Amendment 1 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 and 13.5, Test Program Procedures for Commercial Items as supplemented with additional information included in this notice. The resultant purchase order will include all applicable provisions and clauses in effect through the federal Acquisition Circular 05-24. This announcement constitutes the only solicitation; proposals are being requested and no additional written solicitation will be issued. This solicitation is issued as a request for proposals. Please reference solicitation number HSTS07-15-R-00041 on all correspondence. This solicitation is being issued as a Total Small Business Service Disabled Veteran Owned Set-Aside. The North American Industry Classification System (NAICS) is 424990/ Other Miscellaneous Nondurable Goods Merchant Wholesalers, not specified elsewhere, manufacturing, with a small business size standard of 100 employees. The proposed contract will be an indefinite delivery/indefinite quantity (IDIQ) on a firm fixed price basis. This combined synopsis/solicitation is for the purchase of Tactical Mission Ready Bags. Please Note: 1. This requirement is for Tactical Mission Ready Bags, and Kissel compliancy is required, supporting documentation must be included in the quote package. 2. For all proposed products supporting documentation shall be provided with response to this synopsis/solicitation. Failure to comply with this and all other terms and conditions here in shall render the proposal unresponsive and exclude the offer from competition. 3. The delivery and shipping is as follows: Egg Harbor Township, NJ. A complete shipping address shall be provided to the successful offeror upon issuance of award. 4. The anticipated award is less than 30 days from response due date and time, Wednesday July 8, 2015 at 12 PM EST. FAR 52.212-1 Instructions to Offers - Commercial Items (June 2008) applies to this acquisition. Addendum to 52.212-1: c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers. FAR 52.212-2 Evaluation-Commercial Items (Jan 1999) The Government anticipates award on a firm fixed price five year Indefinite Delivery Indefinite Quantity (IDIQ) resulting from this solicitation to the responsible offeror whose offer conforming to solicitation will be most advantageous to the Government, price and technical acceptability factors will be considered. All proposals will be evaluated on a low price technically acceptable (LPTA) basis. To receive consideration for award, a rating of pass/fail will be given for the Technical Evaluation factor. Proposals that do not respond to all requirements in the solicitation may be rejected without further evaluation, deliberation, or discussion. The Government may reject any proposal that is evaluated to be significantly not compliant with the solicitation requirements, or reflects a failure to comprehend the complexity and risks of the work to be performed. The government reserves the right to award without discussions with Offerors. GENERAL INSTRUCTIONS FOR THE PREPARATION OF PROPOSALS (OCT 2008) (o) KISSELL AMENDMENT AND TRADE AGREEMENT ACT APPLICATION (1) Offerors' attention is drawn to HSAR 3052.225-70 Requirement for Use of Certain Domestic Commodities (DEVIATION 13-01) Pages 15 and 16 of the solicitation. Additionally, an appendix is attached to this solicitation to provide further guidance on the Kissell Amendment (See Attachment B -Kissell Amendment Tutorial Appendix). Offerors should thoroughly review and familiarize themselves with each of these provisions as they are likely to address any questions offerors may have regarding the application of the Kissell Amendment. Additionally, please take note that this acquisition is also covered by the Trade Agreements Act, see page 81 under Section K- Representations and Certifications." (2) Offerors' attention is also drawn to the Attachment A spreadsheet (Components Specifications CLIN List-Revised) to this solicitation, specifically the column named "Kissell Covered Item Yes/No" for each CLINs. Items are indicated with a "Yes," "Yes*," "No" and "No*." A "Yes" means that CBP has determined that the item is a Kissell-covered item. This means that Offerors are required to provide a Kissell-compliant item. A "No" means the item is not Kissell-covered. If an item is not Kissell-covered, Offerors will not be required to provide a Kissell -compliant item. Items with a "No*" are mostly those items where specifications permit either leather or synthetic material equivalent and it is unclear whether offerors will be proposing items containing textiles or not. Items with a "Yes*" are mostly those items where specifications require both leather and synthetic. If the Offeror chooses to propose an item that contains textiles in accordance with the description of textiles in 6 USC 453b for either a "No*" or "Yes*" item, that item must be Kissell-compliant. Please be advised that regardless of whether an item is Kissell-covered or not, the Trade Agreements Act applies to all CLIN items. (3) Offerors shall submit compliant items for all the Kissell-covered items indicated on Attachment A unless a Non-Availability Determination request has been granted. Offerors wishing to make a Kissell Non-Availability Determination request shall submit such requests at least two weeks prior to the closing date for the solicitation. This request shall contain a master index of the items for which the offeror is requesting a Non-Availability Determination. Each item for which a Non-Availability Determination is sought shall be supported by the following information, at a minimum; (A) A description of the foreign and domestic items; (B) Quantity; (C) Cost; (D) Time of delivery or availability; and (E) A detailed justification of the reason for use of foreign items (4) It is incumbent upon offerors to clearly and fully support any request for a Non-Availability Determination. Requests that do not include all of the minimum information required will not be considered. Offerors are requested to also provide information about any change to the specification for the item which would permit it to be sourced as Kissell-compliant. Any recommended change(s) must be clearly indicated and described. Technical Factors: The proposal will be evaluated on a pass/fail basis to determine whether the Offeror's proposed product's ability to meet the minimum stated requirements specified herein. The proposal will be evaluated to determine the extent to which it provides an effective, efficient, and achievable method for accomplishing the work to be performed within the required timeline. The Government will assess the proposed product's ability to meet/exceed the stated minimum requirements, as well as the comprehensiveness of the proposed warranty. The design and features of the proposed product shall be thoroughly described. Any claims of features or capabilities that exceed the minimum requirements shall be fully