Description
PRE-GRANT PUBLICATION DATA CAPTURE (Draft SOW) The United States Patent and Trademark Office (USPTO) has a unique opportunity to support the Office of Data Management (ODM) with Pre-Grant Publication Data Capture. The USPTO is required to publish pending utility and plant patent applications eighteen months after the earliest effective filing date unless a non-publication request has been filed. The data capture services necessary to create the Pre- Grant Publication are the subject of this Request for Information (RFI). The purpose of the pilot project is to determine if there is sufficient competition that can meet the expected volumes and production schedules and meet or exceed the USPTO quality standards and expected volumes. The USPTO desires to identify vendors capable of performing Pre-Grant Publication data capture services. The pilot program further allows the USPTO to determine whether the vendors can demonstrate compliance with the requirements and reliably produce patent data products for public dissemination within the standards of the contract. Although the USPTO is unaware of specific new technologies required to achieve a successful outcome, vendors that are interested in participating, vendors that are interested in participating are encouraged to utilize any innovative means and technology in order to produce deliverables that meet or exceed USPTO quality and timeliness standards. The USPTO may award pilot project contracts to multiple participants. The associated North American Industry Classification System (NAICS) code for this requirement is 511199 (All Other Publishers), proposed Federal Supply Code (FSC) is 7690 (Miscellaneous Printed Matter), and Small Business Size Standard is 500 employees. Estimated ceiling amount is $20 million. This RFI is not a request for proposals/quotes and the USPTO is not committed to award a contract pursuant to this announcement. Contractors are hereby notified that as a result of USPTO's exemption from the Competition in Contracting Act, the subject requirement may be procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act, 35 U.S.C. 2(b)(4)(A). If the PTAG Alternative Competition Method is used, the solicitation may only be issued to those determined to be capable of providing the required services or products. This determination will be made based on USPTO's market research, including the responses to this RFI. During the performance of the pilot project, the current Patent Data Capture (PADACAP) contractor, Reed Technology and Information Systems, Inc. (RTIS), will continue to fulfill all requirements of the PADACAP contract. The work being completed under the pilot project will be transparent and will not interrupt or change the requirements of the PADACAP contract. The draft Statement of Work (SOW) provides the requirements of the Pre-Grant Publication Data Capture process for the Pilot. An ISO 9001:2008 Certification is not mandatory for the performance of this pilot. However, please indicate whether you are already ISO 9001:2008 Certified or if you are currently seeking ISO 9001 Certification. Any future Patent Data Capture contracts will require, at a minimum, an ISO 9001:2008 Certification. If your organization can only fulfill a portion of the requirements outlined in the Statement of Work, please identify the requirements you can fulfill. The information from this RFI is for planning purposes only and will assist the USPTO in formulating its acquisition strategy. This is strictly market research and the USPTO will not pay for any costs incurred in the preparation of information for responding to this RFI. Instructions for RFI Respondents: Questions may be submitted during the period of June 15, 2015 through June 26, 2015. Submissions shall be delivered via email to Hope Smith, Contracting Officer, at hope.smith@uspto.gov and should not exceed 3 MB in size. On subject line of e-mail, please indicate Capability Statement - Pre-Grant Publication Data Capture Questions. The due date for submission of the information below is 5:00 PM Eastern Standard Time (EST), July 20, 2015. All submissions shall be submitted electronically to Hope Smith, Contracting Officer, at hope.smith@uspto.gov. On subject line of e-mail, please indicate Capability Statement - Pre-Grant Publication Data Capture. The response should be no longer than twenty (20) pages not exceed 3 MB in size and shall include, at a minimum: 1.) Point of Contact Name, Company Name, Address, Email, Phone, DUNS number, and GSA FSS contract number, if applicable; 2.) An indication of whether teaming is intended, and if so, identification of each vendor involved in the team; 3.) The applicable GSA Schedule number(s), if available, for each vendor involved in the response; 4.) Past performance summary of work performed that was of similar size and scope over the past 3 years. 5.) Which type of business, if applicable, your organization is, as registered and validated at the System for Award Management (SAM) at https://www.sam.gov. 6.) Please state how your organization could provide the following capabilities based on the draft SOW and in accordance with the Technical References: •· Ability to meet production volume and schedules based on relevant experience (see B.2/B.3); •· Ability to meet the quality requirements; and, •· Ability to provide automated and innovative solutions. Responses marked "Proprietary" will be handled accordingly. This notice is not a request for competitive proposals.
