Description

The Office of Acquisition and Agreement Management (OAAM), of the National Institute of Standards and Technology (NIST), on behalf of the Material Measurement Laboratory (MML), intends to negotiate on a sole-source basis with FEI Co., under the authority of 41 US 3304 (a)(1), for maintenance Avizo software licenses and the purchase of Avizo XWind. Maintenance shall be for a base period of one year and two one-year option periods. The Materials Measurement Science Division (MMSD) of MML at NIST has numerous research efforts related to the manipulation and visualization of three-dimensional (3D) datasets. To fulfill this effort, MMSD currently utilizes the Avizo software suite (Avizo Lite and Avizo Fire) for processing, manipulating, and displaying the aforementioned datasets. MMSD often produces finite element analysis and computational flow dynamics simulation data, which is complex and difficult to visualize. To this end, the MMSD requires Avizo XWind to enable the capability of rendering finite element analysis computation flow dynamics simulation data within the Avizo software suite. In addition, MMSD requires maintenance for all Avizo licenses to ensure that the software licenses are functioning in accordance with the manufacturer's specifications and to enable technical support from the manufacturer. Sole source is based on the fact that FEI has proprietary rights to the Avizo software suite. FEI is the sole provider of all software updates for the software suite and technical support services. FEI does not have any distributors or resellers capable of providing the required software and service. The North American Industry Classification System (NAICS) code for this acquisition is 511210 - $38.5M. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by 4:00 p.m. Eastern Time on July 9, 2015 will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
