- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ACTIVITY: Department of the Air Force, 1st Special Operations Contracting Squadron/LGCA, Hurlburt Field, FL 32544. II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED This action will be awarded as a sole source, firm fixed price contract. The Fire Restoration clean up from a fire extinguisher discharge in HQ AFSOC Annex was regarded as an unusual and compelling emergency that permitted rapid response in accordance with Federal Acquisition Regulation (FAR) Part 18.104 and 6.302-2(a)(2). A contract will be executed between ServPro of Fort Walton Beach Inc. and the United States Government. III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS AFSOC/SG is in need of Fire Restoration clean up services to be provided at HQ AFSOC Annex on the first floor after a fire and contaminants from a fire extinguisher discharge. IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION Authority for this sole source requirement is conducted through 41 U.S.C. 3304(a)(1), only one responsible source and no other supplies or services will satisfy agency requirements as implemented by FAR 6.302-1(a); only one responsible source. V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE The emergency nature of the acquisition in accordance with FAR Part 18.104 and 6.302-2(a)(2), requires the authority cited above. The need for rapid response was required for mission continuation, therefore, the local vendor, ServPro of Fort Walton Beach Inc., was regarded as the best option for this emergency. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE Due to the quick response required for the acquisition, offers were not solicited from any other vendors in accordance with FAR Part 6.302-2(c)(2). VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE The contracting officer will utilize techniques recommended in FAR 13.106-3 to determine the price fair and reasonable. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED Market Research was not conducted prior to performance due to the unusual and compelling urgency of the requirement to clean up hazardous materials in accordance with FAR Part 18.104. IX. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED N/A X. CONTRACTING OFFICER'S CERTIFICATION In accordance with FAR Part 18.104, the acquisition was regarded as an unusual and compelling urgency. The contracting officer's verified that certified funds were available with 1 SOCPTS in accordance with FAR Part 32.702. XI. TECHNICAL/REQUIREMENTS PERSONNEL'S CERTIFICATION N/A XII. CONTRACTING OFFICER'S CERTIFICATION The contracting officer's signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief. XIII. TECHNICAL/REQUIREMENTS PERSONNEL CERTIFICATION As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete.
