimbursement by the Government. Additional DFARS contract terms and conditions applicable to this procurement are: 252.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items including 252.225-7001, Buy American Act and Balance of Payments Program; 252.232-7003 Electronic Submission of Payment Requests and Receiving Reports. N00244L332, UNIT PRICES (OCT 2001) (FLC SAN DIEGO) Contractor unit prices, when incorporated into a Government contract, will be released under the Freedom of Information Act (FOIA) without further notice to the contractor submitter. If the Contractor takes issue with the release, it should submit its proposal data with the appropriate legends and explain in detail why such data cannot be released as a public record under the Freedom of Information Act.
