- June, 11, 2015 SUBJECT: Limited Sources for Contract Award VA244-15-C-0334 The Lebanon VA Medical Center experienced a sink hole in a parking lot on 5/29/2015. Upon investigation it was discovered that the sink hole had been caused by a failure in a pipe which is part of the underground storm water management system. The pipe collapsed and caused the ground underneath to wash away and the parking lot to collapse. The time required to conduct a full and open competition for the required repairs would have caused significant delays in awarding a contract to repair the damaged storm water management pipe and repair the parking lot. The delay by conducting a full and open competition would have potentially led to the expansion of the sink hole, caused more storm water management pipes to fail and caused damage to more of the parking lot. IAW FAR 6.302-2 and FAR 5.502(a)2 the contracting officer determined that due to the urgent nature of the repairs and the potential for significantly higher costs due to further damage that it was in the best interest of the government to limit competition for the necessary repairs. The contracting officer conducted a search of the VETBIZ website and found 5 SDVOSB companies operating under NAICS 237110. The contracting officer conducted an oral solicitation with five SDVOSB firms and issued an IFB to each. There was a site visit conducted on 6/1/2015 with all five vendors being present. The contracting officer requested sealed bids to be submitted by 6/5/2015. The contracting officer received timely bids from all five SDVOSB firms. The contracting officer promptly opened the bids and sent the bid results to all five bidders. Harger Utility Contractors was the apparent low bidder. The contracting officer conducted a review of the low bidders offer and made a responsibility determination, and awarded the contract for the required repairs to Harger Utility Contractors on 6/10/2015.