supported. The Offeror shall detail the proposed Tactical Mission Ready Bags, per the salient characteristics. The technical evaluations will be conducted to ensure samples are in conformance with all specified requirements. Samples must achieve a no less than acceptable rating and failure to meet any or all requirements, as stated in this solicitation, shall render the sample technically unacceptable and shall be removed from competition to include future consideration for award. Proposed products shall comply with all technical requirements herein to ensure compatibility and durability. The following are the required technical requirements: A. The Tactical mission ready bags, with B. The bags must meet the following Dimensions: Main Compartment Dimensions: 28.75"H x 15"Lx13"D / Top Half Dimensions: 28.75"Hx15"Lx2"D; Bottom Half Dimensions: 28.75"Hx15"Lx10.25"D; Reinforced corners and bottom skids; Four external carry handles; Heavy duty wheels and axle; Collapsible handle; Five external pockets; Internal, roll-away dividers. C. The bags must have an Ultra-durable 1600D nylon; Moisture and weather resistant D. Vendor must provide supporting documentation verifying that the tactical ready bags are Kissel Compliant. E. The Government requests a 1 each sample (at no cost to the Government) for all submissions. The sample will be used for technical evaluation and testing purposes and therefore shall not be returned. Samples must be sent to the following address: Attention: Brad Felling 601 S. 12th Street Freedom Center / TSOC Annex Arlington, VA 20598-6104 Delivery Schedule: The Offeror shall provide its production lead time (measured from date of delivery order award to the receipt of the first shipment), as well as the maximum quantity of Tactical Mission Ready Bags that can be delivered per month. See Attachment 1: Delivery Schedule. Offerors shall include proposed delivery schedule. The Government encourages a less than 30 day delivery schedule, however requires a no later than 30 day delivery. Price Factors The Government will evaluate price by multiplying the maximum quantity for each quantity range by the corresponding unit price. The totals for each quantity range within each ordering year will be added to establish the total evaluated price. The total evaluated price is for evaluation purposes only and should not be confused with the maximum ordering ceiling for the resulting contract. The Government may determine that an offer is unacceptable if the prices are significantly unbalanced or are unreasonable high or low. The offeror shall provide the pricing by providing a unit price for each range quantity for all five years. See Attachment 2: Pricing Schedule for additional information and line item quantities. Oferors are cautioned that all range quantities for each year must have a corresponding unit price. Failure to do so will result in the Offeror being determined as non-responsive. The Offeror must submit a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items (Aug 2009), with its proposal. An offeror shall complete only paragraph (b) of the provision if the offeror has completed the annual representation and certification electronically at http://orca.bpn.gov. If an offeror had not completed the annual reps and carts electronically at the ORCA website, the offereof shall complete only paragraphs (c) through (m) of this provision. As used in this clause- (1) "Commercial," as applied to an item described in subsection (b) of this clause, means an item of supply, whether an end product or component, that meets the definition of "commercial item" set forth in (FAR) 48 CFR 2.101. (2) "Component" means any item supplied to the Government as part of an end product or of another component. (3) "End product" means supplies delivered under a line item of this contract. (4) "Non-commercial," as applied to an item described in subsections (b) or (c) of this clause, means an item of supply, whether an end product or component, that does not meet the definition of "commercial item" set forth in (FAR) 48 CFR 2.101. (5) "Qualifying country" means a country with a memorandum of understanding or international agreement with the United States under which DHS procurement is covered. (6) "United States" includes the possessions of the United States. (b) The Contractor shall deliver under this contract only such of the following commercial or non-commercial items, either as end products or components, that have been grown, reprocessed, reused, or produced in the United States: (1) Clothing and the materials and components thereof, other than sensors, electronics, or other items added to, and not normally associated with, clothing and the materials and components thereof; or (2) Tents, tarpaulins, covers, textile belts, bags, protective equipment (such as body armor), sleep systems, load carrying equipment (such as field packs), textile marine equipment, parachutes or bandages. (c) The Contractor shall deliver under this contract only such of the following noncommercial items, either as end products or components, that have been grown, reprocessed, reused, or produced in the United States: (1) Cotton and other natural fiber products. (2) Woven silk or woven silk blends. (3) Spun silk yarn for cartridge cloth, (4) Synthetic fabric or coated synthetic fabric (including all textile fibers and yarns that are for use in such fabrics), (5) Canvas products. (6) Wool (whether in the form of fiber or yarn or contained in fabrics, materials, or manufactured articles), (7) Any item of individual equipment manufactured from or containing any of the fibers, yarns, fabrics, or materials listed in this paragraph (c). (d) This clause does not apply-- (1) To items listed in (FAR) 48 CFR 25.104, or other items for which the Government has determined that a satisfactory quality and sufficient quantity cannot be acquired as and when needed at United States market prices; (2) To incidental amounts of non-compliant fibers if the total value of non-compliant fibers contained in the end item does not exceed 10 percent of the total purchase price of the end item; or (3) To items that are eligible products per (FAR) 48 CFR Subpart 25.4. (End of clause) Additionally, offerors are advised that the following clauses will pertain to any contract award: release of Information: The Contractor shall not disclose, advertise, or release information about this contract to any individual or organization without prior written approval from the Contracting Officer. Proposal Submission Guidelines The Offeror shall submit a proposal which responds to the RFP requirements, presents the Offeror's capabilities, and is comprehensive enough to provide a substantive basis for evaluation by the Government. The Government will neither assume nor consider anything that is not specifically addressed; therefore, submissions should be sufficiently detailed to permit a complete and accurate evaluation.
